This permit, issued on 511319-) , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) In order to protect juvenile shrimp populations, no excavation or filling will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the N. C. Division of Coastal Management. (2) The bulkhead and boat ramp on the Rozier property will be reconstructed in accordance with the project plans. The boat ramp must not exceed the original dimensions without a modification of this permit. (3) All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. (4) Vegetated wetlands will not be excavated or filled. (5) Excavation will not exceed 5 feet below the elevation of mean low water (MLW). (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Narrative description The applicants property is located in the Galleon Bay Subdivision on Topsail Island and at the head of a man- made canal which enters Stump Sound. This canal is approximately minus 5 feet mean low water in its center and has been designated by the N.C. Division of Marine Fisheries as a primary nursery area. This year's winter storms caused a significant ocean overwash to occur at this location which resulted in the head of the canal adjacent to the applicants property being filled in with coarse sand material. This filled in area is up to 120 feet long by up to 120 feet wide and is at an elevation of approximately plus 1 feet above mean high water. The applicant is requesting a permit to maintenance ex- cavate this area by dragline to a depth of minus 5 feet mean low water. 'The approximately 2,200 cubic yards of sand material which is to be excavated will be placed on the applicants and adjacent property owner lots so that they can fill their property to there original prestorm elevation. Any excess material will be hauled away. The applicant also wishes to rebuild an approximately 95 linear foot bulkhead which will approximate his lot boundary. 10. Anticipated impacts The project as proposed will result in the excavation of approximately 9,000 square feet of canal area which is presently filled in to an elevation of plus 1 feet above mean high water. The approximately 2,200 cubic yards of coarse sand material which is excavated will be placed on adjacent highground or trucked away. This area has been designated by the N.C. Division of Marine Fisheries as a primary nursery area. Narrative description The applicants property is located in the Galleon Bay Subdivision on Topsail Island and at the head of a man- made canal which enters Stump Sound. This canal is approximately minus 5 feet mean low water in its center and has been designated by the N.C. Division of Marine Fisheries as a primary nursery area. This year's winter storms caused a significant ocean overwash to occur at this location which resulted in the head of the canal adjacent to the applicants property being filled in with coarse sand material. This filled in area is up to 120 feet long by up to 120 feet wide and is at an elevation of approximately plus 1 feet above mean high water. The applicant is requesting a permit to maintenance ex- cavate this area by dragline to a depth of minus 5 feet mean low water. The approximately 2,200 cubic yards of sand material which is to be excavated will be placed on the applicants and adjacent property owner lots so that they can fill their property to there original prestorm elevation. Any excess material will be hauled away. The applicant also wishes to rebuild an approximately 95 linear foot bulkhead which will approximate his lot boundary. 10. Anticipated impacts The'project as proposed will result in the excavation of approximately 9,000 square feet of canal area which is presently filled in to an elevation of plus 1 feet above mean high water. The approximately 2,200 cubic yards of coarse sand material which is excavated will be placed on adjacent highground or trucked away. This area has been designated by the N.C. Division of Marine Fisheries as aprimary nursery area. Increase levels of turbidity can be expected by this project but could be minimized if excavation is timed periods of least biological activity.
