Resources and Community Development permit, issued May 15, 1987, and modified November 25, 1987, which authorizes the deepening and enlargement of a canal and construction of a bulkhead and. pier on Davis Creek, Wanchese, Dare County, North Carolina. You are hereby informed that your modified proposal, as indicated by the enclosed plans, continues to be consistent with the provisions and objectives of Department of the Army general permit No. SAWC080-N-000-0291. Therefore, you may continue construction activity in strict accordance with State authorization. Failure to comply with the State authorization or conditions of the general permit could result in a violation, of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) A silt fence will be installed at each end of the canal prior to excavation and will remain in place for 48 hours after excavation has been completed. (2) Excavation will not exceed 8 feet below the elevation of normal water. (3) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the plat. (4) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surroun- ding waters. (5) The bulkhead will not extend waterward more than one foot from the mean high water level at any point along its alignment at the time of construction. (See attached sheet for Additional ?-onditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit, expires on December 31. 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (7) Any additional fill material from sources other than spoil from the excavation will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (8) All disturbed areas must be provided with a ground cover sufficient to restrain erosion. (9) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTUs or less are not considered significant. (10) The permittee will maintain the authorized work in good condition andin conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. NOTE: Future development on the permittee's property may require a modification of this permit. Contact a representative of the Division of Coastal Management at 338-1558 for this determination prior to taking such action. NOTE: The proposed project is certified under General Water Quality Certification No. 1272 issued on November 10, 1978, for bulkhead construction. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The bulkhead will be positioned in strict accordance with permit plans. It will not be aligned farther waterward than an average distance of 1 foot from the normal water level (NWL) elevation contour. b. All excavated materials will be confined landward of the normal water level (NWL) elevation contour and any irregularly flooded vegetated wetlands or landward of the authorized bulkhead. c. Excavation will not exceed 8 feet below the elevation of normal water. d. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. -2- e. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. f. Project rummary The applicant proposes to excavate and bulkhead a boat basin and canal on a creek off of Croatan Sound at Wanchese to prepare the site for a private boat dock for small commercial fishing boats.: VICTOR ROLLINSON BIO REPORT PAGE 2 SITE DESCRIPTION The applicant owns a small parcel of land which is at the head of a creek off of Croatan Sound at Wanchese. The property is bounded by a deep lagoon (-14 feet NWL) at the head of the creek to the east, a shallow (-3 feet NWL) man made canal to the south and a very shallow(-1 foot NWL) ditch to the west. The property has elevations of as much as 4 feet and was vegetated in pines until recently cleared. The property grades towards the water and exhibits some areas of Juncus and Spartina marsh and mud flats (see field plat). No structures exist on the property except for a very delapidated pier at the head of the lagoon. The lagoon is used by other property owners in the area for mooring fishing boats. The applicant proposes dredging the shallow canal to the south of the property to -8 feet NWL and excavating a 50 foot long by 15 foot wide basin at the junction of the canal and the creek. The applicant proposes to bulkhead this. basin an average distance below NWL of 1 foot and to bulkhead a small section of the lagoon. Also proposed is a dock along the basin and canal. The excavation work.will be accomplished by dragline with the spoils placed on the adjacent highground. The intended purpose of the work is to provide mooring facilities for 3 or 4 small fishing and crabbing boats. ANTICIPATED IMPACTS The proposed project will result in some elevated turbidity levels but these should be localized. The dredging will result in impacts to 50 square feet of Juncus marsh; 1,400 square feet of shallow water habitat and 700 square feet of highground. The bulkhead will result in the filling of 90 square feet of shallow water. CAMA REVIEW The project site is classified as transition and conservation in the Dare County LUP.
