The site is suitable for some amount of wastewater to be disposed of by a low-pressure system. At our recent meeting you advised that DCM needs to know whether the site for such systems is suitable to accomodate the amount of wastewater expected to be generated from the development project for which the CAMA permit is sought. We cannot determine the amount of wastewater that can be placed upon this site without more information from the applicant and his consultant. We cannot issue a permit for this project until we have complete plans and specifications and other required supporting materials which are required to constitute a complete application for a DEM permit. We currently do not have any permit application pending for this project. Previously submitted materials have been returned as incomplete. Once a complete application for permit is submitted we will review it in an expeditious manner. I feel that the only way that DCM can be of further assistance for this review will be their encouragement to the applicant to provide a complete application for DEM permit with required supporting information. Please keep us advised if you receive additional information concerning this system. Also, I detect "rumblings" about site suitability. The purpose of this memorandum is to help DCM decide upon an action on the CAMA permit request. It is important that this office not issue a permit prematurely. We must also protect the integrity of the processing time. An action such as placing the project on hold might well give the applicant something to react to, thereby helping him decide on his own course of action. Obviously, the Hummock Tract needs sewer connection soon. The Division of Coastal Management requests that you provide answers to the following at the earliest possible time or by November 15 if possible: 1) Has the project site been officially designated as suiLable for the "low pressure subterranean discharge system" listed in the CAMA joint application? 2) Can the Division o= Environmental Management issue a permit for the plant described above? Sewall/G/ Assistant Chief Environmental Health Section SUBJECT: Roanoke Properties, Pirates Cove Project Dare County Dr. Robert Uebler, a Soil Specialist from our Sanitation Branch, visited the site for the above referenced project on September 29, 1987. As a result of this investigation, our review of the site investigation report for this project prepared by Dr. Elwood Black in July, and our understanding that this proposed sewer system will be owned and operated by a public utility, we do not object to the waste water system portion of this project provided: 1. Wastewater application rate will not exceed 0.8 gallons per day per square foot for tertiary treated effluent in multiple low-pressure pipe drain fields. 2. Ground-water field investigations are made to determine height of projected ground-water mound beneath the proposed drain fields and sufficient fill is added to keep field trench bottoms at least two feet above the projected seasonal high-water table plus ground-water peak elevation. 3. Drain fields and repair areas are located at least 200 feet away from adjacent SA waters and the public water supply well. If you have any questions regarding our comments, please let me know. The proposed project will not require a 401 water quality certification. b. The preliminary evaluation of the suitability of the site for a wastewater disposal system indicates that the site is suitable for use as a low pressure system. Complete engineering plans and specifications must be filed and a non-discharge permit obtained from our Permits and Engineering Unit. During our review. of the plans and specifications, a complete review by our Groundwater Section will be conducted for -potential groundwater impacts and groundwater monitoring requirements. Some preliminary work has been filed on the project but plans and specifications has not been filed to date. The preliminary work is filed under the name of Precision Utilities - Pirates Cove. SUBJECT: irate's Cove Development Dare County The subject project has been permitted through a NPDES Permit under the name of Roanoke Properties. This permit was issued on May 23, 1985, and allows a discharge of 0.10 mgd of treated domestic wastewater into Shallowbag Bay. To date, no request for an Authorization to Construct waste treatment facilities under the terms and conditions of this permit has been received. On July 29, 1987, the Division of Environmental Management received an application from Precision Utility to serve the Pirate's Cove Development with a low pressure pipe system. The application was incomplete in that neither plans, specifications, permit fee nor Utility Commission documents were included. The items received were a permit application and one copy of a site investigation by the firm Soils and Materials. The Division returned the app]-ication as incomplete on September 16, 1987. The application was resubmitted by Precision Utility on September 21, 1987, with a :::heck to cover the permit fee and another copy of the site investigation. However, plans, specifications and Utility Commission documents were once again not provided. The applicant was contacted regarding the afore mentioned omissions. The Division was informed that plans and specifications would bp provided on September 25, 1987, or, at the latest, by September 30, 1987. To date, we have yet to receive the_ plans or specifications. We were also informed that the required utility documents were being processed and would be forwarded in due'i;onrse. The Town of Manteo and Pirate's Cove have had discussions on the Town providing the needed services; however, no agreement was reached. Due to the amount of concern over the low pressure system, the applicant has been notified that a public meeting would be held prior to any final decision on his permit application. The proposed treatment system is located within 600 feet of one of the Dare County's wells. The applicant was told,. that the Division would answer his application by October 30, 1987, if the application was completed by September 25, 1987. The delay in the completion of the application will result in a subsequent delay in the Division's response. Elevations are only 3 - 5 feet above sea level, making entire area subject to frequent flooding (within 10-year flood recurrence zone).« 2. Our continuing opposition is based on possible environmental damage which would affect taxpayers, landowners and voters, but would benefit only a private real estate enterprise. Sincerely, Cecil M. Guthrie Shirley Guthrie We, the undersigned, do strongly protest the proposed construc- tion of a PRIVATE wastewater treatment plant for the sole benefit of the Pirate's Cove development. This facility is to be located in Skyco on the Pipkin property, 800' south of the intersection of NCSR #1134 and NCSR ,1345- REASONS: 1. The location is too close to the #9 well and pumping station which, in part, supplies the County water system. 2. The proposed treatment of approximately 100,000 gallons of wastewater per day--with a drainfield of ONLY 6.8 acres--is unrealistic. 3. There is NO guarantee that seepage will not occur and affect local well-water or the County water supply, and create a health hazard. 4. The only staff mentioned is ONE operator who will check the facility--once a day. 5. All of the above will cause property devaluation, and NO mention has been made of compensation to property owners. ROANOKE PROPERTIES BID REPORT PAGE 2 SITE DESCRIPTION The applicants have purchased an approximately 18 acres tract adjacent to the Croatan Sound, Charles Creek and Howard Creek near the intersection of Skyco Road and N.C. SR345 in Dare County. The land may be characterized as a-pine plantation with low elevation which is surrounded on three sides by an extensive and lush marsh vegetated primarily in Juncus roemerianus. The applicants are proposing to construct an approximately 100,000 gallons per day low pressure subterranean discharge system to'serve the Pirates Cove Subdivision constructed on the Roanoke Sound at the base of Roanoke Sound Bridge. This proposal is to replace the sewage discharge into Shallowbag Bay which has already been approved by DEM. Also.proposed is the construction of a marine storage building and greenhouse. All construction is proposed landward of the edge of the marsh. (The marsh alignment has not been verified by the COE)., The force main will leave Pirates Cove Subdivision via the culverted entrance and will be contained within the highground right-of-way along U.S. 64/264. It will cross under U.S. 264 and follow along the right-of-way along Wanchese Road to the project site. All proposed work is along the highground and no marsh will be excavated or filled. ANTICIPATED IMPACTS The proposed development will result in the destabilization of the 6.8 acres drain field and the construction site for the waste treatment plant and marine storage and greenhouse. Laying of the force main will require destabilization of the highground along the right-of-way. The Skyco area is near well points which.service Dare County water supply. The potential impacts to this resource should be-analyzed by the appropriate State experts.
