Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080- N-000-0291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The bulkhead will be constructed approximating the mean high water line. (2) In order to protect juvenile finfish populations, no excavation or filling will be permitted between February 1- and April 30 of any year without the prior approval of the Division of Coastal Management. (3) The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (4) Excavation will not exceed 6 feet below the elevation of normal water. (5) All excavated materials will be confined on high ground behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. (6) The diked disposal area must be constructed a sufficient distance from the MHW line or any marshland, to eliminate the possibility of dike erosion This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit #112-87 Page 2 of 2 (7) Flow from the diked retention area will be confined by pipe, trough or similar device to a point at or below the normal water elevation contour to prevent gully erosion and resultant unnecessary siltation. (8) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. (9) The terminal end of the pipeline will be positioned at or greater than 50' from any part of the dike and a maximum distance from spillways to allow adequate settlement of suspended solids. (10) The dike will be seeded, grassed or otherwise stabilized within four weeks of dike construction to prevent undue erosion of the dike with resultant solid materials entering adjacent marsh or water. (11) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of cor(struction or construction-related discharge. NOTE: Sufficient care must be taken during hydraulic dredging operation to prevent over-filling the diked spoil area. NOTE: The proposed project is certified under General Water Quality Certification No. 1273 issued on November 10, 1978, for discharges of liquid effluent from diked upland disposal areas. NOTE: Disturbance of more than one acre of grading, filling, diking, etc., requires the approval of an erosion and sedimentation control plan prior to project commencement, under the N. C. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The bulkhead will not be positioned farther than 2 feet waterward from the normal water elevation contour at any point along its alignment. b. All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. c. All excavated materials will be confined landward of the normal water elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. -2- .A.f , :O* d. Pro ject zs?mmary The applicant proposes to maintenance dredge a 900 foot long basin with highland spoil disposal at'a site near•Frisco,•Dare "County, N.C. Also planned is a 360' bulkhead at the HHW mark inside a man made canal and the construction/operation of a commercial fish and crab packing, house any!, boatramp. REDEEMED FISH COMPANY BIO REPORT PAGE 2 SITE DESCRIPTION Buxton Harbor is a small county maintained harbor which is home port to a number of commercial fishermen and a boat repair facility. The access channel was maintenance dredged in March,'1987 under CAMA permit #234-86 to'a depth of -6 feet MLW. This access channel leads to a 900 foot long canal which has shoaled in to -4 feet and shallower at the mouth. The west side of the basin has been bulkheaded while the east side has not. The unbulkheaded side exhibits a discontinuous border of Juncus roemerianus. and S artina marsh (approximately 1 foot wide) for the first half of the basin south end with a.wider fringe along the north end. The applicant proposes to excavate, with a small hydraulic dredge, owned and operated by the applicant, a 50' wide channel 300' inside the existing man made canal. The excavated material, primarily sand, will be pumped into an existing highland spoil area, utilizing earthen dikes to retain the material. This spoil site was used during the county's dredging of the access channel. The applicant states he plans to haul material from the site prior to re-initiating excavation. A -6' depth is to be main- tained within the man made cnnal. The applicant further proposes the bulkhead approximating the MHW line near is a 40' X 60' building to function as a 40' long wooden dock adjacent the canal construction of a 360' long wood and/or concrete the head of the man made canal. Also proposed commercial fish and crab packing house with a and a 20' wide boat ramp within the basin. The project site is not located in an identified primary nursery area. No significant areas of bottom rooted vegetation exist within the proposed channel alignment. The edges of the inland canal, those parts not presently bulkheaded, contain only widely scattered clumps of black needlerush (Juncus roemerianus). CAMA permit #20-81 was issued for this work but no work was completed under that authority and has.now expired. ANTICIPATED IMPACTS The dredging will result in the deepening of approximately 10,000 square feet of shallow water which has shoaled in. Perhaps 200 square feet of scattered Juncus and Spartina marsh will be filled during the backfilling of the proposed bulkhead. Some short term elevated turbidity levels can be expected during the construction of the boat ramp and bulkhead. CAMA RFVIFW The project area is classified as'transition in the Dare County LUP.
