Box 1890 Wilmington, NC 28402 Dear Mr. Hollis: This letter is in reference to your letter of May 20 concerning mitigation plans submitted by Piper Glen Development. We regret this untimely response. As it turned out, several key agencies were unable to respond until after your authorization on June 18. We note that your requested deadline was, in fact, June 19. Even though authorization has been granted for the subject project, we offer the following comments for the record. These comments and the agency submitting each follows: North Carolina Wildlife Resources Commission - as of June 11, 1987 the Commission had not seen the detailed plan. That office did, however, recommend that the 0.3 acres of mitigation be increased to not less than one acre and that the total mitigation package include: 1) Reduction of side slopes from 3:1 to 2:1, 2) Commitment of 10.4 acres of existing wetlands to the Mecklenburg Greenway System, 3) Creation of no less than 1.0 acre of non-wetlands to wetlands, planting appropriate wetland species, and committing the created wetlands to the Mecklenburg County Greenway System; Division of Water Resources - supportt the mitigation plan that has reportedly been recommended by the U. S. Fish and Wildlife Service; Division of Environmental Management - supports the project proposed. (704) 37z 4464 XEGULATCriy Our office is forwarding for your review the following information in conjunction with the General Permit required for the Rea Road crossing of Four Mile Creek in Mecklenburg County. We are acting on behalf of the applicant, Mr. Brad Wilemon of Piper Glen Development, in supplying this information. Piper Glen is a residential and recreational development in southern Mecklenburg. County. The proposed Rea Road is the major access into the site as well as a planned thoroughfare in the Charlotte-Mecklenburg Thoroughfare Plan. It will be built to N.C.D.O.T. specifications and standards and will be turned over to DOT for maintenance at the completion of construction and the dedication of the 25- acres of right-of-way. It has been determined by your field representative, Mr. Hugh Heine, that approxi- mately 1140 feet of Rea Road will cross wetlands between Station 44+50 and 55+90. Typical road design utilizes 3:1 side slopes for this height of fill. This would require filling 5.04 acres of wetlands. Because of the wetlands involved, we are reducing the side slope to 2:1 and thereby reducing the affected area by 0.75 acre. Therefore, the total amount of wetlands affected is 4.29 acres. As a commitment to the preservation of wetlands and wildlife habitat, Piper Glen has committed to dedicate and convey 26.9 acres of land't+o the Mecklenburg County Greenway System at no cost to the taxpayers. Of this 27- acres, approximately 10,4 acres is wetlands. Of the remaining 16.5 acres, approximately 0.3 acres will be lowered in grade and enhanced with plantings typically present in wetland areas. This one-third acre is immediately adjacent to the Greenway wetland areas and will enlarge the total wetland area in the Greenway to 10.7 acres. Enhancement of this 0.3 acre will be accomplished by planting water oak, willow oak or river birch seedlings (18 to 24 inches tall) at a spacing of eight to twelve feet. Species of plants identified in both the affected area and the greenway area include the following: willow oak, jewel weed, river birch, lizard tail, red maple, sweet gum, sycamore and black willow. y REA ROAD, PIPER GLEN DEVELOPMENT PAGE Two Construction of Rea Road is scheduled to begin July 1, 1987. Completion of the fill would occur approximately August 15,.1987 with all of Rea Road from Highway 51 to Piper Glen Drive being completed in Spring of 1988. Erosion control plans have already been submitted and approved by the Mecklenburg County Engineering Department. The North Carolina Departrnent of Natural Resources and Community Development oversees and assists the County's Engineering Department in its review of erosion control plans. The permittee will donate to Mecklenburg County 15.4 acres of wetlands within the project area to be incorporated into the County's Greenway System and used for wildlife conservation and outdoor recreation. b. Development within the dedicated area will be restricted by deed covenant to installation of a walking trail and adjacent benches. i i 3 r -2- c. The U.S. Ffsh and Wildlife Service will be afforded the right of 'approval of the dedicating legal instrument prior to the transfer of land rights. d. The work will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the stream is 50 NTU's or less will not be considered significant. e. Appropriate sedimentation and erosion control measures will be employed to minimize turbidity and siltation. Please read the enclosed general permits to prevent an unintentional violation of Federal law.
