OPEERATiON5 h.?\?rtia DEPARTMENT OF THE ARMY Wilmington District, Corps of Engineers Post Office Box 1890 Wilmington, North Carolina 28402-1890 SAWCO-ND-87-N-29-0003 RE EIVED SEC19Iwo December 18, 1986 MAINTENANCE DREDGING MANTEO (SHALLOWBAG) BAY PROJECT, NORTH CAROLINA (Dare County) TO WHOM IT MAY CONCERN : The Wilmington District Corps of Engineers, Wilmington, North Carolina, proposes to perform routine maintenance dredging of the Manteo (Shallowbag) Bay, North Carolina, navigation project. This Federal project has been reviewed under the following laws: a. Clean Water Act of 1977 (PL 95-217). b. The National Environmental Policy Act of 1969 (42 U.S.C. 4321-4347). c. The Fish and Wildlife Act of 1956 (16 U.S.C. 472a et seq.), the Migratory Marine Game - Fish Act (16 U.S.C. 7600-760g), and the Fish and Wildlife Coordination Act (16 U.S.C. 661-6660). d. The National Historic Preservation Act of 1966 (80 Stat. 915, 16 U.S.C. 470). e. Sections 307 (c)(1) and (2) of the Coastal Zone Management Act of 1972 (16 U.S.C. 1456 (c)(1) and (2), 86 Stat. 1280). f. The Endangered Species Act of 1973, as amended. PROJECT DESCRIPTION. The required maintenance work is scheduled to begin on or about February 1, 1987, and will require approximately 100 days to complete. The work will require the removal of all material lying above the plane of 14 feet below mean low water (MLW) within the designated limits of the channels shown on Enclosure 1. The total quantity of material to be removed from the limits shown is approximately 295,000 cubic yards. The material is composed of predominately coarse sand with lesser amounts of shell fragments except for the material in the channel to Wanchese Harbor which is composed of predominately silt and clay. All of the disposal areas have previously been used for maintenance of the project. There is no development near any of the disposal areas except Island C which has a house at the west end. Measures will be taken to avoid the house. f -2- OLD HOUSE CHANNEL. Mile 0 to mile 1.0, dredged material will be placed on disposal areas L and M (Enclosure 1) using control of effluent (i.e., not diked, but directing the effluent to the west side of the islands away from the channel being dredged). No material will be placed on the south end of Island M since this is a brown pelican nesting area. Approximately 68,000 cubic yards of material will be dredged and placed on these disposal sites. The normal frequency of dredging in this area is once a year. CHANNEL TO OREGON INLET. From the intersection with Old House Channel to 2,000 feet toward the Oregon Inlet bridge, dredged material will be placed on disposal area C using control of effluent (i.e., not diked, but effluent directed back toward the channel). CHANNEL TO MAN TEO. Dredged material will be placed on islands D and F using control of effluent (i.e., not diked, but effluent directed back toward the channel). The rookery that formerly nested on Island F is now on Island G and, therefore, will not be impacted by the disposal operation. Approximately 38,000 cubic yards of material will be dredged and placed on these disposal areas. The dredging frequency in this area is once a year. CHANNEL TO WANCHESE. From mile 7.5 of the Manteo - Oregon Inlet channel to the side channel to Wanchese Harbor and from the side channel to Wanchese Harbor (ranges 14 and 14A), dredged material, consisting of predominately clay and silt, will be placed in the upland diked disposal area on Island H after it is expanded. Approximately 189,000 cubic yards of material will be dredged from ranges 14 and 14A. The dredging frequency in this area is once every 3 years. The disposal area on Island H has reached capacity and will be expanded prior to the discharge of dredged material. Expansion of the existing disposal area will involve the construction of a 10-foot-high sand dike with a 6-foot top width along the mean high water (MHW) mark around the island (Enclosure 2). The outside toe of the dike will be approximately 5 feet away from the MHW mark. The dike will have a 2- horizontal to 1- vertical slope on both the inside and outside. Material for dike construction will be coarse to fine grained sand from the northern end of the island. The existing dike will be leveled after completion of the new dike in order to maximize the capacity of the disposal area. The work will not be performed until a coordinated viewpoint from interested State and Federal agencies has been received and reviewed. There is enclosed a list of Federal, State, and local agencies with whom these activities are being coordinated. A Final Environmental Impact Statement (EIS) related to the authorized maintenance of Manteo (Shallowbag) Bay, North Carolina, was filed with the Council on Environmental Quality (CEQ) on April 20, 1979, a Final Supplement to the final EIS was circulatd for public review on November 7, 1980. ?4 4, -3- The proposed action is consistent with the approved Coastal Management Program of the State of North Carolina (N.C. Department of Natural Resources and Community Development's letters of concurrence dated September 25, 1979, September 19, 1980, and August 23, 1983). A separate consistency determination has been prepared and was submitted to the N.C. Department of Natural Resources and Community Development on November 21, 1986, for the expansion of the Island H disposal area. Section 401 (PL 95 - 217) Water Quality Certificates were issued for the project by the N.C. Division of Environmental Management on June 28, 1979, and June 12, 1980 (water quality certificate number 1337 and 1337-R for control of effluent). The release of effluent from the Island H upland diked disposal area is covered under general water quality certificate number 1273 issued November 10, 1978, for release of effluent from upland diked disposal areas. An application for a separate Section 401 water quality certification was submitted to the N. C. Division of Environmental Management on November 21, 1986, for the placement of fill in wetlands in conjuction with the expansion of the disposal area on Island H. Expansion of the disposal area will involve filling approximately 1.5 acres of high marsh confined between the MW mark and the existing dike on the west side of the island. Designation of the proposed disposal sites for dredged material associated with the Federal project shall be made through the application of guidelines promulgated by the Administrator, Environmental Protection Agency, in conjunction with the Secretary of the Army. If these guidelines alone prohibit the designation of these proposed disposal sites, any potential impairment to the maintenance of navigation, including any economic impact on navigation and anchorage which would result from the failure to use these disposal sites, also will be considered. This public notice is being distributed to all known interested persons in order to assist in developing facts on which a decision may be made by the Corps of Engineers with respect to the disposal of dredged material in navigable waters or ocean waters. For accuracy and completeness of record, all data in support of or in opposition to the proposed work should be submitted in writing setting forth sufficient detail to support convictions. Any person who has an interest which may be affected by the disposal of this dredged material, may request a public hearing. The request must be submitted in writing to the District Engineer within 15 days of the date on this notice and must clearly set forth the interest which may may be affected and the manner in which the interest may be affected by this activity. In order for such a request to be given appropriate consideration, it should be mailed or delivered to the U.S. Army Engineer District, Wilmington, Post Office Box 1890, Wilmington, North Carolina 28402- 1890, in time to be received on or before January 2, 1987.
