Reference your application for a Department of the Army permit
to maintain an area of a manmade canal and construct a pier off
Spring Creek, Fairfield Harbour, Craven County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

attached plats, 3, dated received 3/18/87.
This permit, issued one is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) Excavation within the canal will take place only in the prescribed area
as delineated on-the permitted work plat drawing dated 3/7/87.
(2) AlI excavated spoil material will be permanently contained and retained
on the highground property landward of the existing bulkhead in such a way
as to prevent the sediments from re-entering the canal.
(3) No excavated or fill materials will be placed at any time in any vegetated
wetlands or waters of the State.
(4) The temporary placement or double handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.
(5) Excavation will not exceed.8 feet below the elevation of normal water.
(6) Construction and installation of the proposed pier will be in accordance
with the work plat drawing. Should the adjacent property be sold before

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
Ali work must cease when the permit expires on
December 31, 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Reference the application of Mr. John K. Wheeler, Neuse Realty and
Insurance Company, for a Department of the Army permit to maintain an area of
a manmade canal and construct a pier off Spring Creek, Failfield Harbour,
Craven County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. Emergent wetland vegetation will not be excavated. Excavation will
not approach closer than 5 feet to such vegetation to assure that it is not
undermined and eroded.
b. All excavated materials will be confined landward of the normal water
elevation contour and any regularly or irregularly flooded vegetated wetlands.
c. No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters of the State.
d. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
e. Excavation will not exceed 8 feet below the elevation of normal water.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received April 2, 1987, for a
Department of the Army permit to maintain an area of a manmade
canal and construct a pier off Spring Creek, Fairfield Harbour,
Craven County, North Carolina, indicates it to be a candidate for
Federal authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

8. Project summary The applicant proposes to develop residential
lots 190 & 191 by maintenance excavating and area 60' x 40' to a depth
of 8' on normal water level. One pier 20' long by 6' wide will be
constructed on the common property line for use by both lot owners.

9. Narrative
Neuse Realty and Insurance Company is owned and operated by-Mr.
John K. Wheeler. His office is located on SR 1600 not far from
the main entrance to Fairfield Harbour in Craven County. The
site is located within Fairfield Harbour Subdivision and involves
maintenance excavation in front of two adjoining lots, #190 and
#191, owned by the real estate company. The properties are
situated off Pellican Drive and the dead end section of one of
the circular finger canals off Spring Creek. The applicant is in
the process of constructing a single family residence on lot 190
at a distance of some 65' landward of the existing concrete
asbestos bulkhead which perimeters the entire canal system. A
similar "spec house" will be constructed in the near future on
lot 191.
The developer proposed through this major CAMA application
request to enhance the accessibility and useability of the 60'
canal frontage. Mr. Wheeler-proposes to maintenance excavate an
area immediately in front of the bulkhead measuring approximately
60' from side to side and extending into the canal some 401. The
project depth will be approximately -8' relative to the normal
water level. -8' seems to be the controlling depth within the
canal system as maintained by the Fairfield Harbour association.
The area to be excavated under this permit request includes an
estimated 350 sq. ft. of high marsh vegetation, dominated by
black needle rush and spartina patens (salt meadow hay). There
are other marginal type species such as salt bushes, switch
grass, and pond pine that inhabit the area between the bulkhead
and open water canal. It appears that over the years runoff
sediments from all of the surrounding land has contributed to the
shoaling problem and subsequent marsh build-up. Although the two
lots in question are well stabilized today with domestic yard
vegetation, sediments have built up to the top of the concrete
cap on the bulkhead which is at an elevation of approximately
+4.51. The excavation will generate approximately 532 cu. yds.
of sandy mud from the canal and the marsh area. The spoil will
be stock piled on the two lots and later used as landscape
material around the two yards. The surface waters of the canal
system within Fairfield Harbour and Spring Creek, which is a
tributary of the Northwest Creek, are classified as inland waters
and are rated SC by the Division of Environmental Management.
10. Anticipated Impacts
The proposed project will directly displace approximately 350 sq.
ft. of high marsh vegetation dominated by black needlerush and
salt meadow grass. This area contains other plant species not
considered wetlands vegetation since most of the area is well
above the normal water level. The proposed maintenance
excavation will also disturb approximately 2000 sq. ft. of
subaqueous bottom lands within the manmade canal, averaging 2-6'
deep prior to excavation. The proposed project will restore the

-8' water level within the manmade canal. Using one access pier
for both lots will also help reduce structural congestion within
the-back end of the canal. The applicant-must be encouraged to
employ adequate sedimentation and erosion control measures during
and after the excavation in order to prevent filling of the canal
in a premature manner. The total amount of environmental
disturbance involved in this project is not considered
significant within the scope of this manmade canal system.
CAMA Review Section
The propose project is consistent with the Land Use Plan for Craven
County where the highground property is classified Transition and the
surface waters as Conservation.

Narrative
Neuse Realty and Insurance Company is owned and operated by Mr.
John K. Wheeler. -His office is located on SR 1600 not far from
the main entrance to Fairfield Harbour in Craven County. The
site is located within Fairfield Harbour Subdivision and involves
maintenance excavation in front of two adjoining lots, #190 and
#191, owned by the real estate company. The properties are
situated off Pellican Drive and the dead end section of one of
the circular finger canals off Spring Creek. The applicant is in
the process of constructing a single family residence on lot 190
at a distance of some 65' landward of the existing concrete
asbestos bulkhead which perimeters the entire canal system. A
similar "spec house" will be constructed in the near future on
lot 19.1.
The developer proposed through this major CANA application
request to enhance the accessibility and useability of the 60'
canal frontage. Mr. Wheeler proposes to maintenance excavate an-
area immediately in front of the bulkhead measuring approximately
60' from side to side and extending into the canal some 401. The
project depth will be approximately -8' relative to the normal
water level. -8' seems to be the controlling depth within the
canal system as maintained by the Fairfield Harbour association.
The area to be excavated under this permit request includes an
estimated 350 sq. ft. of high marsh vegetation, dominated by
black needle rush and spartina patens (salt meadow hay). There
are other marginal type species such as salt bushes, switch
grass, and pond pine that inhabit the area-between the bulkhead
and open water canal. It appears that over the years runoff
sediments from all of the surrounding land has contributed to the
shoaling problem and subsequent marsh build-up. Although the two
lots in question are well stabilized today with domestic yard
vegetation, sediments have built up to the top of the concrete
cap on the bulkhead which is at an elevation of approximately
+4.51. The excavation will generate approximately 532 cu. yds.
of sandy mud from the canal and the marsh area. The spoil will
be stock piled on the two lots and later used as landscape
material around the two yards. The surface waters of the canal
system within Fairfield Harbour and Spring Creek, which is a
tributary of the Northwest Creek, are classified as inland waters
and are rated SC by the Division of Environmental Management.
Anticipated Impacts
The proposed project will directly displace approximately 350 sq.,
ft. of high marsh vegetation dominated by black needlerush and
salt meadow grass. This area contains other plant species not
considered wetlands vegetation since most of the area is well
above the normal water level. The proposed maintenance
excavation will also disturb approximately 2000 sq. ft. of
subaqueous bottom lands within the manmade canal, averaging 2-6'
deep prior to excavation. The proposed project will restore the
-8' water level within the manmade canal. -Using one access pier
for both lots will also help reduce structural congestion within
the back end of the canal. The applicant must be. encouraged to
employ adequate sedimentation and erosion control measures during
and after the excavation in order to prevent filling of the canal
in a premature manner. The total amount of environmental
disturbance involved in this project is not considered
significant within the scope of this manmade canal system.
CAMA Review Section
The propose project is consistent with the Land Use Plan for Craven
County where the highground property is classified Transition and the
surface waters as Conservation.
