For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Cade of Federal Regulations (CFR), Part 330, published in the Federal Register on November 13, 1986, lists nationwide permits. Authorization was provide? for bank stabilization activities provided: (i) The activity is less than 500 feet i= length. (2) The activity is necessary to prevent erosion. (3) The activity is limited to less than an average of 1 cubic yard of material per running foot placed along the baW.K within waters of the United States. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) In order to protect juvenile shrimp and fin fish populations, no excavation or filling will be permitted between May 1 and September 1 of any year without the prior approval of the Division of Coastal Management. NOTE: Excavation may occur in the basin after April 1 provided that a silt curtain is provided to isolate the basin from the river system. (2) Excavation will not exceed 8 feet below the elevation of mean low water (MLW). (3) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surroun- ding waters. (4) The diked disposal area will be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of dike erosion into or upon any marsh and/or surrounding waters. See attached sheet for Additional Conditions This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Contact a representative of the Division of Coastal Management at 256-4161 for this determination at least two weeks prior to this action. (6) The disposal area effluent will be contained by pipe, trough or similar device to a point at or below the mean low water level to prevent gully erosion and unnecessary siltation. (12) The channel markers. must be installed in accordance with U. S. Coast Guard specifications and/or as per standards of the Uniform Waterway Marker System administered by the N. C. Wildlife Resources Commission. NOTE: The proposed project is certified under General Water Quality Certification No. 1273 issued on November 10, 1978, for discharges of liquid effluent from diked upland disposal areas and No. 1272 issued on November 10, 1978, for bulkhead construction. NOTE: The potential exists for creating moderate to severe mosquito problems with this project. Therefore, the spoil site should be dewatered as quickly as possible. Division of Parks and Recreation, Carolina Beach State Park New Hanover County In response to a request that the requirement for a pumpout facility be deleted from the CAMA permit recently issued for the Subject project, the following comments are offered: 1. This project is in SC waters so there is no certain violation of Water Quality standards which will necessarily occur should a boat discharge sewage overboard. 2. We do feel that providing a sewage pumpout facility is a reason- able requirement for avoiding adverse impacts to Water Quality in a closed marina such as the Subject facility. 3. Should the CAMA permit be amended to delete the requirement for a pumpout facility, there should be signs placed on the docks advising of the locked -head policy and the location of the nearest sewage pumpout facilities. Box 27687 Raleigh, NC 27611 Dear Mr. Owens: The Division of Parks and Recreation has received the Major Development Permit for maintenance dredging of our boat basin at Carolina Beach State Park in New Hanover County. One of the conditions of the permit requires a pumpout facility to be installed and operable prior to December 31, 1987. Unfortunately, our budget for the marina maintenance project does not include sufficient funds to install a pumpout facility. We feel that such a facility is not needed at this time. The marina at Carolina Beach State Park is not located in or adjacent to shellfish waters. Few of the boats using the marina have holding tanks, and we have not had problems in the past with boats pumping into the basin. To prevent potential problems, we will post and enforce a no -sewage discharge policy. We request that the requirement for a pumpout facility be deleted from the conditions of our permit. We are currently evaluating future plans for the marina, and should it ever be expanded we will reconsider the need for a pumpout facility at that time. Thank you for your assistance. This work will be performed near the AIWW, classified SC. The project has been reviewed to determine impacts on water quality. The following comments are provided: 1. The proposed project will require 401 Certification, 2. It is recommended that the Certification contain the following conditions: a. That earthen banks adjacent to the bulkhead be stabilized with vegetative cover as soon as possible after construction to minimize erosion. b. That construction of the bulkhead not restrict stream or tidal flows or drainage of adjacent areas. c. That every reasonable effort be made to perform the work in a manner that will prevent excessive increases in turbidity and settleable solids concentrations in the water body. d. That the terminal end of the pipeline from the dredge into the retention area be positioned at a maximum distance from spillways to allow adequate settlement of suspended solids and a sufficient distance from any part of the dike so as to preclude dike erosion by the pipeline discharge. e. That a water control structure be installed at the intake end of the effluent pipe leading from the retention area in order to insure maximum settlement of suspended solides and control of discharge volumes. f. That the flow from the diked retention area be contained by pipe, metal or wooden trough, or similar device to a point waterward of any emergent vegetation along the shoreline. That sufficient freeboard be maintained within the diked disposal area during the dredging operation to assure the integrity of the dike structure and the containment of the dredged material. h. That the concentration of the settleable solids in the effluent being discharged from the diked disposal area be no greater than 0.1 ml/1. i. That disposal area dikes be stabilized with vegetative cover as soon as possible after construction to minimize erosion. j. That pump out facilities be provided and a locked head policy be enforced. k. There is an existing man-made basin with access channel. The dimensions of the basin are approximately 400' x 2601. Shoaling has occurred within the basin so that the average depth at mean low water (mlw) is approximately -3'. The channel is approximately 300' x 50' and has shoaled to depths as shallow as -1.5' mlw. There is an existing rip -rap wave barrier located at the junction (mouth) of the basin and channel and along the northwestern riverward side of the basin. This barrier envelopes a finger of high ground between the river and the basin. There is a fringe of smooth cordgrass (Spartina alterniflora) marsh along the northeastern length of the basin which averages approximately 4 feet in width. There is an existing flushing channel located at the north corner of the basin. There is a set of docks with approximately 32 slips located within the basin which are in a bad state of repair. Some maintenance is required for the docks. There is also an existing bulkhead along the southern and southeastern sides of the basin. Again, this structure has some area of partial failure which need repairs. There is an existing boat ramp with piers as well as gas pumps which serve the facility. Boat slips are available to the public on a charge basis. The proposed spoil area is the existing Corps of Engineers Spoil Area #8. There is some minor dike repair work required prior to the area being used for the project. The waters are classified as SC and secondary nursery area. The applicants propose to excavate approximately 20,000 cubic yards of sand/ silt in the maintenance of the existing facilities. The dimensions of the channel will be returned to approximately 300' long x 50' wide x -8' mean sea level (msl) . The basin will be maintained to approximately 400' x 260' x -8' msl. Approximately 20,000 cubic yards of material will be excavated by means of a hydraulic dredge and will be pumped to Corps Spoil Area #8. There will be some minor maintenance necessary in order to secure the spoil site. The dock/pier system will be repaired and the bulkhead will be stabilized. The applicants are proposing to work in the basin behind silt curtains in order to minimize dredging impacts. 10. ANTICIPATED IMPACTS The proposed project will result in some short term sedimentation and turbidity problems. Provided the, basin work is done using set barriers and the channel is maintained during a period of low biological activity in the river, no significant adverse impacts are anticipated.
