This permit, issued on 3,?? ?g0 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) This permit modification authorizes a revised dock and wave brake layout
in keeping with the attached plat dated received February 19, 1988.
(2) All conditions of, a modified version of this permit issued on August 19,
1987 remain in effect, except as modified by this permit.
(3) This modification must be attached to the permit issued on August 19, 1987
and be readily available on site when Division personnel inspect the project
for compliance.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Dear Mr. Jenkins:
Reference your application for a Department of the Army permit
to construct a dry stack storage facility with associated docking
facilities and shoreline stabilization on Bogue Sound, Morehead
City, Carteret County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-060-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This permit, issued on zz? , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) All development will; be conducted in strict accordance with the attached
application and plats.
(2) All excavated materials will be confined above mean high water and landward
of regularly or irregularly flooded marsh, behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or surround-
ing, waters.
(3) Excavation will not exceed 16tfeet below tthe elevation' of mean low water
(MLW).
(4) The riprap material will not extend waterward more than 5' from the normal
water level at any point along its alignment.
(5) The riprap material will be clean and free of any pollutants, except in
trace quantities. Metal products, organic materials, or unsightly debris
will not be used. The riprap must be sized to prevent its movement from

the site by current or wave action.
(6) All wet concrete to be placed below MHW shall be placed during low tide
with the forms completely dewatered.
(7) The temporary placement or double handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.
(8) The activity must be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction-related
discharge (increases such that the turbidity in the Stream is 25 NTUs or
less are not considered significant).
(,9) The disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within 30 days of project completion.
(10) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
(11) If the display of lights and signals on the authorized structure is not
otherwise provided for by law, such lights and signals as may be prescribed
by .the U..S. Coast Guard will be installed and maintained by, and at the
expense of, the permittee.

Reference the application of Morehead Ships Chandler,
Incorporated, represented by Mr. Bill Jenkins, for a Department of
the Army permit to construct a dry stack storage facility with
associated docking facilities and shoreline stabilization on Bogue
Sound, Morehead City, Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The riprap material will be placed in strict accordance
with the permit plans.
b. The riprap material will be clean and free of any
pollutants except in trace quantities. Metal products, organic
materials, or unsightly debris will not be used.
c. All excavated materials will be confined landward of the
mean high water (MHW) elevation contour and any regularly or
irregularly flooded vegetated wetlands.
d. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).

e. The temporary placement or double handling of excavated or
fill materials within waters or vegetated wetlands is not
authorized.
f. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized work. Use of the permitted activity
must not interfere with the public's right to free navigation on
all navigable waters of the United States.
g. If the display of lights and signals on the authorized
structure is not otherwise provided for by law, such lights and
signals as may be prescribed by the U.S. Coast Guard will be
installed and maintained by and at the expense of the permittee.
h. It is possible that the authorized structure may be
damaged by wavewash from passing vessels. The issuance of this
permit does not relieve the permittee from taking all proper steps
to ensure the integrity of the permitted structure and the safety
of moored boats from damage by wavewash. The permittee will not
hold the United States liable for any such damage.
i. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.
k. This permit does not authorize interference with any
existing or proposed Federal project.

Dear Mr. Jenkins:
On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received January 26, 1987, for a
Department of the Army permit to construct a dry stack storage
facility with associated docking facilities and shoreline
stabilization in Bogue Sound, Morehead City, Carteret County,
North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

Water Quality Standards and discharge guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.

9. Narrative description
Applicant's property is a parcel approximately one and one-half
acres in size, located on Harbor Channel which empties into Bogue
Sound. The property is located on the extreme east end of
Arendell Street between the Leeward Harbor Condominium and J.M.
Davis Texaco in the Town of Morehead City in Carteret County.
The property is characterized by 4-6' elevations on which three
cinder block structures had been constructed to provide
facilities for the old Parker Ford Dealership which existed at
this site in the early to mid 701s. These structures are
presently in a serious state of decay.
The portion of the property bordering Arendell Street is
presently paved, however, this stops approximately mid-way the
property as you move towards the water, and the remaining portion
of the property is either grass or barren. The shoreline is
characterized by a bulkhead on the side bordering the Leeward
Harbor Condominium project and a rock revetment on the remaining
shoreline segments. A pier exists in the central portion of the
property and extends offshore approximately 2401. The applicant

this area and also to protect the boat launching area from
unnecessary sedimentation. The area between the two jetties is
proposed to be excavated to a depth of -6' MLW and this
excavation will cover an area approximately 40' wide by 60' long.

10. Anticipated Impacts
Conducting this project as proposed will involve the disturbance
of 'approximately 2400 sq. ft. of shallow subtidal water area
where the basin is planned, and another 1280 sq. ft. will be
disturbed in reconstituting the presently existing rock
revetment. The highground grading and construction will involve
the disturbance of 67,500 sq. ft.
Adjacent waters are classified as SC according to the Division of
Environmental Management and are presently closed'to shell
fishing by the Division of Health Services.

The Department of Natural Resources and Community Development hereby
gives public notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)
(c) that Morehead Shins Chandler, Inc. of Morehead-City
North Carolina filed an application on February 2,
for a permit from the Division of Coastal Management to develop in an
Area of Environmental Concern and for certification from the Division
of Environmental Management that a discharge of fill material in project
wetlands will not violate applicable water quality standards. •

applicant proposes to redevelop a
parcel located' on Harbor Channel and the east end-oaf Arende•11 =Street,
Morehead City. A drystack storage project is proposed.

9. Narrative description
Applicant's property.is a parcel approximately one and one=half
acres in size, located on Harbor Channel which empties into Bogue
Sound. The property is located on the extreme east end of
Arendell Street between the Leeward Harbor Condominium and J.M.
Davis Texaco in the Town of Morehead City in Carteret County.
The property is characterized by 4-6' elevations on which three
cinder block structures had been constructed to provide
facilities for the old Parker Ford Dealership which existed at
this site in the early to mid 701s. These structures are
presently in 'a serious state of decay.
The portion of the property bordering Arendell'Street is
presently paved, however, this stops approximately mid-way the
property as you move towards the water, and the remaining portion
of the property is either grass or barren. The shoreline is
characterized by a bulkhead on the side bordering the Leeward
Harbor Condominium project and a rock revetment on the remaining
shoreline segments. A-pier exists in the central portion of the
property and extends offshore approximately 2401. The applicant
.is proposing to remove the existing buildings and asphalt from
the highground portions of the lot and the pier from the adjacent
waters. The applicant is then planning to redevelop the entire
track, constructing a dry stack storage building 253' long by
105' high by 50' high,.approximately in the central portion of
the property and paving the landward end-and side of this
property in order to provide parking for patrons of this dry
stack storage business. On the shoreline a paved ramp area for
launching boats is proposed on the eastern portion of the
property, maintaining a 15' separation from the J. M. Davis
facility, and on the western portion of the property, a series of
floating docks are proposed along with some proposed fuel pumps.
Immediately offshore of the area to be used for launching the
vessels will be a floating dock which will also serve as a wave
deflector to protect the launching operation. On either side of
the launching area will be jetties approximately 60' in length
which will be formed from concrete sheet piles. These jetties
are proposed in order to deflect the high currents that exist in
this area and also to protect the boat launching area from
unnecessary sedimentation. The area between the two jetties is
proposed to be excavated.to a depth of -6' MLW and this
excavation will cover an area approximately 40' wide by 60' long.

10. Anticipated Impacts
Conducting this project as proposed will involve the disturbance
of approximately 2400 sq. ft. of shallow subtidal water area
where the basin is-planned, and another 1280 sq. ft. will be
disturbed in reconstituting the presently existing rock
revetment. The highground grading and construction will involve
the disturbance of 67,500 sq. ft.
Adjacent waters are classified as SC according to the Division of
Environmental Management and are presently closed to shell
fishing by the Division.of Health Services.

Enclosed is the application of Mr. Bill Jenkins, dba Morehead
Ships- Chandler, Inc., for a Department of the Army permit and a
State Water Quality Certification to place fill material in Bogue
Sound in conjunction with the development of a dry stack storage
facility with associated docking facilities in Morehead City,
Carteret County, North Carolina. Your receipt of this letter
verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by March 27, 1987, the District Engineer
will deem that waiver has occurred.
