Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-7015 NORTH CAROLINA New Hanover County CERTIFICATION THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Environmental Management Regulations in 15 NCAC 2H, Section .0500 to Truman Moore pursuant to an application filed on the 30th day of April, 1987 to fill a wetlands area for ccnmrcial development. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Bridgers Canal in conjunction with the proposed development project in New Hanover County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That the fill material used be from a clean upland source and free of any toxic materials. 3. That appropriate erosion control methods be used (i.e. silt fences) to confine the fill. 4. That the erosion control measures be in place before fill is put in place. 5. That all slopes be vegetated immediately upon completion to prevent post-construction erosion. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 15th day of Tune, 1987. Dear Mr. Franklin: We are writing to formally request you extend our application for a permit'to fill lands filed 4/28/87. In the original application, we requested a permit to fill .97 acres. We would like to now request the 401 Water Quality Certification be considered for an additional 2.78 acres, as shown on the attached exhibit. It is our belief that this small upland area does not provide any significant drainage flow to tidal waters, as there are no creeks or ditches in the area subject to this permit request. With a 43,000 square foot shopping center on one side, a large subdivision almost adjacent on the other side, and a 20,000 car per day U.S. Highway to the front, we would like the front 600 feet of this 33 acre tract to be useable for commercial development. Again, we would like to leave our initial permit application intact while having this additional request added to the file for simultaneous consideration.
