The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of a tributary to Dillard creek in conjunction with the proposed irrigation pond in Chowan County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 50 NTU's or less are not considered significant). 2. That the dam shall be properly seeded at the completion of construction to stabilize the soils and reduce turbidity impacts. 3. That a vegetative buffer area (minium 50 feet) be maintained around the perimeter of the pond to reduce potential pollutants carried with runoff frcan entering the pond. 4. That the Division of Environmental Management be allowed access to the pond and dam if necessary to inspect or sample waters. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall beccane null and void unless the above conditions are made conditions of the Federal Permit. In order to evaluate compliance with stormwater requirements for the parking area, the following information should be provided by the applicant: 1. Plans should be revised to underline the parking area within 50 feet of wetland area with an impervious medium. 2. Elevations around perimeters of parking area must be shown in order to demonstrate that the grade will direct runoff to the retention areas. 3. It should be shown how the fill for the parking areas will be contained. 4. Specifications for the gravel must be provided. b. Moore, Environmental Technician'/ Washington Regional Office SUBJECT: 401 Certification Preston Monds Chowan County The proposed project is located southeast of the intersection of SR 1311 and SR 1310 and about 2 miles east of Small's Crossroads in Chowan County. Mr. Monds proposes to construct an earthen dike across a 404 wooded wetland area. This wetland area is tributary to Dillard Creek, which is classified BNSW. The proposed dike is 450 ft. long by 8 ft. high by 14 ft. top width, and involves fill in approximately 0.3 acres of wetlands. The impounded water area is estimated to be about 7 acres. The stated purpose of the project is to provide impounded waters for farm irrigation and trap non-point source runoff. The proposed project raises 2 important concerns regarding potential impacts on water quality. The first concern is the potential for a depletion of dissolved oxygen levels in both the impounded waters and receiving waters. The impounded area will encompass about 7 acres, most of which is vegetated with 404 type wetlands. A significant portion of the vegetation will die once the area is flooded and contribute to an organic layer within the impoundment. This organic material will exert an oxygen demand on the impounded water which will result in a contravention of the dissolved oxygen standard. When impounded waters are discharged downstream, this same oxygen depletion will likely occur. It is anticipated that the extent and duration of oxygen depletion in the receiving waters will be increased as a result of the proposed impoundment structure. The second concern relates to the potential for nutrient enrichment of the receiving waters. The impoundment will, in fact, act as a settling basin and filter upland runoff. As a result, nutrients will be trapped in the impoundment for some indefinite period of time. The concern is that nutrients may concentrate in the impounded waters and then be released downstream. With the nutrient and associated algal problems that currently exist in the Chowan River Basin, any project resulting in a discharge should be designed to avoid any significant increase of nutrients to the system. It is anticipated that the proposed project will have significant adverse impacts on water quality, and that a contravention of the dissolved oxygen standard will occur. Therefore, it is recommended that the 401 water quality certification be denied. WJM/cm
