Construction (1) The location of all the piers and attendant mooring facilities, for both Mitchell and Stanford Creeks, must be in keeping with Rules of the Coastal Resources Commission which, in part, require that such structures: 1) not extend more than 1/3 the width of the natural water body as measured from bordering marsh vegetation, where present, and 2) not encroach within 15 feet of adjacent property lines and associated area of riparian access as measured from a line perpendicular to the run of the channel back to the point where the shoreline and property line meet. (2) Subject to Condition No. 1, all development will be carried out in strict accordance with project plans. (3) If, during the course of marina construction, submerged materials of archaeo- logical significance are encountered, the permittee will immediately cease work in that area and contact the Division of Coastal Management at 919/726- 7021 and the Corps of Engineers at 919/343-4631. this permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. (5) The waterward extremities of the two piers will be permanently marked with reflectors to preclude possible impact by boats at night or during other periods of reduced visibility. (6) If the display of lights and signals on the authorized structures are not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained--by,- and at the expense of, the permittee. Operation (7) Prior to the occupancy of any new slips authorized by this permit, the permittee will install and maintain operational for the life of the project a pumpout facility to service boats with holding tanks. (8) The marina shall prominently post and enforce a no sewage discharge policy. (9) No person shall be allowed to live aboard vessels in the marina. (10) All floating structures, other than boats, used for habitation or commerce (as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations for onshore sewage treatment. (11) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. (12) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. (13) The authorized structures and associated activity will not cause an unaccep- table interference with navigation. NOTE: This 12/87 modification authorizes the relocation of fuel pumps, removal of "T" head and creation of an additional slip at the waterward end of the 512' pier and construction of an 8' x 16' highground deck off the main pier. Narrative Description Applicants property is a 3.5 acre tract located on Stanford and Mitchell Creeks, tributaries of Clubfoot-Creek in Craven County. The property.is reached by taking SR 1711 off Highway 101 at North Harlow to the end, where the applicant's father has operated a marina for some years. - The property presently is vegetated by oak, sycamore, pine, gum and cedar. Understory vegetation is domestic year grass, growing on soils of sandy clay. Elevation ranges up to 101. There are 4 mobile homes at the site, a block residence, marina office and 3 storage buildings. Other structures mainly related to the marina operation are 4 piers, a boatramp and a gas pump: A portion of the shoreline is bulkheaded, and another segment is vegetated by high marsh composed of salt grass, giant reed grass and three square. Other segments of shoreline include a 6-8' high eroding bluff. Debris along this segment of shoreline includes large•numbers of red brick, possibly equipment or building foundations. The applicant is proposing to remove the three southernmost existing piers and replace these with two piers, both shaped in a long "L" type configuration. One pier will be 512' long and the other will be 320' long. The longer pier will have a 36' long by 6' wide "T" on the end with gas pumps and holding tank pump out located here: Finger piers and pilings to accommodate 94 boats total are proposed.following the layout shown on the plat. Stanford Creek is 306' wide-in the area where the longer pier extends 100' from shore, before turning and making a long "L" configuration. Mitchell is over 1000' wide where the piers encroach approximately 3001. 10. Anticipated Impacts This project will present an obvious feature to navigational interest in this area and will encroach into approximately 82000 sq. ft. of public trust area. Short-term minor turbidities should be expected in the project area during piling installation. No further development is proposed on the highground. Existing gravel areas will be used for parking with overflow parking using the grassed areas in the adjacent yard. Adjacent waters are classified as SA according to the Division of Environmental Management, and according._to the Division of Health. services, adjacent: waters are currently closed to shellfishing.
