Preston Howard, Jr., P.E., Director Wayne and Barbara Barbee 59 Barbee Lane Timberlake, North Carolina 27583 Y1.5?FA IT 00 A&�J C) F N F=1 December 12, 1997 Subject: Permit No. WQ0014319 Wayne and Barbara Barbee Single Family Wastewater Spray Irrigation Facility Person County Dear Mr. and Mrs. Barbee: It has been brought to my attention by the Person County planning department that your intention is now to subdivide your property that was permitted for a spray irrigation system into two separate lots. I have also received a fax of your proposed subdivision and found it to be in direct conflict with section I, condition number 11 of the subject permit. Upon review of the proposed subdivision, it appears as though the requirements for buffers from property lines and existing residences will not be maintained. The existing homes were exempt from the 400 foot buffer requirement in the original permitting since you owned both houses. With the proposed subdivision, the Division must insure that any future owners of the piece of property with the pond and two houses will know that these minimum buffers are not being maintained It appears as thought there are two paths you can follow for your proposal to pass and allow for construction of your new home. One is to be granted a variance from Person County ordinances restricting you to one principal home per lot or to have a permit modification through the Division allowing for variances to our minimum buffer distances. I can not speak for the process of obtaining a variance from Person County, if that is even an option, but the following information will be required prior to the Division issuing a permit modification for the proposed subdivision: P.O. Box 29535, Raleigh, North Carolina 27626-0535 Telephone 919-733-5083 FAX 919-733-0719 An Equal Opportunity Affirmative Action Employer 50% recycled/ 10% post -consumer paper I- A written request for permit modification including a $400 permit modification fee. 2- A copy of the new deeds for both properties, including language in the deed for the property with the pond and two houses, stating that there is an on-site wastewater treatment system on the adjoining property which does not maintain the Division's minimum buffers in relation to the property line or the two existing residences. 3- The irrigation line from the pump tank (near the house) to the irrigation field must be located on the strip of property connecting the new home to the spray field or it shall have a dedicated easement on the adjoining property. If an easement is to be utilized, it must be shown on the plat map and recorded in the deeds. 4- A copy of construction drawings for the spray irrigation system, showing the new property lines, which will be stamp approved corresponding with the newly modified permit. This set of drawings should show both pieces of property in their entirety and show any required easements.
