Z ; Reference the application of Mr. Jerry L. Lee for a Department of the Army permit to excavate a canal and boat basin, and construct a boat ramp and construct and backfill a bulkhead off Pettiford Creek, near Cape Carteret, Carteret County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. To minimize increases in turbidity levels outside the work area, the basin will be excavated prior to any excavation of the _ canal. b. An earthen plug will be left between the inland basin and the canal extending to Pettiford Creek until excavation landward of the plug has been completed. To prevent unnecessary sediments from reaching adjacent waters, 24 hours will be allowed to elapse before the plug is removed. c. All excavated materials will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. -2- ti y d. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and at a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. e. Sufficient freeboard will be maintained within the diked retention area during the dredging operation to assure the integrity of the dike structure and the containment of excavated material. f. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. g. Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and resultant unnecessary siltation. h. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters of the State. i. Excavation will not exceed 4 feet below the elevation of mean low water (MLW). j. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. k. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less are not considered significant. 1. The concentration of settleable solids in the effluent from the diked disposal will not be greater that 0.1 ml/l. m. Every reasonable effort will be made to perform the work in a manner to prevent excessive increases in turbidity and settleable solids concentrations in the water body. n. The retention area dikes and the earthern banks landward of the bulklhead will be stabilized with vegetative cover as soon as possible after construction to minimize erosion. -3- o. (1) In order to protect juvenile shrimp and fin fish populations, no excavation or filling will be permitted between March 1 and August 31 of any year without the prior approval of the Division of Coastal Management. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. (13) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction- related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less. are not considered significant. - NOTE: Future development on the permittees property, including the possible change of use of the basin to commercial, will require a re-evaluation and/or modification of this permit. Contact a representative of the Division of Coastal Management prior to initiating such work for this determination. NOTE:. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Pettiford Creek in conjunction with the proposed boat basin in Carteret County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition (s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That the terminal end of the pipeline from the dredge into the retention area be positioned at a maximum distance from spillways to allow adequate settlement of suspended solids and a sufficient distance from any part of the dike so as to preclude dike erosion by the pipeline discharge. 3. That a water control structure be installed at the intake end of the effluent pipe leading from the retention area in order to insure maximum settlement of suspended solids and control discharge volumes. 4. That the flow from the diked retention area be contained by pipe, metal or wooden trough, or similar device to a point waterward of any emergent vegetation along the shoreline. 5. That sufficient freeboard be maintained within the diked disposal area during the dredging operation to assure the integrity of the dike structure and the containment of the dredged material. 6. That the concentration of settleable solids in the effluent being discharged from the diked disposal area be not greater than 0.1 ml/1. 7. That disposal area dikes be stabilized with vegetative cover as soon as possible after construction to minimize erosion. - 2 - 8. That construction of the bulkhead not restrict stream or tidal flows or drainage of adjacent areas. 10. That every reasonable effort be made to perform the work in a manner that will prevent excessive increases in turbidity and settleable solids concentrations in the water body. 11. To minimize increases in turbidity levels outside the work area, the highground basin should be built prior to any hydraulic work done in the canal. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 4th day of February, 1987. Preston Howard, Jr. d Wilmington Regional Office Subject: Regional Office Review & Recommendations Application for Permit for Excavation and/or Fill Jerry Louis Lee Carteret County The applicant proposes to maintenance excavate an existing mosquito canal which runs adjacent to his property. This canal would be used as an access channel leading to a new 60' by 40' highground boat basin. This new basin would also be bulkheaded. This work would be done adjacent to Pettiford Creek, classified SA and currently closed to shellfishing. The project will require a 401 Certification. It is recommended that the following conditions be included in this Certification: 1. That the terminal end of the pipeline from the dredge into the retention area be positioned at a maximum distance from spillways to allow adequate settlement of suspended solids and a sufficient distance from any part of the dike so as to preclude dike erosion by the pipeline discharge. 2. Lee, the applicant, owns a one acre tract of land that adjoins a man-made mosquito ditch located just off Hwy 58 and SR 1111 above the Pettiford Creek Bridge in Carteret County. Mr. Lee proposes to maintenance excavate the 520' long ditch which averages 16' wide to a depth of -4' relative to mean low-water. The new.access canal will extend through a section of high marsh vegetation. This new access cut will average approximately 16' wide and will displace about 900 sq.*ft. of salt meadow hay, saltgrass, and black needlerush. The access canal will terminate in the high ground property where the applicant proposes to excavate a basin which will measure 60' wide by-401 long by 4' deep. A drag line will remove approximately 600 cu. yds. of earthen material from this basin area. The material will be used to create the diked disposal area as shown on the work plat drawing. In order to stabilize the basin, the applicant proposes to bulkhead the entire shoreline with some 180 li. ft. of salt treated structure. The marsh interface will be left open and un- bulkheaded. 'According to the application, all maintenance dredging within the ditch will be accomplished by a small 4" hydralic dredge mounted on a barge. The dredge will pump approximately 1500 cu. vds. of silty mud to the high ground disposal site. The applicant has made a clear statement on the work plat drawing that says no marsh grass will be excavated along either side of the ekisting ditch. Additional information supplied by the applicant indicates that-the mosquito ditch was originally dug by Carteret County around 1966 or 1967. Today the ditch has silted in and is very shallow, to the point.that the upper portion of the ditch ebb dries on low tide. Salt marsh cord grass has reestablished and encroached along both sides of the original inter-tidal banks. The ditch separates the remnants of old Hwy 58 on the west side and an extensive marsh complex which braces Pettiford Creek on the east side. The entrance to the mosquito ditch is approximately 1701 above or upstream of the Hwy 58 bridge. A determination has been made that Pettiford Creek, upstream of the bridge, is considered Inland Waters.of the state by the North Carolina Wildlife Commission,. while the Division of Environmental Management classifies these waters as SA. All of the waters below, that is downstream of the bridge, have been designated as_a Primary Nursery Area by the Division of Marine Fisheries.
