Tho Phase I v,,astewater treatment system (100,000 GPD) will consist of a 25,000 gallon flow equalization chamb4:r with duplex 100 GPM submersible pumps, one (1) 80 CFM blower, and high water alarms, 11. rnaaivally craned bar screen, flow splitter box, two (2) 62,500 gallon fine bubble aeration basins, two (2) 10,r 18 gallon clarifiers, one (1) 20,000 aaIlon aerated sludge holding tank, three (3) 290 CFM blowers, t„,o (2) 34.5 square foot teritary filters (a total of 69.0 square feet) with duplex 518 GPM backwash a)urnps, duplex 40 GPM wastewater return pumps, one (1) 55 CFM air scour blower, and high water alarms, ultraviolet disinfection, one (1) 1,895 gallon effluent dosing chamber with duplex 190 GPM submrsible pumps, approximately 5,700 linear feet of 8-inch force main, acid approximatJy 170 linear feet of 3-1nch force main (to eventually puinp to Phase 11), a continuous monitoring and recording flow meter, and a turbidity meter. The spray irrigation system Nvill consist of a 500,000 gallon lined upset pond (for Phase I), a 2,000,000 ,gallon lined upset ;aond (for Phase II), a 13,000,000 gallon storage and irrigation pond, and approximately .16 acres of irritation area. "i he reclaimed water system will serve the Winding River Plantation with no discharge of wastes to the surface v,aters, pursuant to the application received April 24, 1997, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of tnvironment, Healih and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until June 30, 2002, and shall be subject to the following specified conditions and limitations: 11. PERFORMANCE STANDARDS Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. Mail the Certification to the Water Quality Permits and Engineering Unit, P.U. Box 29535, Raleigh, NC 2762E-0535. 2. The Wilmington Regional Office, telephone number (910) 395-3900, shall be notified a[ least forty-eight (48) hours in advance of operation of the installed facilities so that an ill place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5.00 p.m. on Monday through Friday, excluding State Holidays. 3. The spray irrigation facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the, irrigation area to adequately assimilate the wastewater, the Permittee shall tape immediate corrective actions including those actions that may be required by the Division of Water Quality, such as the construction of additional or replacement wastewater treatment and disposal facilities. 4. The issuance of this permit shall not relieve the Permi€tee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 5. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the North Carolina Division of Water Quality. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 7. The following buffers shall be maintained: a) 100 feet between wetted area and water supply wells, b) 100 feet between wetted area and waters classified as SA, c) 100 feet between wastewater treatment units and wells, d) 50 feet between wastewater treattxzent units and property lines, and e) 25 feet between wetted area and surface waiters not classified as SA. Public access to the Iand application sites shall be controlled during active site use. Such controls may include the posting of signs shoe-ing the activities being conducted at each site. A sign shall be posted in plain sight in the club house showing these activities. 11. OPERATION AND M_UN'lC'MANCE RE, UIREL ENT, The facilities shall be properly maintained and operated at all times. A, suitable vegetative cover shall be maintained on the spray irrigation areas. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause ninoff. 4. Adequate measures shall be taken to prevent wastewater runoff from the spray field. IYL 5. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back --up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202. Once the facility is classified, the Permittee must submit a letter to the Certification Colm-nission which designates the operator in responsible charge within thirty days after the wastewater treatment facilities are 50% complete. 6. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 7. The application rate shall not exceed a cumulative loading of 83.2 inches over any twelve (12) month period at an instantaneous application rate not to exceed 02 inches per dose. 8. No type of wastewater other than that from the Winding River Plantation shall be sprayed onto the irrigation area. All wastewater shall be routed to the five-day holding pond should the limit for fecal coliform (daily maximum concentration of 25 per 100 znl) or turbidity (instantaneous maximum of 10 NTU) be exceeded, until such time that the problems associated with the treatment capability of the wastewater treatment plant have been corrected. The wastewater in the five-day holding pond shall be pumped back to the treatment plant for retreatment or treated in the five-day pond prior to discharge to the storage pond. ���0NTITOFING AND RFPORT.TNG REQUIREMENTS Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division of Water Quality to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. During the remainder of the year, these parameters shall be monitored monthly. Triannually sampling shall be conducted during March, July, and November. If Groundwater sampling indicates or predicts problems with the compliance with Groundwater Standards, this permit will be modified to include additional and/or more restrictive. limitations. 3. Adequate records shall be maintained by the Permittee tracking the amount of wastewater disposed. These records shall include, but are not necessarily limited to the following information: a. date and time of irrigation, b. volume of wastewater irrigated, c . zone irrigated, d. length of tune zone is irrigated, e, continuous v-,,cekly, monthly, and year-to-date hydraulic (inches/acre) loadings for each zone, f. weather conditions, and g. maintenance of cover crops. 4. Three (3) copies of all operation and disposal records (as specified in condition Ill 3) on Form. NDAR-1 shall be submitted on or before the last day of the following month. Three (3) copies of all effluent monitoring data (as specified in condition III 2) on Form NDMR-1 shall be submitted on or before the last day of April, August, and December. A record shall be maintained of all residuals removed from this facility. 'This record shall include the name of the hauler, permit authorizing the disposal or a letter from a municipality agreeing to accept the residuals, date the residuals were hauled, and volume of residuals removed. C. A maintenance log shall be maintained at this facility including but not limited to the following items: a. Daily sampling results including residual chlorine, settleable matter, and dissolved oxygen in the aeration basin and at the clarifier weir. b. Visual observations of the plant and plant site. c. Record of preventative maintenance (changing of filters, adjusting belt tensions, alarm testing, diffuser inspections and cleanings, etc.). d. Date of calibration of flow measurement device. e. Date and results of power interruption testing on alternate power supply. 7. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office, telephone number (910) 395-3900, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnorrrral in quantity or characteristic, such as the dum ing of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influelat to such station or facility. d. Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. V. GROUNDWATE R REQUIREMENTS Any groundwater duality monitoring, as deemed necessary by the Division, shall be provided. The forty (40) irrigation wells at the site shall remain dedicated irrigation wells and shall not be used for any other purpose. These wells shall be clearly h-beled as non -potable and there shall be a ten (10) foot buffer between each well and the edge of the spray application area. No land application of waste activities shall be undertaken when the seasonal high water table is less than three feet below land surface. 4. Both of the 5-day upset ponds shall have liners of natural material at least one foot -ra thickness, compacted to 95% proctor standard dry density and installed and compacted ill layers no thicker than six inches, with a hydraulic conductivity of no greater than I x 10-6 cm/sec. Following installation and inspection of the lagoon liner, and prior to waste disposal operations, verification of the liner's compliance with hydraulic conductivity and thickness specifications must be provided to the Division of Water Quality, Groundwater Section, by the project engineer. 5. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary is for the disposal system constructed after December 31, 1983 is established at either (1) 250 feet from the waste disposal area, or (2) 50 feet within the property boundary, whichever is closest to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action in addition to the penalty provisions applicable under General Statute 143-215.6A(a)(1). In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require remediation action on the part of the permittee. V . INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. ? . The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division of Water Quality or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter and inspect any property, premises or place oat or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. VL GENFRtJ, CONDITIONS This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes describes[ in the application and other supporting data. 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Pernittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as array be appropriate. The approval of this request will be considered on its anerits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 6. A set of approved plans and specifications for the subject project must be retained by the Pern-.ittee for the life of the project. 7. The annual administering and compliance fee must be paid by the Permittee within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 8. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted., will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. 9. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of this permit. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by North Carolina General Statute 143-215.6(A) through 143- 215.6(C) for violation of or failure to act in accordance with the terns and conditions of this Permit. The DEVELOPER shall construct the Disposal System in accordanc: with the r=it and plans and speci-ficadons hegzafter issued, and approved by the CON MISSION; and shall thereafter properly operate and maintain such systems and facilities in accordance with applicable permit provisions and law. :?. The DEVELOPER shall not transfer ownership and/or control of the Disposal System to the Association until construction has bf= completed in aecordanc—_ with the permit and approved plans, and the staff of the Division of Environmental Management has inspected and approves of the facilities- In order to change the name of the pem-nit holder, the DEVELOPER must request that the permit be reissued to the Association. The request must include a copy of the Association Bylaws and Declaration. 3. The DEVELOPER shall provide in the Declaration and Association Bylaws that the Disposal system and appurtenances thereto are part of the common elements and shall thereafter be properly maintained and operated in conformity with law and the provisions of the permit for construction, operation, repair, and rnainwnartce of the system and facilities. The Declaration and Bylaws shall identify the entire wastewater treatment, collection and disposal system as a common element which will receive the highest priority for oxpcnditures by the Association except for Federal, State and local taxes, and insurance. i. The DEVM OPER shall provide in the Declaration and Association Bylaws that the Disposal System will be maintained out of the common expenses. In order to assure that there shall b-- funds readily available to repair, mainwin or construct the Disposal System, beyond the routine operation and maintenance expenses, the Dccla;'a6 n and Association Bylaws shall provide that a fund be created out of the common expenses. Such fund shall bo separate from the routine maintenance allocated for the facility and shall be part of the yearly budget. 6. In the event the common expense allocation and separate fund are not adequate for the construction, repair, and rnaintunance of the Disposal System, the Declaration and Association Bylaws shall provide for sprxiG l aso.mnients to cover such necessary costs. There shall be no limit on the amount of such assessments, and The Dr-cl.aration and Bylaws shall provide that such special assessments can be made as n=ssary at any time. 7. • If a wastewater collection system and wastewater treatment and/or disposal facility provided by any city, town, village, county, water and sewer authorities, or other unit of government shall hereinafter becorne available to serve the Development, the DEVELOPER shall take such action as is necessary to cause the - existing and future wastewater of the Development to be accepted and discharged into said governmental system; and shall convey or transfer as much of the Disposal System, and such necessary easernents as the governmental unit may require as condition of accepftg the Development's wastewater. kecogni��g that it would be contrary to the public interest and to the public health, safety and welfare for the Association to enter into voluntary dissolution without having made adequate provision for the continued proper maintenance, repair and operation of its Disposal. A physlcaVchemical method for reducing soluble organic material from wastewater effluent; The coiumn-type beds used in this method will have a flow rate varying tram two to elght gallons per minute per square loot and may be either upfiow or downflow carbon beds. Carbon may or may not be regenerated on the wastewater treatment plant she; (2) Aerated Lagoons. A basin in which all solids are malnialned In suspension and by which biological oxidation or organic matter is reduced through artificially accelerated transfer of oxygen on a flow -through basis; (3) Aeration. A process of bringing about Inllmals contact between air or high purity oxygen in a liquid by spraying, agitation or dlffuslon;(3a) Extended Aeration. An activated sludge process utilizing a minimum hydraulic detention time of 18 hours- (4) Agriculturally managed site. Any site on which a crop is produced, managed, and harvested (Crop Includes grasses, grains, trees, etc.); (5) Air Stripping. A process by which the ammonlum Ion is first convened to dissolved ammonia (pH adjustment) with the ammonla then released to the atmosphere by physical means; or other similar processes which remove petroleum products such as benzene, toluene, and xylene; (6) Carbon Regeneration. The regeneration of exhausted carbon by the use of a furnace to provide extremely high temperatures which volatilize and oxidize the absorbed Impurities; (7) Carbonaceous Stage. A st ige of wastewater treatment designed to achieve 'secondary' effluent Ilmfts; (B) Centrifuge. A mechanical device In which centrifugal force Is used to separate solids from liquids or to separate liquids of ddferant dens'rias; (9) Chemical Addition Systems The addhlon of chemlcai(s) to wastewater at an application point for purposes of Improving solids removal, pH ad]usiment, alkaiinhy control, etc.; the capability to experiment with different chemicals and different application points to achieve a spacft resuh will be considered one system; the capability to add chemical(s) to dual units will be rated as one system; capability to add a chemical at a dfffereni appflcatlon points for different purposes will result In the systems being rated as separate systems; (10) Chemical Sludge CondNoning. The addition of a chemical compound such as Ilme, ferric chloride, or a polymer to wet sludge to coalesce the mass prior to Its appticatlon to a dewwering device; (11) Closed Cycle Systems. Use of holding ponds or holding tanks for containment of wastewater containing inorganic, non -toxic materials from sand, gravel, crushed stone or other similar operations. Such systems shall carry a maximum of two points regardless of pumping facilities or any other appurtenances; (12) Combined Removal of Carbonaceous DOD and Nitrogenous Removal by Nitrification- A single stage system required to achieve permh effluent limits on BOD and ammonia nitrogen within the same biological reactor, (13) DecNorinallom The partial or complete reduction of residual chlorine In a liquid by any chemical or physical process; (14) Denhrrfica6on Process. The conversion of nitrale-nitrogen to Ntrogen gas;
