This permit, issued on ?-j ?r b ) , is subject to compliance with the application (where consistent
with the permit), all applic ble re lations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The proposed jetty will be placed a maximum of 2 feet from and parallel
to the existing jetty. Y
(2) The height of the jetty shall not exceed 1 foot above mean high water.
(3) The activity will, be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-
related discharge.
NOTE: The project site is located in an, area having a high probability of con-
taining cultural resources such as artifacts, human remains, etc. If
such materials are encountered, the permittee must immediately stop work
and notify the District Engineer, Wilmington Corps of Engineers at (919)
343-4629 and the N.C. Division of Coastal Management-at (919) 338-1558.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Dear Mr. Jones:
Reference is made to your application for Department of the
Army authorization to place excavated materials in wetlands
adjacent to Cedar Island Bay for the purpose of constructing a
duck impoundment near Waterlilly, Currituck County, North
Carolina. Reference is also made to our May 1, 1987, letter to
you in which you were given the opportunity to rebut the
objections maintained in the April 13 and April 16, 1987, letters
from the Fish and Wildlife Service and the National Marine
Fisheries Service. The deadline for your rebuttal was May 15,
1987. We have not received your response. Accordingly, your
Department of the Army application has been retired.
You may submit a new application for your proposal; however,
any new application must address the objections maintained by the
U.S. Fish and Wildlife Service and the National Marine Fisheries
Service. Their reaction to your proposal is the result of
anticipated significant adverse impacts. Because of the Federal
agencies' influence on Department of the Army permit decisions, it
is unlikely a Department of the Army permit would be available
unless your project can be modified to lessen its impacts.

Section 401 Public laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to James.Jones pursuant to an
application filed on the 26th day of November, 1986 to construct a
waterfowl impoundment.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of a tributary
to Currituck Sound in conjunction with the proposed waterfowl
impoundment in Currituck County will not result in a violation of
applicable Water Quality Standards and discharge guidelines. Therefore,
the State of North Carolina certifies that this activity will not
violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions hereinafter
set forth.

MR. JAMES B. JONES, POST OFFICE BOX 204, COINJOCK, NORTH CAROLINA 27923,
has applied for a Department of the Army permit TO CONSTRUCT A WATERFOWL
IMPOUNDMENT IN WETLANDS ADJACENT TO CEDAR ISLAND BAY, IN THE COMMUNITY OF
WATERLILY, CHURCH ISLAND, Currituck County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show construction of a waterfowl impoundment with outside
dimensions of 245 feet long by 190 feet wide. Fill material would be placed
in existing ditches and on high ground fields to construct a berm around the
permimeter of the impoundment. Material for the berm would be obtained from
excavation of open field and wooded wetland within the interior of the
proposed impoundment. The wooded wetland is dominated by wax myrtle, eastern
baccharis, and pine. Plans showing the proposed work are included with this
public notice.
The applicant has determined that the proposed work is consistent with the
North Carolina Coastal Zone Management Plan and has submitted this
determination to the North Carolina Division of Coastal Management for their
review and concurrence. This proposal shall be reviewed for the applicability
of other actions by North Carolina agencies such as:
a. The issuance of a Water Quality Certification under Section 401 of the
Clean Water Act by the North Carolina Division of Environmental Management.
b. The issuance of a permit to dredge and/or fill under North Carolina
General Statute 113-229 by the North Carolina Division of Coastal Management.
c. The issuance of a permit under the North Carolina Coastal Area
Management Act (CAMA) by the North Carolina Division of Coastal Management or
their delegates.
d. The issuance of an easement to fill or otherwise occupy State-owned
submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11,
and 146-12 by the North Carolina Department of Administration and the North
Carolina Council of State.

the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The.DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
February 17, 19870

Water Act certification should do so in writing delivered to the North
Carolina Division of Environmental Management, Post Office Box 27687, Raleigh,
North Carolina 27611-7687, on or before February 11, 1987, Attention:

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received November 17, 1986, for a
Department of the Army permit to place excavated material in
wetlands adjacent to Cedar Island Bay to construct a duck
impoundment near Waterlilly, Currituck County, North Carolina,
indicates it to be a candidate for Federal authorization under
this general permit. Accordingly, the administrative processing
of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

Enclosed is the application of Mr. James Benjamin Jones for a
Department of the Army permit and a State Water Quality
Certification to place excavated materials in wetlands adjacent to
Cedar Island Bay to construct a duck impoundment near Waterlilly,
Currituck County, North Carolina. Your receipt of this letter
verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by January 21, 1987, the District
Engineer will deem that waiver has occurred.

with property adjoining a proposed project of the type covered therein
be given thirty (30) days in which to comment on that project. This
