In a letter dated December 15, 2014, Troy Doby of the Water Quality Permitting Section's Non - Discharge Permitting Unit asked you to provide additional information (copy of letter attached) no later than the close of business on January 16, 2015. As of today, this information has not been received, therefore, the Division of Water Resources must return your application as incomplete in accordance with North Carolina General Statute §143-215.1. Please be advised that construction and/or operation of the subject facilities without a valid permit is a violation of North Carolina General Statute §143-215.1 and may subject the owner/operator to appropriate enforcement actions in accordance with North Carolina General Statute § 143-215.6A-6C. Civil penalties of up to $25,000 per day per violation may be assessed for failure to secure a permit required by North Carolina General Statute § 143-215.1. When the requested additional information has been obtained, a new application package and appropriate permit processing fee may be submitted. Skvarla, III Secretary Division of Water Resources' Central and Regional staff has reviewed the application package received September 30, 2014 and additional information letter received via email December 3, 2014, from Mr. Linwood Stroud, P.E. However, additional information is required before the review may be completed. Please address the items below no later than the close of business on January 16, 2015. 1. From review of the sheet Mr. Stroud provided, it appears that ditches surrounding the proposed irrigation zones 11 & 12 were claimed as waters of the US, but the interior ditches in question were not. Therefore, they can be filled as proposed without U. S. Army Corps of Engineers notification. However, our office still maintains that these ditches, as well as the proposed new deeper ditch, function to lower the groundwater in the area and would require a setback of 100 feet from wastewater irrigation areas. These should be reflected on any drawings submitted. 2. If the existing ditches are to be filled and replaced by one central ditch, a new, updated hydrogeologic assessment and mounding analysis of the area must be performed to prove that the new irrigation zones with the resultant greater ditch spacing will be able to assimilate the wastewater at the proposed loading rates. Please be aware that you are responsible for meeting all requirements set forth in North Carolina rules and regulations. Any oversights that occurred in the review of the subject application package are still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items or failure to provide the additional information on or before the above requested date may result in your application being returned as incomplete. Please reference the subject application number when providing the requested information.
