Reference your application for a Department of the Army permit
to construct a pier (bridge) to span a small tidal creek off
Jarrett's Bay, Williston, Carteret County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This permit, issued on D , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may subject
pemtittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) No land disturbing activity, other than the placement of pilings, is authorized
by this permit.
(2) A minimum vertical clearance of 3-1/2' must be maintained between the mean
high water line and the bottom of the walkway stringer. A horizontal clearance
the width of the creek channel will also be maintained.
(3) The permittee must install and maintain, at his expense, any signal lights
and signals prescribed by the U. S. Coast Guard and/or The Uniform Waterway
Marking System regulated.by the N. C. Wildlife Resources Commission on the

(4) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the permitted activity
without having it transferred to a third party.
(5) The authorized structure and associated activity must not cause an unacceptable
interference with navigation.

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.

9. NARRATIVE DESCRIPTION:
The applicant's property consists of an approximately
twenty-seven (27) acre tract of land located at the end of a
private dirt drive off NCSR 1353 and adjacent to Jarrett's
Bay in the Community of Williston, Carteret County. This
private drive is located on the left in the first curve one
would encounter going East on SR 1353. A residence has been
constructed on this property and the applicant has built a
bulkhead pier and boathouse under several general permit
authorizations.
The applicant is now requesting a permit to construct an
approximately 100' long by 4' wide walkway over a small
tidal creek in order to gain pedestrian access to a sandy
beach area just North of this creek. The creek at this
location is approximately 12' in width and appears to be
navigable by small boats during mid to high tides. On
either side of the creek at this location coastal wetlands
exist which vary from 30' to 50' in width. The applicant
has indicated that no pilings would be placed in the creek,
and that a vertical clearance of 3' would be established
from mean highwater to the bottom of the walkway. The
applicant is also proposing to construct the walkway over
the vegetative wetland areas.
10. ANTICIPATED IMPACTS:
The project as proposed will result in the construction of
walkway over a tidal creek which adjoins Jarrett's Bay and
over coastal wetland vegetation. Navigation in this creek
is limited, but would be available to small boats during
periods of higher water. The applicant is proposing to span
the creek with pilings and provide a vertical clearance of
31. The width of the walkway over the creek and over
coastal wetlands is proposed to be 41. Adjacent waters are
classified as "SA" by the Division of Environmental
Management and are open to the harvesting of shellfish.

In addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).

Reference the application of Mr. Luke Job for a Department of
the Army permit to construct a pier (bridge) to span a small tidal
creek off Jarrett's Bay, Williston, Carteret County, North
Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The permittee must install and maintain, at his expense,
any signal lights and signals prescribed by the U.S. Coast Guard,
through regulations or otherwise, on authorized facilities.
b. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having it transferred to a
third party.
c. The authorized structure and associated activity will not
cause an unacceptable interference with navigation.

9. NARRATIVE DESCRIPTION:
The applicant's property consists of an approximately
twenty-seven (27) acre tract of land located at the end of a
private dirt drive off NCSR 1353 and adjacent to Jarrett's
Bay in the Community of Williston, Carteret County. This
private drive is located on the left in the first curve one
would encounter going East on SR 1353. A residence has been
constructed.on this property and the applicant has built a
bulkhead pier and boathouse under several general permit
authorizations.
The applicant is now requesting a permit to construct an
approximately 100' long by 4' wide walkway over a small
tidal creek in order to gain pedestrian access to a sandy
beach area just North of this creek. The creek at this
location is approximately 12' in width and appears to be
navigable by small boats during mid to high tides. On
either side of the creek at this location coastal wetlands
exist which vary from 30' to 50' in width. The applicant
has indicated that no pilings would be placed in the creek,
and that a vertical clearance of 3' would be established
from mean highwater to the bottom of the walkway. The
applicant is also proposing to construct the walkway over
the vegetative wetland areas.
10. ANTICIPATED IMPACTS:
The project.as proposed will result in the construction of
walkway over a tidal.creek which adjoins Jarrett's Bay and
over coastal wetland vegetation. Navigation in this creek
is limited, but would be available to small boats during
periods of higher water. The applicant is proposing to span
the creek with pilings and provide a vertical clearance of
31. The width of the walkway over the creek and over
coastal wetlands is proposed to be 41. Adjacent waters are
classified as "SA" by the Division of Environmental
Management and are open to the harvesting of shellfish.

In addition to the completed application form, the

A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
