(1) The proposed pier must be constructed in accordance with the permitted workplat drawings, dated October. 6, 1987. (2) The pier shall not interfere with the access to any riparian property, and shall have a minimum setback of 15' between any part of the pier and the adjacent property owner's area of riparian access. (3) The bulkhead will not be positioned farther waterward than an average of 3 feet nor a maximum of 6 feet from the normal water elevation contour at any point along its alignment at the time of construction. To prevent an unintentional violation of this authorization, representatives of the N.C. Division of Coastal Management and the Corps of Engineers are available to stake the alignment before construction. (4) All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. See attached sheet for Additiona"1 Co This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance; as the case may be. This permit must be accessible on-site to Department personnel wben the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. (6) The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (7) No marsh grass will be excavated and/or filled. (8) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the plat. (9) The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within 30 days of project completion. (10) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction- related discharge. (11) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party. NOTE: It is recommended that the applicant meet with representatives of DCM and/or U.S. Army Corps of Engineers prior to project initiation. NOTE: The proposed project is certified under General Water Quality Certification No. 1272 issued on November 10, 1978, for bulkhead construction. Reference the application of Mr. John A. Jackson for a Department of the Army permit to replace an existing pier with a new pier and 2 additional decks at the end of S.R. 1711, Clubfoot Creek, Matthews Point, Craven County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must riot interfere with the public's right to free navigation on all navigable waters on the United States. b. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. -2- c. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work, will, without expense to the United States and in such time and mariner as the Secretary of the Army or his authorized representative may direct, restore the waterway to its former conditions.. If the permittee fails to comply with this direction, the Secretary or his representative may restore the waterway, by contract or otherwise, and recover the cost from the permittee. d. It is possible that the authorized structure may be damaged by wave wash from passing vessels. The issuance of this permit does riot relieve the permittee from taking all proper steps to insure the integrity of the permitted structure and the safety of moored boats from damage by wavewash. The permittee will riot hold the United States liable for any such damage. e. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permitee is riot relieved of this requirement if he abandons the permitted activity without transferring it to a third party. f. The authorized structure and associated activity will riot cause art unacceptable interference with navigation. g. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required State/Federal coordination. h. In issuing this permit, the Federal Government does riot assume any liability for the following: (1) Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes. (2) Damages to the permitted project or uses thereof as a result of current or future Federal activities initiated on behalf of the general public. JACKSON PAGE #2 9. NARRATIVE DESCRIPTION: The project site is located at the end of SR 1711, at Matthews Point, near the mouth of Clubfoot Creek, in Craven County. Visitors to the site will want to take Highway 101 from Havelock or Beaufort. The community of North Harlowe is nearest the project site. The applicant, Mr. John A. Jackson, proposes to modify his Major CAMA/Dredge and Fill Permit #170-86 issued in August of 1986. That permit authorized the construction of a bulkhead with backfill and a boat ramp. The onsite inspection conducted recently confirms that work has been completed in accordance with the permit conditions. At this time, the applicant proposes to completely replace the old deteriorated pier with a new wider, longer structure. The existing pier is 6' wide x 130' long with a t-head platform at the offshore end. The pier has a traditional top deck elevation of 3' to 4' above the normal water level. The proposed new pier will have an overall length of 1801.with a width of 8' along the main leg. The top deck elevation will be approximately 8' above the normal water level. The applicant hopes this design will prevent storms and other abnormally high tide conditions from lifting the structure, or otherwise destroying it. The project plans also call for the construction of two (2) lower level decks, each measuring 10' x 20' to be positioned on either side of the pier. These structures will allow easier access on lower tide conditions. Water depths in this area range from -4' to -6' during periods of normal water level. 10. ANTICIPATED IMPACTS: The proposed pier, and associated single-family activities, should create little to no adverse impact on the local ecology of Clubfoot Creek. The new proposes pier will be oriented along the same line as the old pier. The 8' width, the 8' height, and the 50' extension should pose no problems to traditional navigational use in Clubfoot Creek. NARRATIVE DESCRIPTION: The project site is located at the end of SR 1711, at Matthews Point, near the mouth ofr Clubfoot Creek, in Craven County. Visitors to the site will want to take Highway 101 from Havelock or Beaufort. The community of North Harlowe is nearest the project site. The applicant, Mr. John A. Jackson, proposes to modify his Major LAMA/Dredge and Fill Permit #170-86 issued in August of 1986. That permit authorized the construction of a bulkhead with backfill and a boat ramp. The onsite inspection conducted recently confirms that work has been completed in accordance with the permit conditions. At this time, the applicant proposes to completely replace the old deteriorated pier with a new wider, longer structure. The existing pier is 6' wide x 130' long with a t-head platform at the offshore end. The pier has a traditional top deck elevation of 3' to 4' above the normal water level. The proposed new pier will have an overall length of 1801.with a width of 8' along the main leg. The top deck elevation will be approximately 8' above the normal water level. The applicant hopes this design will prevent storms and other abnormally high tide conditions from lifting the structure, or otherwise destroying it. The project plans also call for the construction of two (2) lower level decks, each measuring 10' x 20' to be positioned on either side of the pier. These structures will allow easier access on lower tide conditions., Water depths in this area range from -4' to,-61 during periods of normal water level. 10. ANTICIPATED IMPACTS: The proposed pier, and associated single-family activities, should create little to no adverse impact on the local ecology of Clubfoot Creek. The new proposes pier will be oriented along the same line as the old pier. The 8' width, the 8' height, and the 50' extension should pose no problems to traditional navigational use in Clubfoot Creek.
