SUBJECT: Stormwater Revittt Somerset Plantation Project #880205 Carteret County This office has reviewed the proposed Somerset Plantation for stormwater control. The owners propose to develop a 42 acre parcel of land into a 70 lot residential development including a pool, tennis courts, boat ramp and paved streets. The project is located on NC Highway 24 near Morehead City, adjacent to Bogue Sound, classified "SA" and currently open to shellfishing. Mr. Larry Zucchino submitted revised plans revised 2/17/88, indicating that the proposed development would meet the density limitations of less than 25 percent. Calculations indicate that the built upon surface area will 'be limited to 6,098 sq. ft. per lot by deed restrictions. Plans indicate that roads will not have curb and gutter, and the built upon areas will be at least 30 feet from mean high water with the exception of a proposed boat ramp. The proposed project (Density Submittal Form and Site Development Plan attached) meets the requirements of 15 NCAC 2H. 1000. This office has no objection to the stormwater management aspects of the plan proposed. If you have any questions, please advise. Computations determining the maximum allowable built upon area for each lot are specified in the attached form titled "Submittal Form for Projects Using Density Limits for Stormwater Control." Derivation of these limits for this project are as follows: Total Acres 41.96 acres -2.29 acres (Roadways) -0.47 acres (Club/pool/tennis) Net Acres 39.2 acres 39.2 ac. x 0.25 = 9.8 acres 9.8 acres allowable for all lots 9.8 / 70 lots = 6,098 s.f impervious surface maximum for any lot. 1 Each lot in the subdivision will be restricted to a maximum impervious cover of 6,098 s.f. through a set of legal deed restrictions attached to each lot. By restricting each owner to a certain built upon surface area, the total development will not exceed the twenty-five percent limitation on impervious surfaces for the entire development. The restrictions and covenants specifically note that the State of North Carolina will be the beneficiary of these restrictions. Please contact me if you require any additional information or clarification concerning this matter. A CAMA Permit and Sedimentation and Erosion Control Permit have been issued for this project. (6) Excavation of the proposed boat basin will be limited to a maximum length of 180', a width of 40', and a water depth of -3' on mean low tide. (7) All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. (8) Vegetated wetlands will not be excavated or filled. (9) The temporary placement or double-handling of excavated or fill materials within waters or vegetated wetlands'is not authorized. (10) The proposed 6' wide pier will be limited to an overall length of 200'. This includes a T-head platform measuring 20' x 151. Since the designated purpose of this pier is for pedestrian access to Bogue Sound, this permit does not authorize additional boat mooring facilities at the pier. (11) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the water body is 50 NTUs or less are not considered significant. (12) New stormwater management rules are effective as of January 1, 1988. Storm- water controls must be redesigned to incorporate the new rules. The new stormwater plans must be reviewed and approved by the Division of Environmental Management through the Division of Coastal Management and incorporated as a modification to this permit prior to initiation of highground development. (13) Any changes in the development of the subdivision, or the activities associated with the boat ramp, docks or piers, will require a re-evaluation by the Division of Coastal Management and a modification of this permit. (14) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. __(15) The authorized-structure and associated activity must not cause an unacceptable interference with. navigation. (16): Approval of the structure was based on determination that there would be no obstruction to navigation. Under conditions existing in the Atlantic Intracoastal_ Waterway (AIWW), a possibility exists that the structure may be damaged by wavewash from passing vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to nullify the navigational benefits on "which the AIWW was justified. Issuance of this permit should not be construed as relieving the permittee of taking proper steps. to ensure-the-structure-and moored boats will not be damaged by wavewash normally to be_expected.in-the AIWW. a H. Bulkheads and Shore Stabilization Measures", bulkheading around the peninsula in front of existing riprap is hereby deleted, as noted on "Fig. 2" and "rig. 6" modified by DCM, 1/13/88. Replacement of the bulkhead with a dock and finger piers for 9 slips within the channel maintenance area is permissible provided revised plans are submitted in accordance with Condition #11. (2) In order to protect juvenile shrimp and fin fish populations, no excavation or filling will be permitted between April 1 and August 31 of any year without the prior approval of the Division of Coastal Management. (3) All construction activities associated with this permit must be undertaken in accordance with the attached work plat drawings. (4) Excavation of the proposed boat basin will be limited to a maximum length of 180', a width of 40', and a water depth of -3' on mean low tide. (See attached sheet for Additional Conditions) -"a This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected. for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. (6) Vegetated wetlands will not be excavated or filled. (7) The temporary placement or double-handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (8) The proposed 6' wide pier will be limited to an overall length of 200'. This includes a T-head platform measuring 20' x 15'. Since the designated purpose of this pier is for pedestrian access to Bogue Sound, this permit does not authorize additional boat mooring facilities at the pier. NOTE: Alignment of the pier should be shifted so that the landward end abuts the existing peninsula. (9) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the water body is 50 NTUs or less are not considered significant. (10) New stormwater management rules are effective as of January 1, 1988. Storm- water controls must be redesigned to incorporate the new rules. The new stormwater plans must be reviewed and approved by the Division of-Environmental Management through the Division of Coastal Management and incorporated as amodification to this permit prior to initiation of highground development. (11) Any changes in the development of the subdivision, or the activities associated with the boat ramp, docks or piers, will require a reevaluation by the Division of Coastal Management and a.modification of this permit. (12) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. (13) The authorized structure and associated activity must not cause an unacceptable interference with navigation. (14) Approval of the structure was based on determination that there would be no obstruction to navigation. Under conditions existing in the Atlantic Intracoastal Waterway (AIWW), a possibility exists that the structure may be damaged by wavewash from passing vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to nullify the navigational benefits on which the AIWW was justified. Issuance of this permit should not be construed as relieving the. permittee of taking proper steps to ensure the structure and moored boats will not be damaged by wavewash normally to be expected in the AIWW. NARRATIVE DESCRIPTION: The applicant, Mr. H. William Hull, Jr., recently acquired a 42 acre tract of land known as the Barringer Estate, located off Highway 24, west of Morehead City, between Barnesfield Subdivision and Ho-Ho Village, on Bogue Sound. The private driveway entrance to the property is situated due south of SR 1265 which leads directly to the Carteret-Craven Electrical Membership cooperative buildings. The project site is a rectangular shaped piece of property about 487' wide on the highway and approximately 2,408' deep on the sidelines. Other than one small outbuilding and a barn, the most notable structure on the property is a very large manor house built by the original owners in December, 1962. It was also during that time when the owner excavated an access channel and a highground boat basin.. The spoils from that project were stockpiled on the east side of the channel alignment creating a peninsula of land that extends some 250' into Bogue Sound. Today, the peninsula is about 80' to 100' wide and stabilized with irregularly shaped pieces of concrete rubble, brickbats, marl and asphalt. A wooden deck, or platform, measuring 20' x 20' is located at the end of the peninsula. The aerial photograph and topographic map referenced on the front sheet of this report will provide an excellent overview and orientation of this property along the Bogue Sound shoreline. Wide fringes of saltmarsh cordgrass border the project shoreline west of the boat basin and east of the peninsula. Except for the access channel, the waters of Bogue Sound adjoining the property are shallow with sandflats occupied by patches of eelgrass. Back on the highground property, elevations over the 42 acre site range from 5' to 30' above mean sea level.. Unlike other sites along Highway 24, in Bogue Sound, no 404 Wetlands appear to transect the property. As proposed, the applicant plans to develop a single-family, residential subdivision to be known as "Somerset Plantation". Each of the proposed 70 lots will be approximately 1/2 acre in size. Individual wells.and septic systems are anticipated. The developer would like to provide the community with water access and a recreational site at the existing boat basin and on the peninsula. In order to accomplish this, a boat ramp is proposed for construction along the back end of the bulkheaded basin. The ramp will measure 18' wide x 20' long.and will be serviced by an asphalt driveway leading in from the main subdivision road. The existing access channel has adequate water depths ranging from 3-1/2' to 4' on mean low water. However, one area at the end of the access channel near the basin will need maintenance excavation. This area is about 60' long x 20' wide and will generate approximately 154 cubic yards of sandy/mud spoil. r 0 FIELD INVESTIGATION REPORT - H. WILLIAM HULL, JR./ SOMERSET PLANTATION PAGE #3 A new open water basin measuring 180' long x 40' wide will be mechanically excavated in that area between the access channel and the existing peninsula. The proposed water depths in the new basin will be -3' on mean low water. An estimated 1,000 cubic yards of sandy/mud will be placed on the highground peninsula and retained in a diked area. As proposed, the new basin will provide finger piers and mooring piles for 9 boat slips. These will be temporary slips for the boat traffic coming and going from the boat ramp. Because the riprap shoreline along the peninsula is so irregular, the applicant proposes to construct a 500' long bulkhead to straighten the west and south ends of the peninsula. The proposed bulkhead will be positioned an average of 5' waterward of the mean high water shoreline in an effort to install the structure in front of the existing rubble. At the south end of the bulkheaded peninsula, the applicant proposes to construct a private pedestrian pier 200' long x 6' wide, with a 15' x 20' t-head platform. The water depths at the end of the proposed pier average -3.51. on mean low water. Several onsite visits have been made, including one. waterside visit by boat. It has been determined that the end of the proposed pier will be approximately 300' from the northern edge of the Intercoastal Waterway. In addition, no eelgrass or significant shellfish resources were found to occur within the channel alignment. Other background information indicates that the."SA" surface waters of Bogue Sound in this area are closed to the harvesting of shellfish. 10. ANTICIPATED IMPACTS: The proposed project will bring the increased boating traffic and pedestrian use of the new 70 lot subdivision. It is noted that the intended purpose of the boat ramp and basin facilities is for the private use by residents with small trailerable boats of the 12' to,20' class. These boats can usually navigate quite well in water depths of only 3' to 4' deep and usually have no onboard bathroom facilities. The proposed bulkhead will displace about 1200 sq. ft. of intertidal bottomland now occupied by the riprap material. The loss of this marginal habitat should not have any significant impact on the estuarine resources. The proposed pedestrian pier should also have no significant impact on the traditional navigational or recreational uses of the Bogue Sound waterway. The overall projection of the proposed pier falls significantly short of the 900' long private pier located near Gull Harbor to the east. FIELD INVESTIGATION REPORT - H. NARRATIVE DESCRIPTION: The applicant, Mr. H. William Hull, Jr., recently acquired a 42 acre tract of land known as the Barringer Estate, located off Highway 24, west of Morehead City, between Barnesfield Subdivision and Ho-Ho Village, on Bogue Sound. The private driveway entrance to the property is situated due south of SR 1265 which leads directly to the Carteret-Craven Electrical Membership Cooperative buildings. The project site is a rectangular shaped piece of property about 487' wide on the highway and approximately 2,408' deep on the sidelines. Other than one small outbuilding and a barn, the most notable structure on the property is a very large manor house built by the original owners in December, 1962. It was also during that time when the owner excavated an access channel and a highground boat basin. The spoils from that project were stockpiled on the east side of the channel alignment creating a peninsula of land that extends some 250' into Bogue Sound. Today, the peninsula is about 80' to 100' wide and stabilized with irregularly shaped pieces of concrete rubble, brickbats, marl and asphalt. A wooden deck, or platform, measuring 20' x 20' is located at the end of the peninsula. The aerial photograph and topographic map referenced on the front sheet of this report will provide an excellent overview and orientation of this property along the Bogue Sound shoreline. Wide fringes of saltmarsh cordgrass border the project shoreline west of the boat basin and east of the peninsula. Except for the access channel, the waters of Bogue Sound adjoining the property are shallow with sandflats occupied by patches of eelgrass. Back on the highground property, elevations over the 42 acre site range from 5' to 30' above mean sea level. Unlike other sites along Highway 24, in Bogue Sound, no 404 Wetlands appear to transect the property. As proposed, the applicant plans to develop a single-family, residential subdivision to be known as "Somerset Plantation". Each of the proposed 70 lots will be approximately 1/2 acre in size. Individual wells and septic systems are anticipated. The developer would like to provide the community with water access and a recreational site at the existing boat basin and on the peninsula. In order to accomplish this, a boat ramp is proposed for construction along the back end of the bulkheaded basin. The ramp will measure 18' wide x 20' long and will be serviced by an asphalt driveway leading in from the main subdivision road. The existing access channel has adequate water depths ranging from 3-1/2' to 4' on mean low water. However, one area at the end of the access channel near the basin will need maintenance excavation. This area is about 60' long x 20' wide and will generate approximately 154 cubic yards of sandy/mud spoil. FIELD INVESTIGATION REPORT - H. WILLIAM HULL, JR./ SOMERSET PLANTATION PAGE #3 A new open water basin measuring 180' long x 40' wide will be mechanically excavated in that area between the access channel and the existing peninsula. The proposed water depths in the new basin will be -3' on mean low water. An estimated 1,000 cubic yards of sandy/mud will be placed on the highground peninsula and retained in a diked area. As proposed, the new basin will provide finger piers and mooring piles for 9 boat slips. These will be temporary slips for the boat traffic coming and going from the boat ramp. Because the riprap shoreline along the peninsula is so irregular, the applicant proposes to construct a 5.00' long bulkhead to straighten the west and south ends of the peninsula. The proposed bulkhead will be positioned an average of 5' waterward of the mean high water shoreline in an effort to install the structure in front of the existing rubble. At the south end of the bulkheaded peninsula, the applicant proposes 'to construct a private pedestrian pier 200' long x 6' wide, with a 15' x 20' t-head platform. The water depths at the end of the proposed pier average -3.5' on mean low water. Several onsite visits have been made, including one waterside visit by boat. It has been determined that the end of the proposed pier will be approximately 300' from the northern edge of the Intercoastal Waterway. In addition, no eelgrass or significant shellfish resources were found to occur within the channel alignment. Other background information indicates that the "SA" surface waters of Bogue Sound in this area are closed to the harvesting of shellfish. 10. ANTICIPATED IMPACTS: The proposed project will bring the increased boating traffic and pedestrian use of the new 70 lot subdivision. It is noted that the intended purpose of the boat ramp and basin facilities is for the private use by residents with small trailerable boats of the 12' to 20' class. These boats can usually navigate quite well in water depths of only 3' to 4' deep and usually have no onboard bathroom facilities. The proposed bulkhead will displace about 1200 sq. ft. of intertidal bottomland now occupied by the riprap material. The loss of this marginal habitat should not have any significant impact on the estuarine resources. The proposed pedestrian pier should also have no significant impact on the traditional navigational or recreational uses of the Bogue Sound waterway. The overall projection of the proposed pier falls significantly short of the 900' long private pier located near Gull Harbor to the east. FIELD INVESTIGATION REPORT - H.
