(1) In order to protect the loggerhead sea turtle (Caretta carretta) and the intertidal benthic community, no work will be perms a eTw-een=. the dates of April 1 - December 15 of any year without the express prior approval of the Division of Coastal Management in consultation with the U. S. Fish and Wildlife Service. (2) Individual and group requests to beach bulldoze may be carried out under this. permit only after each individual or group has contacted appropriate Town authorities, and after evidence of adjacent landowner notification is submitted to the Div. of Coastal Management at the NRCD, Wilmington Regional Office. (3) The area.. on which this activity is being performed must maintain a slope of adequate grade so as to not endanger the public or the public's use of the beach and should follow the pre-emergency slope as closely as possible. The movement of material utilizing a bulldozer, front end loader, backhoe, scraper, or any type of earth moving or construction equipment shall not exceed one foot in depth measured from the pre-activity surface elevation. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (5) The activity must not exceed the lateral bounds of the permitte's property unless he has permission of the adjoining landowners. (6) The activity must not significantly increase erosion on neighboring properties and must not have a significantly adverse effect on important natural or cultural resources. (7) This permit does not grant any property rights or exclusive privileges. (8) In issuing this permit, the State and Federal Governments do not assume any liability for the following: (a) Damages to other permitted or unpermitted activities or structures caused by the authorized activity. (b) Damage claims associated with any future modification, suspension, or revocation of this permit. (9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by. the United States in the public interest. NOTE: The Town should monitor all project activity to ensure compliance with permit conditions. NOTE: There exists the possibility that this work may unearth a beached shipwreck. In the event that such occurs, work shall move to another area and the Underwater Archaeology Unit and the DCM shall be contacted immediately at (919) 458-9042 and 256-4161, respectively. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. In order to protect the loggerhead sea turtle, Caretta carretta, no work will be permitted between the dates of April 1 and December 15 of any year without the prior approval of the North Carolina Division of Coastal Management, the U.S. Fish and Wildlife Service and the National Marine Fisheries Service. b. The project area is located adjacent to the Atlantic Ocean, classified SB. The projcet has been reviewed to determine impacts to water quality. The following comments are offerred: 1. The project. will require 401 Certification, and should contain the following: a. Turbidity shall not exceed 25 N . T . U . as a result of the proposed activity. b. PROJECT DESCRIPTION: The Town of Holden Beach in response to recent severe storm events with accompanying erosion is requesting that a CAMA permit be issued which will allow the town to issue a letter of authorization to all citizens who request permission to bulldoze. At the present time there are structures along the beach front which can qualify as threatened (foundation 20' from erosion escarpment). There are also those which have too much land between the escarpment and the foundation to be considered threatened. This permit would allow the town officials to allow bulldozing on a case-by-case basis whenever individual property owners request it. Landowners with threatened structures can get a quick permission at the present time through emergency procedures. Others must go through the longer CAMA minor permit process. The Town proposes to allow for a dune face replacement approximately 16' wide and 8' high along the six miles of beach. 10.
