(1) A silt fence will be erected across the mouth of the canal and remain in
place until 24 hours after all excavation has been completed to prevent
unnecessary siltation from reaching Currituck Sound.
(2) Excavation will not exceed -6' below the normal water level.
(3) No excavated or fill material will be placed at any time in any marsh or
surrounding waters outside of the alignment of the fill area indicated
on the work plat(s).
(4) All excavated materials will be confined above mean high water and landward
of regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or surroun-
ding waters.
(5) The external slope of the spoil disposal area dike must be at an angle
that can be retained by vegetative ground cover. This is no steeper than
2H:IV.

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1991 -
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(6) A ground cover sufficient to restrain erosion must be provided on all slopes
within 30 working days of completion of dike construction, and within 30
working days or 120 calendar days, whichever is shorter, of completion
of the project on all other exposed areas.
(7) The activity will be conducted in such a manner as to prevent a significant
increase in turbidity outside the area of construction or construction-related
discharge.
NOTE: Future development such as additional dock or pier construction on the
permittee's property will require a modification of this permit.

DATE: December 8, 1987
Mr. J. A. Helms has submitted a modification of his original CAMA
permit application to maintain and extend a boat basin near Jarvisburg,
on a man-made canal off the Currituck Sound in Currituck County, N. C.
Upon learning of possible denial of his proposal, he has reduced the amount
of excavation and decreased the angle of the access canal. This proposal
will result in the excavation of 1800 square feet of high ground and 255
square feet of "404" wetlands for the new work, and 900 square feet of
shallow water for maintenance of the existing basin, as indicated on the
attached plat. According to the applicant, final depths within the canal/
basin will be less than those of adjacent waters within the man-made canal.
Please review this modification and submit your comments to this office
before December 30, 1987.

County off S.R. 1118 on a man made canal off the Currituck Sound. _

SITE DESCRIPTION
The applicant's property is located in Currituck County off S.R. 1118 on a man
made canal adjacent the Currituck Sound. There is an existing 30' X 30' boat basin
which is located at a right angle off an approximately 1400 foot long man made canal
which has only one 45 degree turn along its entire length. The adjacent property
landward is a cultivated field. Across the basin alongside the canal are 11404"
wetlands. There is a 6' wide drainage ditch leading out from the basin along the
edge of the "404" area and the cul°tivated fields, separating the two landforms.
The applicant proposes to perform maintenance excavation of 2' within the
existing 30' X 30' X 4' basin, which will result in 900 square feet of basin bottom
excavation by dredging'to approximately -6'. The applicant also proposes to excavate
out from the existing basin an extension into the highground (cultivated field) to
be 100' X 30' X-6'. This excavation will be along the 6' wide existing drainage
ditch. All spoil material will be placed on highground behind the proposed bulkhead.
A wooden bulkhead is proposed to be constructed along the one edge of the proposed
100' X 30' X-6' boat basin excavation. This proposed bulkhead will be approximately
100' in length. In addition, a 4' wide dock is proposed to be constructed parallel to
the bulkhead.
ANTICIPATED IMPACTS
The project as proposed will result in the excavation of 900 square feet of
basin bottom, resulting in 66 cubic yards of spoil material. The excavation of the
highground area will result in 666 cubic yards of spoil. The proposed bulkhead will
be 100' in length and will usurp approximately 100 square feet of excavated basin bottom.
The proposed dock will result in the shading of 400 square feet of basin bottom. The
total project will result in increased levels of turbidity, however, these effects
will be short-termed and localized.
The N.C. Division of Environmental Management classifies these waters as "SC".

A opy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
LAn accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per.
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113.229(d).

application. The project will be subject to condi-
tions and restrictions contained in the permit.
