Staff of our Winston-Salem Regional Office have confirmed that this NonDischarge Permit is no longer required. Box 5705 High Point, NC 27262 Dear Mr. Crowley: Subject: Permit Issuance Water Quality Permit No. WQ0012896 Guilford County e�� EDEHNR DIVISION OF WATER QUALITY -- Water Quality Section -- This letter is to address your concerns in your letter dated January 6, 1997. Your firm applied for a land application permit to dispose of Coca Cola damaged by Hurricane Fran. In your letter you indicated the turnaround time for this permit was two weeks. Title 15A North Carolina Administrative Code (NCAC) 2H.0209 addresses the processing of permit applications by the Division. The Director is required to take final action on all applications not later than 90 days following receipt of a complete application and with required information. The staff strives to issue permits as quickly as possible with adequate technical review. During the review of this application it was determined that your application was incomplete. The application did not coptain any soils analysis or address the Coca Cola pH. As with any incomplete application, there is a delay in issuance of the permit until the necessary information is received and reviewed by the Division. Typically land application permits involve any solid or semi-solid waste which in most cases are soils contaminated with petroleum products or sludge from wastewater treatment plants. It is understood that your competitor received a similar permit in one day from another regional office for land applying Coca Cola, The competitor submitted information to the region indicating the waste was typical soil remediation waste. Since the applicant presented the waste as typical, the regional office issued the permit quickly. Evidently the information submitted was inaccurate and incomplete. It is unfortunate that the permit was issued so hastily. The competitor's application should have received the same level of review as yours did in Winston- Salem. Since this incident, the Division is working on consistent technical reviews in each regional office. 585 Waughtown Street, %�y. In the future your competitor's applications should be reviewed in the same manner that your application was reviewed. It is not our policy to give any firm a competitive edge. Please accept our apology concerning this matter. Your permit will be revoked as you requested. (EMS) received a notice regarding Violation and Revocation for nonpayment for Water Quality Permit No. WQ0012896. Please go ahead and revoke our permit. EMS had to wait two weeks for this permit and our competitor received the permit in one day. EMS lost the job to the competitor due to this wait time. This fee is required by Title 15 North Carolina Administrative Code 2H .0205, under the authority of North Carolina General Statutes 143-215.3(a)(1), (la) and (lb). Because this fee was not fully paid within 30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 1.5 NCAC 211 .D205(c)(4), and G.S. 143-215.1(li)(3). This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative hearings, Post Office Drawer 27447, Raleigh, North Carolina, 27611-7447.
