Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The bulkhead alignment will average 2' and a maximum of 5' beyond the existing bulkhead at the time of construction. (2) All backfill material will be obtained from a high ground source and confined behind the permitted; bulkhead.. (3) The fill material will abe.,clean and free of any pollutants,! except in- trace -quantities :Fleta? .pr.oducts, org4nic materials, or unsightly debris will not be used.- (4) Vegetated wetlands will not be filled. (5) The backfill material will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. (6) The activity will be conducted in such 'a manner as to prevent significant increases in turbidity outside the area ofconstruction or construction-related discharge. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The bulkhead will not be positioned farther waterward than a line established from the corners of the existing bulkheads on adjacent properties. b. All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. c. Vegetated wetlands will not be filled. d. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. e. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this -2- permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. f. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Project nummary The applicant proposes to construct a new bulkhead an average of four feet waterward,of his existing bulkhead on T..ulls Bea at Bra View Acres. FREDERICK C. HAMBRUCH. BIO REPORT PAGE 2 SITE DESCRIPTION The applicant owns a single family residential lot on Tulls Bay at Bray View Acres. The property supports a single family residence which is serviced by a septic tank and drain field, a garage and a utility buildl ng. The.shoreline is bulkheaded and is retaining its backfill, however, the structure is very old and needs replacing. The adjacent properties are bulkheaded as well with the bulkhead on the property to the east extended seven feet more waterward than the applicant's and the bulkhead to the west one foot more waterward. The applicant is requesting authorization to extend his new bulkhead between the two existing bulkheads on the adjacent properties. This will result in an average of 4 feet waterward of the 14WL for the 165 foot long bulkhead. ANTICIPATED IMPACTS The construction of the bulkhead will result in some short term elevated turbidity levels. Backfilling of the bulkhead will result in the loss of 660 square feet of shallow water habitat.
