Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The northern bulkhead will be positioned entirely landward of any wetland vegetation. (2) On the eastern side of the basin, a 5-foot-wide zone, between excavation and existing marsh, will be undisturbed and retained as a buffer. (3) All spoil materials must be placed on highground or upon a barge and retained in such a fashion to prevent spill-over into adjacent wetland or water areas. (4) Prior to excavation of the boat basin, the permittee's contractor must designate the spoil disposal site and have it approved by a representative of the Division of Coastal Manaqement. (5) No excavated or fill materials will be placed at any time in any vegetated wetlands or waters of the State. I (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty' (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (7) Excavation will not exceed 6 feet below the elevation of mean low water (MLW). (8) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (9) The pier and mooring pilings must not extend any further waterward than the established pier-head line. (10) This permit does not authorize the interference with any existing or proposed Federal project. (11) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. (12) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction- related discharge. NOTE: Future residential construction may require a CAMA minor development permit. You should contact the Carteret County Planning Office for such a determi- nation prior to construction. NOTE: Permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. NOTE: The proposed project is certified under General Water Quality Certification No. 1272 issued on November 10, 1978, for bulkhead construction. NOTE: The permittee should contact the local health department regarding their requirements for septic tank and private well installations (as required under 10 NCAC 10A .1900 et. seq.). The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. Project summa ry:_The applicant is proposing to maintain an existing boat basin which has shoaled-in and construct a dock into Taylors Creek at a site off the Lennoxville Road (SR 1310) near the Town of Beaufort, Carteret County. NARRATIVE DESCRIPTION: The applicants property consists of an approximately 1.2 acre tract of land which is located on the south side of the Lennoxville Road (NCSR 1310) and adjacent to Taylors Creek, near the Town of Beaufort, Carteret County. The property is undeveloped and is characterized by having an upland area consisting of primarily oak trees with elevations of approximately 10' above mean sea level. Along the shoreline of Taylors Creek, the highground is separated from the water by an approximately 40' to 50' border of coastal wetlands which consist primarily of Spartina alterniflora marsh. Years ago, an approximately 28' wide x 45' long boat basin was excavated into this marsh area. Today, the mouth of the basin has filled in and has re-established itself with an approximately 4' to 5' border of Spartina alterniflora marsh on either side of an approximately 4' wide sandy berm area. Additionally, on the northern side of the basin an approximately 1' to 6' border of Spartina alterniflora, Spartina patens, and Distichlis spicata exists. Existing water depths within the basin area are estimated to be approximately -31. The applicant is proposing to excavate the existing basin (28' x 281), the marsh and sandy berm "plug" (28' wide x 14' long), and a 50' long x 28' wide area of Taylors Creek. Excavations propo-cred to be performed by drag line with clam shell bucket operated on the barge with the spoils also being placed on a barge. The northern end of the basin is proposed to be bulkheaded which will fill an approximately 3' wide x 28' long border of Spartina alterniflora, Spartina patens, and Distichlis spicata marsh. The applicant is also proposing to construct an approximately 97' long pier with associated tie-up pilings of which approximately 65' of structure wood extended into Taylors Creek itself. Taylors Creek is classified by the North Carolina Division of Environmental Management as "SC" waters and is closed to the harvesting of shellfish. 10. ANTICIPATED IMPACTS: The project as proposed will result in the excavation of approximately 326 sq. ft. of coastal wetland vegetation primarily consisting of Spartina alterniflora marsh. Additionally, approximately 1400 sq. ft. of bottom area of Taylors Creek will be excavated to a depth of -6' mean low water. Approximately 300 cubic yards of silty sand material will be excavated by this proposed project with the materials being placed on a spoils barge for future unloading at an undetermined site. Increased levels of turbidity and the sloughing off of adjacent wetlands vegetation areas can be expected from the dredging proposal. FIELD INVESTIGATION REPORT - CHARLES & ROSEMARY HAINES PAGE #3 An approximately 28 linear foot bulkhead is proposed to be placed waterward of the marsh fringe which would result in the filling in of approximately 84 sq. ft. of a mixture of Spartina alterniflora, Spartina patens, and Distichlis spicata marsh. A pier structure is also proposed to be constructed along the east side of the existing basin which would extend out into Taylors Creek for a distance of approximately 69 feet. It appears that this structure would not exceed the established pier head line in this area. A residence will be constructed on this property sometime in the future. Preliminary indications by the applicant is that the structure would be located outside the estuarine shoreline AEC. If the applicant is not claiming to be the owner of said property, then for- ward a copy of the deed or other instrument under which the owner claims title, plus written permis- sion from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on 8 t/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 16 high quality copies are provided by the applicant. (Contact the U.S. Army Corps of Engineers regard- ing that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency per- sonnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners. These individuals have 30 days in which to submit com- ments on the proposed project to the Division of Coastal Management. The applicant must advise the adjacent landowners of this opportunity by sen- ding a copy of the permit application to them by registered or certified mail. Project summary: The applicant is proposing to maintain an existing boat basin which has shoaled-in and construct a dock into Taylors Creek at a site off the Lennoxville Road (SR 1310) near the Town of Beaufort, Carteret County. NARRATIVE DESCRIPTION: The applicants property consists of an approximately 1.2 acre tract of land which is located on the south side of the Lennoxville Road (NCSR 1310) and adjacent to Taylors Creek, near the Town of Beaufort, Carteret County. The property is undeveloped and is characterized by having an upland area consisting of primarily oak trees with elevations of approximately 10' above mean sea level. Along the shoreline of Taylors Creek, the highground is separated from the water by an approximately 40' to 50' border of coastal wetlands which consist primarily of Spartina alterniflora marsh. Years ago, an approximately 28' wide x 45' long boat basin was excavated into this marsh area. Today, the mouth of the basin has filled in and has re-established itself with an approximately 4' to 5' border of Spartina alterniflora marsh on either side of an approximately 4' wide sandy berm area. Additionally, on the northern side of the basin an approximately 1' to 6' border of Spartina alterniflora, Spartina patens, and Distichlis spicata exists. Existing water depths within the basin area are estimated to be approximately -31. The applicant is proposing to excavate the existing basin (28' x 281), the marsh and sandy berm "plug" (28' wide x 14' long), and a 50' long x 28' wide area of Taylors Creek. Excavations proposed to be performed by drag line with clam shell bucket operated on the barge with the spoils also being placed on a barge. The northern end of the basin is proposed to be bulkheaded which will fill an approximately 3' wide x 28' long border of Spartina alterniflora, Spartina patens, and Distichlis spicata marsh. The applicant is also proposing to construct an approximately 97' long pier with associated tie-up pilings of which approximately 65' of structure wood extended into Taylors Creek itself. Taylors Creek is classified by the North Carolina Division of Environmental Management as "SC" waters and is closed to the harvesting of shellfish. 10. ANTICIPATED IMPACTS: The project as proposed will result in the excavation of approximately 326 sq. ft. of coastal wetland vegetation primarily consisting of Spartina alterniflora marsh. Additionally, approximately 1400 sq. ft. of bottom area of Taylors Creek will be excavated to a depth of -6' mean low water. Approximately 300 cubic yards of silty sand material will be excavated by this proposed project with the materials being placed on a spoils barge for future unloading at an undetermined site. Increased levels of turbidity and the sloughing off of adjacent wetlands vegetation areas can be expected from the dredging proposal. FIELD INVESTIGATION REPORT - CHARLES & ROSEMARY HAINES PAGE #3 An approximately 28 linear foot bulkhead is proposed to be placed waterward of the marsh fringe which would result in the filling in of approximately 84 sq. ft. of a mixture of Spartina alterniflora, Spartina patens, and Distichlis spicata marsh. A pier structure is also proposed to be constructed along the east side of the existing basin which would extend out into Taylors Creek for a distance of approximately 69 feet. It appears that this structure would not exceed the established pier head line in this area. A residence will be constructed on this property sometime in the future. Preliminary indications by the applicant is that the structure would be located outside the estuarine shoreline AEC.
