Grant Page 2 9. PROJECT DESCRIPTION The project is located on the North East Cape Fear River. The site was . formerly used by the general public as a boat launching area even though it was under private ownership. The river bank has experienced some erosion in the area of existing piling remains near the southeast corner of the property. The tract is approximately 4.3 acres in size. There is an existing concrete boat ramp located at the northeast corner of the tract. The waters are designated as "C" and the the area is a designated primary nursery area. Lanes Ferry Bridge is the upper unit of estuarine water on this river. The applicant proposes to stabilize the shoreline, to construct a deck and pier, to construct a residence/office and to develop 15 camping spaces. He will also install a package treatment plant and discharge to the river. The length of shoreline to be stabilized is approximately 75'. The alignment of the concrete cylinder rip-rap material is approximately 4' waterward of the mean high water contour (mhw). The applicant will construct a wooden walkway from the office towards the water. It will terminate in a wood deck approximately 20' x 10'. From this deck a 4' x 20' floating dock will extend out into the river and will terminate in a 4' x 40' "T". 10. ANTICIPATED IMPACTS Provided that the treatment plant is operated correctly no adverse impacts will result from the installation. The rip-rap wall will be installed within an unvegetated area. No significant impact will result if the structure is installed as proposed. Submitted by: C. Any violation of these terms may subject vermittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. The rip-rap must not exceed 4' below the mean high water contour. In order to ensure this requirement, the final alignment of the structure must be approved by DCM and Corps personnel prior to construction. 2) The final alignment of the pier must be approved by representatives of the Division of Coastal Management and Archives and History Underwater Archaeology Unit (458-9042, Kure Beach) in order to avoid submerged cultural artifacts. 3) The rip-rap material will be clean and free of any such pollutants except in trace quantities. Metal products, organic materials or debris will not be used. 4) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction- related discharge. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. NOTE: The waterward end of the effluent discharge line should be marked in accordance with the Uniform Waterway Marking system (as administered by the NC Wildlife Resources Commission) if it has any potential to impede navigation. NOTE: Permanent reflectors should be attached to the pier and dock structure in order to make it more visible during hours of darkness or inclement weather. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The riprap material will not be positioned farther than 4 feet waterward from the mean high water (MHW) elevation contour at any point along its alignment. b. The riprap material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials or debris will not be used. c. The authorized pier and associated activity will not cause an unacceptable interference with navigation. d. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this -2- permit. This form allows the adjacent* riparian landowner to express either: (1) that he objects to the project or, (2) that he does not object and desires to waive his right to the 30-day period so that the processing of the application can progress more rapidly.
