Dear Mr. Foster,
In accordance with your permit modification and renewal application package received on August
30, 2006 as well as the additional information received on September 20, 2006, we are forwarding
herewith a modified and renewed Permit No. WQ0012404, dated January 30, 2007, to CF Industries, Inc.
for the subject nitrogen -enriched ground water land application program.
This pen -nit shall be effective from the date of issuance until December 31, 2011; shall void
Permit No. WQ0012404, issued on January 10, 2003 and corrected on April 15, 2003; and shall be
subject to the conditions and limitations as specified therein. Make note of this permit's expiration date
and the fact that a permit renewal application is due to the Division of Water Quality (Division) no later
than six months prior to that date (i.e., see Condition VI. 7.), as the Division does not send reminders to
apply for permit renewal. Please note that Conditions 1.9 and III.2 are new conditions. Please also note
that the numbered order of several permit conditions has changed, and that the verbage has been changed
in Conditions I3,1.5,1.6,1.8, II.3,11.5, II.6,1I1.3, VI.1, VI.5, VI.7 & VI.9.
This permit approves the continued operation of the nitrogen -enriched ground water land
application program for another five-year cycle. As always, remember to take the time to review this
permit thoroughly, as some of the conditions contained therein may have been added, changed, or
deleted since the last issuance. Pay particular attention to the monitoring requirements in this permit.
Failure to establish an adequate system for collecting and maintaining the required operational
information will result in future compliance problems.
If any parts, requirements, and/or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within 30 days following receipt of this
permit. This request shall be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative Hearings at 6714 Mail Service
Center, Raleigh, North Carolina 27699-6714. Unless such demands are made, this permit shall be final
and binding,

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
continued operation of a nitrogen -enriched groundwater recovery system consisting of nine recovery wells
with a transfer pump station and a one million gallon storage basin with a groundwater transfer and
loading system with dual loading bays for the tanker trucks. The operation (hereafter considered the
"groundwater recovery facility"); and for the operation: of a nitrogen -enriched ground water land
application program consisting of the application of 14,000,000 gallons per year of nitrogen -enriched
ground water from the CF Nitrogen, Inc. site in Tunis, N.C. (hereafter considered the "groundwater
recovery site"), to approximately 4,382.7 acres of land in Bertie, Hertford, and North Hampton Counties
(hereafter considered the "land application sites") with no discharge of nitrogen -enriched groundwater to
the surface waters, pursuant to the modification/renewal land application program package received on
August 30, 2006, as well as the additional information received on September 20, 2006, and in conformity
with the project plan, specifications, and other supporting data subsequently filed and approved by the
Department of Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until December 31, 2011; shall void Permit
No. WQ0012404, issued on April 15, 2003; and shall be subject to the following specified conditions and
limitations:
I. PERFORMANCE STANDARDS
The Washington Regional Office, telephone number [phone], and the appropriate local
governmental official (county manager/city manager) shall be notified at least twenty-four
(24) hours prior to the initial application of the nitrogen -enriched ground water to a land
application site so that an inspection can be made of the land application site and application
method. Such notifications to the regional supervisor shall be made during the normal
business hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays. In addition, the Hertford County Manager's office must be notified prior to the
initial application so that they will be aware that the operation has commenced.

2. This permit shall become voidable if the soils at a land application site fail to adequately
assimilate the nitrogen -enriched ground water and may be rescinded unless the land
application sites are maintained and operated in a manner that will protect the assigned water
quality standards of the surface waters and ground waters.
3. The groundwater recovery facility and the land application sites shall be effectively
maintained and operated at all times so that there is no discharge of nitrogen -enriched
groundwater to the surface waters, nor any contamination of ground waters by nitrogen -
enriched ground water which will render them unsatisfactory for normal use. In the event that
the groundwater recovery facility or a land application site fail to perform satisfactorily,
including the creation of nuisance conditions or failure of the land application site to
adequately assimilate the nitrogen -enriched ground water, the Permittee shall cease applying
nitrogen -enriched groundwater to the land application site, contact the Aquifer Protection
Section of the appropriate Division of Water Quality's (Division) regional office, and take any
immediate corrective actions as may be required by the Division.
4. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to
surface waters or ground waters resulting from the operation of this program.
5. The following buffer zones shall be maintained at all times:
a. 200 feet from residences or places of public assembly under separate ownership for
surface application method; however, the buffer zone requirement may be reduced to a
minimum of 100 feet upon written consent of the owner and approval from the Aquifer
Protection Section of the appropriate Division's regional office in Attachment A of this
permit;
b. 50 feet from residences or places of public assembly under separate ownership for
subsurface application methods,
c. 100 feet from any public or private water supply source, waters classified as SA or SB,
and any Class I or Class H impounded reservoir used as a source of drinking water for
both methods;
d. 100 feet from any streams classified as WS or B, any other stream, canal, marsh or coastal
waters and any other lake or impoundment for surface application;
e. 50 feet from any streams classified as WS or B, any other stream, canal, marsh or coastal
waters and any other lake or impoundment for subsurface application;
f. 50 feet from property lines for surface application method;
g. 25 feet from property lines for subsurface application method,
h. 50 feet from public right of ways for both surface and subsurface application methods;
i. 10 feet from upslope interceptor drains and surface water diversions for both surface and
subsurface application methods; and
j. 25 feet from downslope interceptor drains, surface water diversions, groundwater drainage
systems, and surface drainage ditches for both surface and subsurface application methods.
Some of the buffers specified above may not have been included in previous permits for this
nitrogen -enriched ground water land application program. However, any land application sites
that are listed in the most recently -certified Attachment A of this permit, but were approved
with different buffers shall be reflagged to comply with these buffers.

6. A copy of this permit shall be maintained in all manned equipment at the land application site
when nitrogen -enriched ground water is being applied during the life of this permit. A spill
prevention and control plan shall be maintained in all nitrogen -enriched ground water
transport and application vehicles.
7. Specific nitrogen -enriched ground water application area boundaries shall be clearly marked
on each land application site prior to and during application on land application sites where a
fixed system is not being used.
No nitrogen -enriched ground water shall be stored at any land application site at any time,
unless written approval has first been requested and obtained from the Division. Temporary
storage in a 12,000 gallon tanker trailer at a specific land application site may be maintained
only during the application process.
Only the land application sites listed in the most recently -certified Attachment A of this permit
are approved for nitrogen -enriched ground water land application.
II. OPERATION AND MAINTENANCE REQUIREMENTS
1. The groundwater recovery facility and the land application sites shall be properly maintained
and operated at all times.
2. The use of existing spray irrigation equipment for application of the nitrogen -enriched ground
water is approved by this permit only if the following conditions are met prior to use:
a. The Plant Available Nitrogen (PAN) rates for the land application site's crops shall not be
exceeded,
b. The buffer requirements, as listed in this permit, shall be met,
c. A backflow prevention device shall be maintained, and
d. There shall be an air gap separation maintained whenever the nitrogen -enriched
groundwater is used in an existing irrigation system.
A suitable vegetative cover shall be maintained on land application sites onto which nitrogen -
enriched ground water is land applied in accordance with the crop management plan outlined by
the local Cooperative Extension Office, the Department of Agriculture and Consumer Services,
the Natural Resource Conservation Service, or other agronomist and as approved by the
Division.
4. Nitrogen -enriched ground water shall not be applied at rates greater than agronomic rates, unless
authorized by the Division. If the owner of the land application site has or will be applying
fertilizer during the crop rotation when nitrogen -enriched ground water is being applied, the
nutrients from the fertilizer shall be taken into account when determining loading rates for the
nitrogen -enriched ground water. At no time shall the agronomic rates for the specific crop be
exceeded by application of the nitrogen -enriched ground water, fertilizer applied by the farmer,
or a combination of nitrogen -enriched ground water and fertilizer.

Nitrogen -enriched ground water and other sources of PAN shall be land applied to all land
application sites at agronomic rates in accordance with the crop management plan outlined by
the local Cooperative Extension Office, the North Carolina Department of Agriculture and
Consumer Services, the Natural Resource Conservation Service, or other agronomist. Under no
circumstances shall the following PAN loading rates land applied to any site exceed the
following for the specified crops. These rates shall include any other fertilizer or waste source to
be applied to a site that includes nitrogen:
The Permittee shall apply for and receive a modification of this permit before land applying
nitrogen -enriched ground water on any land application site that is to be established in a crop
other than those listed above. A maximum PAN loading rate for the desired crop shall be
approved with the permit modification.
If the land application sites are to be overseeded (e.g., coastal bermuda grass in the summer
and rye grass in the winter with BOTH crops to receive nitrogen -enriched ground water), then
the second crop shall receive an application of PAN at a rate of no greater than 50 pounds per
acre per year. This practice shall be allowed as long as the second crop is to be harvested. If
the second crop is to be planted for erosion control only and is to be tilled into the soil, then no
nitrogen -enriched ground water shall be land applied to these sites because the PAN will
essentially be returned to the soil.

The Permittee shall apply for and receive a modification of this permit before land applying

6. Upon classification of the nitrogen -enriched ground water land application program by the
Water pollution Control System Operators Certification Commission (WPCSOCC), the
Permittee shall designate an appropriate certified operator to be in responsible charge (ORC)
of the nitrogen -enriched ground water recovery facility and the land application program. The
operator shall hold a certificate of the type and grade at least equivalent to or greater than the
classification assigned to the nitrogen -enriched groundwater recovery facility and the land
application program by the WPCSOCC. The Permittee shall also designate a certified back-up
operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G
.0202.
7. Adequate provisions shall be taken to prevent wind erosion and surface runoff from conveying
pollutants from the nitrogen -enriched ground waterland application sites onto adjacent
properties or into any surface waters.
Adequate procedures shall be provided to prevent surface runoff from carrying any land
applied or stored nitrogen -enriched ground water into any surface waters.
9. . For land application sites that are prone to flooding or within the 100 -year flood elevation,
nitrogen -enriched ground water shall be land applied only during periods of dry weather.
10. Nitrogen -enriched groundwater shall not be land applied during inclement weather or until 24
hours following a rainfall event of 0.5 -inch or greater in 24 hours. Any emergency nitrogen -
enriched ground water land application measures shall first be approved in writing by the
Division.
11. Nitrogen -enriched ground water shall not be land applied to any land application site that is
flooded, frozen, or snow-covered.
12. The freeboard in the storage basin shall be no less than two feet. If the freeboard becomes less
than two feet because of a significant rainfall event; the Permittee shall notify the Washington
Regional Office and promptly take action to return the freeboard to at least two feet. At no
time shall the storage basin be allowed to overflow.
III. MONITORNG AND REPORTING REQUIREMENTS
Any monitoring (i.e., including groundwater, surface water, soil, or plant tissue analyses)
deemed necessary by the Division to ensure protection of the environment shall be
established, and an acceptable sampling and reporting schedule shall be followed.
2. Analytical determinations made pursuant to the monitoring and reporting requirements of this
permit shall be made by a laboratory certified by the Division for the required parameter(s)
under 15A NCAC 2H .0800 or 15A NCAC 2H..1100. Field analyses are exempted from this
requirement.
Proper records shall be maintained by the Permittee tracking all application events. These
records shall include, but are not necessarily limited to, the following information:
a. date of nitrogen -enriched ground water application;
b. location ofnitrogen-enriched ground water application (site, field, or zone #);
c. method of application;

d. weather conditions (i.e., sunny, cloudy, raining, etc.);
e. soil conditions (i.e., dry, wet, frozen, etc.);
f. type of crop or crops to be grown on land application site;
g. volume of nitrogen -enriched ground water applied in gallons per acre;
h. continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings for each
land application site;
i. annual totals, for each land application site, of plant available nitrogen (PAN) from the
nitrogen -enriched ground water (lbs/acre); annual totals, for each land application site, of
Phosphorous applied from all sources (lbs/acre), fertilizers applied (other than from the
nitrogen -enriched ground water) (lbs. of PAN/acre); and annual totals, for each field, of
PAN from all sources.
4. A nitrogen -enriched ground water analysis program will be conducted from the date of permit
issuance by the Permittee and the results maintained on file by the Permittee for a minimum of
five years. The following program shall be conducted:
a. A nitrogen -enriched groundwater field analysis shall be completed every 25 trucks
(125,000 gallons). The analysis shall include the following parameters:
Ammonia -Nitrogen (NH3-N) Phosphorous
Nitrate -Nitrite Nitrogen
b. A nitrogen -enriched groundwater laboratory analysis shall be completed every 100
trucks (500,000 gallons). The analysis shall include the following parameters:
Nitrate -Nitrite Nitrogen TKN
Ammonia -Nitrogen (NI13-N)
c. A nitrogen -enriched groundwater laboratory analysis shall be completed every 90
days. The analysis shall include the following parameters:

d. Quarterly reports shall be submitted to the Aquifer Protection Supervisor of the
Washington Regional Office and shall include all monitoring results within the quarter.
This report shall include, but is not limited to, the following:
1. The land application sites used for land application per quarter,
2. the amount of nitrogen -enriched ground water applied per land application
site,
3. the nitrogen applied per land application site,
4. the total amount of nitrogen -enriched ground water recovered, and
5. the total amount of ground water and nitrogen recovered per year.
C.

In the event of four consecutive field tests and one laboratory test vary more than 20%,
the Monitoring schedules in Conditions a. and b. above will revert back to the
previously permitted monitoring schedule (i.e., a. A nitrogen -enriched groundwater field
analysis shall be completed every 10 trucks, and b. A nitrogen -enriched groundwater
laboratory analysis shall be completed every 100 trucks) until further notice by the
Division.
A Toxicity Characteristics Leaching Procedure (TCLP) analysis of the recovered ground
water in the storage basin shall
be conducted by the Permittee
once prior to permit application
submittal for reissuance.

7. Noncompliance Notification:
The Permittee shall report by telephone to the Aquifer Protection Section of the Division's
Washington Regional Office at telephone number [phone], as soon as possible, but in
no case more than 24 hours or on the next working day following the occurrence or first
knowledge of the occurrence of any of the following:
a. Any occurrence with the land application program that results in the land application of
significant amounts of nitrogen -enriched ground water which is abnormal in quantity or
characteristic.
b. Any failure of the land application program resulting in a release of nitrogen -enriched
ground water to receiving waters.

c. Any time that self-monitoring information indicates that the groundwater facility or land
application program has gone out of compliance with the conditions and limitations of this
permit or the parameters on which the program system was designed.
d. Any groundwater recovery facility failure, due to known or unknown reasons, that renders
the facility incapable of the facility's intended useage.
e. Any spillage or discharge from a vehicle or piping system transporting nitrogen -enriched
ground water to the application site.
Persons reporting such occurrences by telephone shall also file a written report in letter form
within five days following first knowledge of the occurrence. This report shall outline the
actions taken or proposed to be taken to ensure that the problem does not recur.
IV. GROUNDWATER REQUIREMENTS
Sampling Criteria Re uirements — Site 11:
a. The Permittee shall maintain the monitoring well system inside the slurry wall by
obtaining water level data from the 45 wells. The Permittee shall develop groundwater
contour map(s) of the system and map this data as groundwater contours. This is to be
sufficient in aerial extent and density to describe the general pattern of the water level
elevation. The map(s) shall include access and monitoring points.
b. The Permittee shall submit cross-sectional view maps by using water level data obtained
from. wells PO -11, PO -12, PI -2, and PO -236 to depict water levels across the slurry wall.
c. The data obtained in Condition la and lb above is to be gathered every February, May,
August, and November.
d. Three copies of the report of this data are to be submitted to the Division of Water
Quality, Aquifer Protection Section, Washington Regional Office (943 Washington
Square Mall, Washington, NC 27889) on or before the last day of the month following
that in which the data is collected.
2. Site Application Restrictions:
a. Each land application site identified with a GW -A in Attachment A of this permit is
dominated by soils with a mean seasonal high water table greater than three feet below the
land surface. The application of nitrogen -enriched ground water may occur on these sites
throughout the year.
b. Each land application site identified with a GW -B in Attachment A of this permit is
dominated by soils with a mean seasonal high water table between one and three feet
below the land surface. The application of nitrogen -enriched groundwater on these sites
shall be prohibited from December through March, inclusive. No nitrogen -enriched
ground water shall be land applied to these sites when the vertical separation between the
depth of application and the water table is less than three feet. The actual water table
depth for seasonally -restricted soils may be verified by soil borings within 24 hours prior
to any nitrogen -enriched ground water land application event that occurs from April
through November, inclusive. The number of borings advanced shall be sufficient to
characterize water table conditions across the land application site adequately. Any open
borings shall be properly tilled with native soil, prior to the nitrogen -enriched ground
water land application event, to decrease the chance of any nitrogen -enriched ground
water contaminating the ground water.

3. Applicable Boundary Requirements:
a. The COMPLIANCE BOUNDARY for nitrogen -enriched ground water Iand application
programs is specified by regulations in 15A NCAC 2L (i.e., "Groundwater Classifications
and Standards"). The Compliance Boundary for each land application site is established
at either 250 feet from the nitrogen -enriched ground water land application area or 50 feet
within the property boundary, whichever is closest to the nitrogen -enriched ground water
land application area. An exceedance of Groundwater Quality Standards at or beyond the
Compliance Boundary is subject to immediate remediation action according to 15A
NCAC 2L .0106 (d)(2).
b. The REVIEW BOUNDARY shall be established around each land application site
midway between the Compliance Boundary and the perimeter of the nitrogen -enriched
ground water land application area.. Any exceedance of Groundwater Quality Standards at
the Review Boundary shall require action in accordance with 15A NCAC 2L .0106 (d)(1).
4. Additional Requirements:
Any groundwater quality monitoring inside or outside the slurry wall containment area
(Site No. 11), or other land application sites, as deemed necessary by the Division, shall be
provided.
V. INSPECTIONS
1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure
proper operation of the groundwater storage, transport, and application facilities.
2. Prior to each nitrogen -enriched ground water land application event, the Permittee or his
designee shall inspect the nitrogen -enriched ground water storage, transport, and application
facilities to prevent malfunctions and deterioration, operator errors, and discharges that may
cause or lead to the release of wastes to the environment, a threat to human health, or a
nuisance. The Permittee shall maintain an inspection log or summary including at least the
date and time of inspection, observations made, and any maintenance, repairs, or corrective
actions taken by the Permittee. This log of inspections shall be maintained by the Permittee
for a period of five years from the date of the inspection and shall be made available to the
Division or other permitting authority, upon request.
3. Any duly authorized officer, employee, or representative of the Division may, upon
presentation of credentials, enter and inspect any property, premises, or place an or related to
the land application sites or facilities at any reasonable time for the purpose of determining
compliance with this permit; may inspect or copy any records that must be kept under the
terms and conditions of this permit; and may obtain samples of groundwater, surface water, or
leachate.
VT. GENERAL CONDITIONS
This permit shall become voidable unless the land application activities are carried out, and the
groundwater recovery facility is maintained, in accordance with the conditions of this permit,
the supporting materials, and in the manner approved by the Division.

2. This permit shall be effective only with respect to the nature and volume of the nitrogen -
enriched ground water described in the application and other supporting data.
This permit shall not be automatically transferable. In the event that there is a desire for the
groundwater recovery site to change ownership or to change the name of the Permittee, a
formal permit request shall be submitted to the Division accompanied by an application fee,
documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request shall be considered on its merits and may or may not
be approved.
4. The sites listed in Attachment A are approved sites for the application of nitrogen -enriched
ground water from CF Nitrogen, Inc., Tunis, NC site. Should CF Industries, Inc. wish to
modify this list of land application sites, a written formal request shall be completed and
include a soil scientist / agronomist report, land owner agreement forms, location map,
topographic map, buffer map, field data sheet and soil analysis report, This request shall be
sent to the Washington Regional Office, Aquifer Protection Section for their review and
approval prior to any land application on the additional sites.
Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division in accordance with North Carolina General
Statutes § 143-215.6A through § 143-215.6C.
6. The annual administering and compliance fee shall be paid by the Permittee within 30 days
after. being billed by the Division. Failure to pay the fee accordingly may cause the Division
to initiate action to revoke this permit, as specified by 15 NCAC 2T .0105 (e)(3).
7. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances that may be imposed by other government agencies
(i.e., local, state, and federal) which have jurisdiction, including, but not limited to, applicable
river buffer rules in 15A NCAC 2B .0200, soil erosion and sedimentation control requirements
in 15A NCAC Chapter 4 and under the Division's General Permit NCGO10000, and any
requirements pertaining to wetlands under 15A NCAC 2B .0200 and 15A NCAC .0500.
En order to extend this Permit, the Permittee, at least six months prior to the expiration of this
permit, shall request its extension. Upon receipt of the request, the Division shall review the
adequacy of the facilities and nitrogen -enriched ground water land application program
described therein, and if warranted, shall extend the permit for such period of time and under
such conditions and limitations as it may deem appropriate.
9. This permit may be modified, revoked, and/or reissued to incorporate any conditions,
limitations and monitoring requirements (including ground water, surface water, soil or plant
tissue analysis) the Division deems necessary in order to protect the environment and public
health adequately.

10. The Permittee shall not land apply nitrogen -enriched ground water to a land application site
unless the agreement between the Permittee and the Iandowner/lessee or operators of any land
application sites listed in the most recently -certified Attachment A of this permit not owned by
the Permittee are in full force and effect. These agreements shall be considered expired
concurrent with the expiration date of the permit and shall be renewed at the same time the
permit is renewed. Should a landowner or lessee terminate its agreement with the Permittee,
the Permittee shall submit a request to the Washington Regional Office, Aquifer Protection
Section, to remove the site from the list of sites on Attachment A.
