Gordon, for the construction and backfill of a bulkhead on Big Davis Canal, Long Beach, Brunswick County, North Carolina. Through coordination with Mr. C. Robert Stroud, Jr., of your Wilmington Office, we are aware that G&H's bulkhead alignment, as presently authorized, does not provide a sufficient setback distance for the installation of septic facilities making the lot unsuitable for the construction of a residence. We understand that an appeal is pending with your office to modify the permit. We have coordinated this question with the National Marine Fisheries Service. Concerns persist regarding the placement of fill material in any emergent wetland vegetation, but we will agree to the most restricted waterward alignment of the bulkhead which would provide the minimum required setback distance for installation of the septic facilities. An appeal requires resolution prior to work initiation or continuance, as the case may be. Project Summary The applicants propose to bulkhead the shoreline of their property in order to meet septic tank requirements. Two new lots would be created. G & J Investments Page 2 9. PROJECT DESCRIPTION The project is located on the north side of Big Davis Canal at the end of 28th Street SW in Long Beach. The site is the location of what was to be a racket club but which at the time of the first visit was deficient. The total tract site is approximately 209' x average of 139' (29,051 square feet). There is an existing structure at the western side of the property. A double tennis court surrounded by a fence was present on the center and east side of the lot at the time of the first visit. There was a severe erosion problem present along the shoreline near one corner of the property. Waterward of the shoreline there is a border of marsh which extends from the western corner across approximately two-thirds of the lot. This border measures from 0' to 19' wide. New marsh growth has begun in the location of the eroded area which apparently had not been present when State Permit #114-82 was issued. A general permit (2331-D) was also issued to construct a bulkhead on the property at or above the mean high water contour and landward of all marsh. After the time of application, the applicant began work on the property which was stopped and a minor permit was issued to compete the work. During this process the eroded area was filled. A silt fence was installed to prevent the deposition of material into the adjacent marsh on water. Also a portion of the bulkhead (approximately 112') was completed in front of the existing residence and adjacent property in accordance with the general permit. The adjacent waters are classified as SA open and are a secondary nursery area. By modified plans the applicant is now submitting a request to complete the bulkhead at the alignment necessary to provide a 100' setback from SA water for septic tank placement on what will become two lots. These septic tanks require approximately 1,280 square feet for a mound type system. Approximately 97 additional feet of bulkhead is proposed. Approximately 60' of this amount will extend up to approximately 10' waterward of the mean high water contour (mhw). The remainder will be approximately 0' to 2' waterward of mhw. Two residential structures will also be constructed. 10. ANTICIPATED IMPACTS The project will cause to be consumed approximately 300 square feet of medium height Spartina alterniflora marsh. This particular growth is an apparent result of a recently eroded portion of the high ground. This loss would be the result of the Health Department's requirement for a 100' separation. The loss could be minimized by transplanting the vegetation to nearby areas. The new structures would meet the 40' CAMA exemption set back for estuarine shorelines. Submitted by: C.
