There have been numerous owners since that time but re airs to the ND system have never been made due to continual and repetitive financial insolvency of each owner. This facili has an NPDES permit and th2y have been discharging under that permit since September 2004. Based on the histM of the site, anticipated limited buildup potential of the subdivision and rescission request by the current owner, it is higbly unlikely the site will ever have a functionally ND 5 5y tern. We have spoken with and secured consensus on this request from the third -party plant operator (James & James Environmental), the board of the affected POA, the operator presently leasing the golf course and other recognized industry professionals. This request is being made on behalf of the real property owners/developers, for whom Underwriter's Funding Group serves as asset manager. All are being copied on this request. This request is made subject to maintaining the present flow at .202mgd and conditioned upon all other factors and plant operations remaining as presently approved. Part and parcel to this request for rescission of the permit, we plan to make necessary upgrades to the WWTP, in addition to expansion as required to accommodate anticipated increases in demand resulting from further lot sales and home development activity.
