Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) In order to protect juvenile shrimp populations, no excavation or filling will be permitted between April 1 and August 31 of any year without prior approval of the Division of Coastal Management. 2) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining-:structures-to-prevent spill-over of -solids into any, marsh 'or surrounding waters: 3) An earthern plug will be leftbetween the area to be excavated and the existing canal and a 24 hour period after completion of the excavation will elapse prior to plug removal to prevent unnecessary siltation into the adjacent water body. 4) The spoil area will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any , maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. A new bulkhead will be built to stabilize the new basins. The project has been reviewed to determine impacts on water quality. The following comments are provided: 1. The project will require 401 Certification, but it should meet the conditions of a General 401 Certification for the construction of bulkheads. 2. Project summary The applicants are proposing to basins into their high ground property located in th x CAMA x sted 2 boat Subdiv. and adjacent to a man-made canal which enters Charles Creek near Sneads Ferry, Onslow County 9. Narrative description The project site consists of two residential lots located in the Twisted Oaks Subdivision, Onslow County. To find this site one would take Sea Bird Lane (dirt drive) off of SR 1521 and then turn onto Cedar Hollow Lane (dirt drive). The lots are each approximately 15,000 sq. ft. in size and have been developed with mobile homes. A gravel drive way along the common property line provides access to both lots. These lots border an approximately 40-60' wide man-made canal which enters Charles Creek with the shoreline of both of these lots having been previously bulkheaded. Charles Creek is classified by DEM as SA waters and has been designated by the Division of Marine Fisheries as primary nursery but are closed to the harvesting of shell fish. The water depths of the man-made canal are approximately -4' MLW. The applicants are requesting a permit to excavate two boat basins into their high ground property. The eastern most basin is to be approximately 32' long by 28' wide by -4' MLW deep with the western basin being approximately 32' long by 20' wide by -4' MLW deep. Additionally, an approximately 10' wide area in front of each basin will have to be excavated in order to reach the -4' MLW contour of the existing canal. The interior of each basin is to be bulkheaded with the spoils generated from the excavation project being placed and spread on adjacent yard areas. In the past several years there have been a number of upland boat basins permitted within this canal system. 10. Anticipated Impacts The project as proposed will result in the excavation of approximately 1536 sq. ft. of high ground property and the creation of two boat basin areas. Approximately 400 cu. yds of dirt material will be excavated and placed on adjacent high ground. Additionally, approximately 480 sq. ft. of canal bottom will be excavated with approximately 35 cu. yds of silty material being placed on adjacent high ground. Increased levels of turbidity can be expected from this project during the excavation process, but could be minimized if it was time to occur during periods of least biological activity.
