Dear Mr. Stroupe:
In accordance with your application received December 11,
1995 we are forwarding herewith Permit No. WQ0011819, dated
December 13, 1995, for the subject pump and haul operation.
This permit shall be effective from January 1, 1996 until
February 29, 1996 and shall be subject to the conditions and
limitations as specified therein. Please pay particular attention
to the monitoring requirements in this permit. Failure to
establish an adequate system for collecting and maintaining the
required operational information will result in future compliance
problems.
If any parts, requirements, or limitations contained in this
permit are unacceptable to you, you have the right to request an
adjudicatory hearing upon written request within 30 days
following receipt of this permit. This request must be in the
form of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Office of
Administrative Hearings, Post Office Box 11666, Raleigh, North
Carolina 27604. Unless such demands are made this permit shall
be final and binding.

In accordance with the provisions of Article 21 of Chapter
143, General Statutes of North Carolina as amended, and other
applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

Alexander County
5400 gpd pump and haul operation to serve the Oliver's Landing
Development with no discharge of wastes to the surface waters,
pursuant to the application received December 11, 1995 and in
conformity with the project plans, and other supporting data
subsequently filed and approved by the Department of Environment,
Health and Natural Resources and considered a part of this
permit.
This permit shall be effective from January 1, 1996 until
February 29, 1996 and shall be subject to the following specified
conditions and limitations:
1. This permit shall become voidable unless the subject pump
and haul activities are carried cut in a manner which has
been approved by this Division.
2. This permit is effective only with respect to the nature and
volume of wastes described in the application and other
supporting data.
3. The facilities shall be properly maintained and operated at
all times.
4. This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must
be submitted to the Division of Environmental Management
accompanied by an application fee, documentation from the
parties involved, and other supporting materials as may be
appropriate. The approval of this request will be
considered on its merits and may or may not be approved.
5. No type of wastewater other than that from the Oliver's

6. The permit shall become voidable unless the agreement
between Mr. Richard M. Stroupe, Hickory Septic Tank Service,
and the City of Hickory for the collect -ion, t .r anjportat ion

7. In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance
conditions, the Permittee shall cease operation of all pump
and haul activities and take such immediate corrective
action as may be required by this Division.
8. This pump and haul permit shall not be renewed.
9. The sewage and wastewater collected by this system shall be
treated in the City of Hickory's Northeast WWTP prior to
being discharged into the receiving stream.
10. The Mooresville Regional office, telephone number 704/663-
1699, shall be notified at least forty-eight (48) hours in
advance of the operation of the pump and haul activities so
that an in --place inspection can be made. Such notification
to the regional supervisor shall be made during the normal
office hours from 8:00 a.m. until 5:00 p.m. on Monday
through Friday, excluding State Holidays.
11. The Permittee is Liable for any damages caused by a spill or
failure of the pump and haul operations.
12. Adequate inspection, maintenance, and cleaning shall be
provided by the Permittee to insure proper operation of the
subject facilities.
13. The Permittee or his designee shall routinely inspect the
wastewater collection facilities to prevent malfunctions and
deterioration, operator errors and discharges which may
cause or lead to the release of wastes to the environment, a
threat to human health, or a nuisance. The Permittee shall
keep an inspection log or summary including at least the
date and time of inspection, observations made, and any
maintenance, repairs, or corrective actions taken by the
Permittee. This log of inspections shall be maintained by
the Permittee for as long as the pump and haul activities
are being conducted and shall be made available upon request
to the Division of Environmental Management or other
permitting authority.
14. Any duly authorized officer, employee, or representative of
Division of Environmental Management may, upon
presentation of credentials, enter and inspect any property,
premises or place on or related to the wastewater collection
facilities at any reasonable time for the purpose of .
determining compliance with this permit; may inspect or copy
any records that must be kept under the tarns and conditions

15. An accurate record of the monthly pump and haul activities
must ;,e maintained by the Permittee, indicating:
a. date wastewater is removed from the facility,
b. name of facility from which wastewater is removed,
C. name of facility receiving wastewater, and
d. volume of wastewater removed, and
e. status of permanent disposal option.
These records shall be submitted to the Mooresville
Regional Office on or before the fifteenth (15) day of
the following month (beginning February 15, 1996).
16. Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to an enforcement
action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-21.5.6.
17. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other
government agencies (local, state, and federal) which have
jurisdiction.
18. The Permittee shall provide for the installation and
maintenance of an audible and visual high water alarm.
19. A leakage test shall be performed on the septic tank and
dosing tank to insure that any exfiltration occurs at a rate
which does not exceed twenty (20) gallons per twenty-four
(24) hours per 1,000 gallons of tank capacity.
20. A copy of the facility plans shall be maintained on file by
the Permittee for the life of the project.
21. Noncompliance Notification:
The Permittee shall report by telephone to the
Mooresville Regional Office, at telephone number 704/663-
1699, as soon as possible, but in no case more than 24 hours
or on the next working day following the occurrence or first
knowledge of the occurrence of any of the following:
a. Any process unit failure, due to known or unkncwn

failures of pumps, aerators, compressors, etc.
b. Any failure of a pumping station, sewer line, etc.

also file a written report in letter form within 15
days following first knowledge of the occurrence. This
report must outline the actions taken or proposed to be
taken to ensure that the problem does not recur.

Oliver's Landing Development
Pump and Haul
Alexander County
This Office is in receipt of a Permit application from Mr.
Richard M. Stroupe, Partner, Larrick Development Company to pump
and haul domestic wastewater from the Oliver's Landing
Development in Alexander County. Mr. Stroupe indicated in his
application that he had been assured by Alexander County that
sewer service was to be available to serve the subject
development on or before the Spring of 1995. Delays experienced
by the County, however, pushed the anticipated completion date to
February 15, 1996. Mr. Stroupe has applied for another P&H Permit
that will provide sufficient time for completion of the sewer
line as well as allow recently constructed dwellings within the
development to be occupied. A review of Mr. Stroupe's request has
been performed and it is recommended that a P&H Permit be issued.
The wastewater will be pumped from a 2000 gallon pump tank that
will include an audible and visual alarm system.
