Dear Dr. Dorman:
Reference your application for a Department of the Army permit
to excavate a basin, construct and backfill a bulkhead, place
riprap material and construct boat docks on Shinn Point Canal off
the Atlantic Intracoastal Waterway (AIWW), Myrtle Grove Sound,
near Wrightsville Beach, New Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This permit, issued on °7is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) All excavated material will be confined on adjacent high ground landward
of any waters or wetland areas. All offsite disposal areas will be approved
by the Corps of Engineers and/or the N. C. Division of Coastal Management
prior to construction.
(2) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between April 1 and September 30 of any year without the
prior approval of the Division of Coastal Management.
(3) An earthen plug will be left between the area to be excavated and the existing
canal and a 24-hour period after completion of the excavation will elapse
prior to plug removal to prevent unnecessary siltation into the adjacent
water body.
(4) No excavated material will be stockpiled, even temporarily, in waters or
wetlands outside of the authorized channel alignment.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1987
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(5) Equipment working from or crossing marsh areas will be supported by mats.
(6) The authorized bulkhead along the east side of the basin will be free standing
and will allow unobstructed tidal interchange between the basin and adjacent
marsh wetlands.
(7) In order to minimize the effects of erosion on the access channel, a retaining
wall must be constructed on the east side along the entire length of the
channel cut. This structure should be constructed to allow for interchange
of water by providing spaces along its length.
(8) The area of high ground graded to marsh elevation will be increased to equal
that of the marsh to be excavated as shown on the enlosed plan. This miti-
gation area will be sprigged with Spartina alterniflora and will be inspected
and approved by a representative of- the Corps of ringineers and/or the N.
C. Division of Coastal Management.

MEMORANDUM
The applicant is proposing to excavate a basin to accommodate 4
boats and to construct a bulkhead and fill 6600 square feet of
coastal wetland. The applicant also proposes to protect the
perimeter of the bulkhead with rip-rap. The project is located
at Shinn Point Canal, classified SA and closed to shellfishing.
The project has been reviewed to determine impacts to water
quality. The following comments are offered:
1. The project requires 401 Certification but should meet the
requirements for the General 401 Certifications for bulkhead
construction and for the placement of rip-rap.
2. After completion of the project, the marsh area, excluding
behind the bulkhead, should be restored in the case where
spoils spillage and traffic have altered the wetlands.
3. The project should be done in such a way as to minimize the
turbidity outside the area of construction. Turbidity must
not exceed 25 NTU outside the project area.

9. PROJECT DESCRIPTION
The proposed project is to be located on the south side of an existing
man-made canal serving Shinn Point Subdivision. The project area is populated
with sea ox-eye, Suaeda M and salt wort. A portion of the site is a salt
bald adjacent to the canal. The excavation of the general area of the project
has been authorized by two State and Federal permits in the recent past. The
first of these was State Permit # 145-77 issued to Hershel Rogers. The other
was State Permit #66-84 issued to Julian K. Taylor III. Both of these permits
involved an entrance canal off the existing canal at approximately the location
of the proposed project. Neither permit was excavated. The waters are
classified as SA closed and are designated primary nursery area. The
bulkhead site is a mixed 11404", coastal wetland area including ox-eye, salt
wort, black needlerush.
The present applicant proposes to excavate a boat basin with access walkway
and dock and pier. He also indicates plans to construct a bulkhead. The
basin will be approximately 56' long x 30' wide x -6' mean low water (mlw). It
will connect directly through the bank to the existing canal. The edge of the
cut will be rip-raped. The access walkway will be approximately 165' long.
The dock will be approximately 50' in length. Two 22' finger piers will
accommodate 4 boats. At present the access pier and dock are located closer
than 15' from the adjacent property. The bulkhead is proposed to be
approximately 220' long. It is proposed along the alignment which was the wall
of a proposed basin of permit 66-84. Approximately 490 cubic yards of
material will be excavated by barge mounted equipment and will be placed on
the applicants high ground property. The applicant has stated that the high
ground will be developed at a later time.
10. ANTICIPATED IMPACTS
The growth of wetlands within the basin project appears to have been
significantly affected by the existing canal. The excavation of this general
area with additional wetlands incorporated into former projects was authorized
by two former permits. No significant loss of resource is anticipated,
however, the final alignment of the basin could be staked to minimize the loss.
The current plans show that the proposed access pier and dock system are too
close to the adjacent property. Some concern has been expressed by the
adjacent property owners regarding this point. The proposed bulkhead is
aligned through an area in which another recently proposed bulkhead with fill
was denied. The structure which was permitted in this general area by
permit 6-84 was the outer wall of the permitted basin. The final alignment of
the new structure should be determined by DCM and Corps personnel in order
to be consistent with current "404" guidelines. The development of the high
ground must be handled by permit modification.

ADJACENT RIPARIAN LANDOWNERS STATEMENT
General Statute 113-229 requires that riparian landowners with property
adjoining a proposed excavation and/or fill project be given thirty (30) days in
which to comment on the project. This form allows the adjacent riparian land-
owner to express either: (1) that he objects to the project or, (2) that he does

Reference the application of Dr. Bruce H. Dorman for a
Department of the Army permit to maintain the Shinn Point small
boat canal off the Atlantic Intracoastal Waterway (AIWW), Myrtle
Grove Sound, near Wrightsville Beach, New Hanover County, North
Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. In order to protect juvenile shrimp, no excavation or
filling will be permitted between the dates of April 1 and
September 30 of any year without the prior approval of the North
Carolina Division of Coastal Management.
b. All excavated materials will be confined landward of the
mean high water (MHW) elevation contour within adequate dikes or
other retaining structures to prevent spillover of solids into any
vegetated wetlands or surrounding waters.
c. The terminal end of the pipeline from the dredge into the
diked retention area will be positioned at or greater than 50 feet
from any part of the dike and at a maximum distance from spillways

to prevent dike erosion and to allow adequate settlement of
suspended solids.
d. A water control structure will be installed at the intake
end of the effluent pipe leading from the retention area in order
to ensure maximum settlement of suspended solids.
e. Flow from the diked retention area will be confined by
pipe, trough, or similar device to a point at or below the *mean
low water (MLW) elevation contour to prevent gully erosion and
resultant unnecessary siltation.
f. No excavated or fill materials will be placed at any time
in any vegetated wetlands or waters of the State.
g. Vegetated wetlands will not be excavated or filled.
h. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).
i. The temporary placement or double handling of excavated or
fill materials within waters or vegetated wetlands is not
authorized.
j. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.
k. At least 2 weeks prior to any maintenance excavation, the
permittee will contact both the Corps of Engineers and the North
Carolina Division of Coastal Management to inform them regarding
the location of the excavated material retention area. Such area
will be inspected and approved prior to the commencement of any
work.
1. Prior to the use of any area within the Corps of
Engineers' Atlantic Intracoastal Waterway (AIWW) right-of-way for
the retention of excavated material, the permittee will obtain
specific, written authorization from the Navigation Branch,
Wilmington District, Corps of Engineers, (919) 343-4824.

backfill a bulkhead, place riprap material and construct boat
docks on Shinn Point Canal off the Atlantic Intracoastal Waterway
(AIWW), Myrtle Grove Sound, near Wrightsville Beach, New Hanover
County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
The National Marine Fisheries Service, by letter of June 9, 1987
(copy enclosed), found the proposal to be detrimental to fishery
resources and recommended that authorization not be provided
unless the basin is relocated so as to be sited completely within
high ground. We concur with this recommendation, not only because
of the projected loss of the approximate 0.18 acre of wetland
vegetation to excavation and the placement of fill; but also, a
community boat ramp is available for the property owners to
exercise their right of riparian access.

9. PROJECT DESCRIPTION
The project is an existing man-made canal system which is connected to the
AIWW at the east end and makes several looping turns first through the edge
of an old spoil disposal area (now developed) and across a drainage easement
with associated marsh and coastal wetlands and ending in a bulbous cul-de-sac
into high ground. There has been low to moderate development along the
shoreline of the canal. The project was permitted in 1975 with some
maintenance renewals in the interim. The permit is now expired. The
dimensions of the canal are approximately 2450' long x 60' x -6' mlw. Some
shoaling has occurred at the mouth of the canal and at the upper end in the
cul-de-sac. The waters are classified as SA closed and the area is' a
designated primary nursery.
The applicant proposes to initially maintain the north and the upper end by
excavating approximately 200-400 yards of material. It is anticipated that
approximately 25% of the canal may need annual maintenance of approximately
1000 cubic yards per operation. This spoil would be placed as an existing
high ground lot within the subdivision initially. Permanent disposal areas have
not been fully identified. However, the use of two Corps disposal sites ideally
situated east of the project site across the AIWW has been recently clouded by
Corps action concerning the use of all these areas. At present the applicant
proposes to utilize contractors with barge mounted excavation equipment which
can off-load the excavated material to high ground.
10. ANTICIPATED IMPACTS
The maintenance of the existing canal with cause short term turbidity and
sedimentation problems. The location of the spoil disposal area shown on plat
pages 1 of 2 may not be available on a long term basis. The use of barge
mounted equipment will greatly facilitate the operation if done on a regular
basis. The large size and close proximity of the Corps spoil disposal to the
site would accommodate the project is permission is still available. The lack
of recent maintenance activity in this system may indicate that no problem will
occur. Past water quality studies in the canal indicate that litter or no
degredation has occurred in it since the original excavation.

Carolina. Your receipt of this letter verifies your acceptance of
a valid request for certification in accordance with Section
325.2(b)(ii) of our.administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by November 24, 1986, the District
Engineer will deem that waiver has occurred.

Gentlemen:
It is requested that an NCDNRCD (CAMA) Permit be issued to construct a small
boat basin on the existing Shinn Point Canal (New Hanover County) in accord-
ance with the attached permit application and supporting sketches. This
small, four-boat basin would replace and be in lieu of the access canal
and larger boat basin previously authorized to Mr. Julian K. Taylor under
NCDNRCD Permit #66-84 and USAED/Wilmington Permit #SAWCO 84-N-065-0033.
The undersigned is now the sole owner of the properties for which the
above referenced permits were issued.
It is now proposed to construct a small four-boat basin immediately adjacent
to the Shinn Point Canal as shown on the permit sketch. The basin will be
56 feet long, 30 feet wide, with excavation to a depth of minus 6 feet MLW.
The basin banks will be side sloped and protected by stone riprap on all
three sides similar to the riprap presently in place along most of the ex-
isting canal system. The basin will be moved 6 feet downstream (eastward)
from the terminal of the existing timber bulkhead in order to protect and
not interfere with that existing structure. Mooring space within the basin
will be provided for four small boats to be secured and serviced by mooring
piles, access ramps and short floating dock sections as shown on the.sketch.
Overall access from the properties (single family development lots) will be
provided by a 4-foot wide elevated catwalk, also as shown on the plan view
and basin sketch. This access walk will be constructed on the shoulder of
high ground except for the approximately 40-foot section which will be
constructed over the marsh flats at the head of the boat basin.
The boat basin will be constructed by clamshell bucket and/or backhoe work-
ing from timber mats on the adjacent high tide marsh flats beside the basin.
This material (primarily an approximate 2-foot thick organic marsh soil underlain
by clean sand) will be transported the short distance (150 to 200 feet) by light
truck for placement adjacent to the high ground wooded area that fronts the
tidal marsh flat (see sketch). Haul vehicle traffic will be confined to the
high ground shoulder adjacent to the existing bulkhead and/or supported on
timber mats where the tidal marsh fringe may be encountered. The excavated
materials will be placed behind a low 4-foot high timber bulkhead to be

constructed across the property front at a variable but maximum distance
from high.eround of 30 feet to anchor on high ground shoulders that flank
both the north and south boundaries of the property. The alignment of
this low bulkhead will follow the stake line established by permitting
authority field agents at the time the above referenced permits were
granted for construction of the access channel and large boat basin
authorized therein (the location and alignment of this bulkhead will
again be confirmed by permitting agency representatives prior to commence-
ment of contruction). The material excavated from the boat basin
(approximately 490 cubic yards) can easily be accomodated in the area
behind the low bulkhead and the high ground property fringe.
The high tidal marsh flats in the proposed new boat basin area are
vegetated primarily by Salicornia with occasional sprigs of dwarf spartina
marshgrass. The high tidal marsh flat area to be confined behind the pro-
posed new buldhead is vegetated by sparse marsh type communities, including
Salicornia, coastal bermuda, scrub yaupon, etc. It is also pointed out
that the existing permit,(referenced above) authorized alteration of about
6,350 square feet of the same high tidal marsh area indicated in this
present application. This permit request encompasses only 1,680 square feet for
the boat basin and about 3,900 square feet behind the proposed bulkhead
and adjacent high ground. Thus, it appears that less area will be disturbed
by this proposal than was the case with the earlier authorized permit. No
work under this request is proposed to be done until early fall.
