Dear Colonel Woodbury:
In keeping with your request, this office has circulated to interested
state review agencies U. S. Army Corps of Engineers Public Notice .... 0295
dated April 30, 1987 which describes a project proposal by Cook Industries of
Greensboro. The project, involving the placement of excavated and fill
material, including riprap, in waters of the United States for the purpose of
increasing the size of a head race serving a hydroelectric facility, is
located on the Deep River, 5 miles east of Robbins on Highway 22 in Moore
County.
Based on a coordinated agency review, the state interposes no objection
to the project. However, important comments were submitted by cooperating
agencies. These comments and the agency submitting each follow: Division of
Archives and History - in its memorandum of May 29 did not recommend an
archaeological investigation but did request more general information on the
site. This office had no information to comply with the request; Division of
Parks and Recreation - would remind the permit-letting authority of the
presence of a "federally proposed" endangered species, the Cape Fear Shiner
(Notropis mekistocholas). It is, therefore, strongly recommended that special
emphasis be placed on the minimization of siltation during project
construction; Division of Land Resources - finds that a permit under the Dam
Safety Law of 1967 may be necessary. The applicant should be informed that if
the subject dam is 15 feet or greater in height, a permit will be required.
To obtain a permit, plans and specifications should be prepared by an
engineer, legally qualified to practice in North Carolina. This information
(5 copies) should be submitted to the following: Mr. Jim Simmons, Dam Safety
Engineer, Land Quality Section, NRCD, P. 0. Box 27687, Raleigh, N.C. 27611;
Division of Environmental Management on June 9, 1987 issued Water Quality
Certification No. 2084 for the proposed project.

Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to Cook Industries, Inc.
pursuant to an application filed on the 21st day of April, 1987 to
construct dike structures associated with modifications to the head race
at a hydroelectric facility.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Deep River e
in conjunction with the proposed dikes in Moore County will not result
in a violation of applicable Water Quality Standards and discharge
guidelines. Therefore, the State of North Carolina certifies that this
activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500
and PL 95-217 if conducted in accordance with the application and
conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant).
2. That appropriate sedimentation and erosion control
measures shall be employed to minimize turbidity
and siltation from the project.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

PUBLIC NOTICE
COOK INDUSTRIES, INCORPORATED, 4701 High Point Road, Greensboro, North
AND PLACE EXCAVATED AND FILL MATERIALS IN THE WATERS/WETLANDS OF DEEP RIVER,
ASSOCIATED WITH INCREASING THE SIZE OF A HEAD RACE SERVING AN EXISTING
HYDROELECTRIC FACILITY, 5 MILES EAST OF ROBBINS ON NORTH CAROLINA HIGHWAY 22,
Moore County, North Carolina.
The following description of the work is taken from data provided by the
applicant. Plans submitted with the application show the proposed excavation
and placement of excavated and fill material, earthen material and riprap, to
widen a head race canal. An earthen wall, or dike, is planned to be
constructed to incorporate an island into the boundary of the head race.
Approximately 0.35 acre of waters is proposed to be filled to establish the
dike. The purpose of the work is to improve the operational function of the
head race canal for the commercial hydroelectric facility. Plans showing the
work are included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the,Army permit will be issued until the. coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application: Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District

Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge that would be
authori.zed by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306 and 307 of the Clean
Water ACt. The applicatioin and this public notice for the Department of the
Army permit serve as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.

Enclosed is the application of Cook Industries, Incorporated,
represented by Mr. George S. Cook, for a Department of the Army
permit and a State Water Quality Certification to place fill
material in waters/wetlands of Deep River associated with
operation of the High Falls Hydroelectric project, No. 7987, near
Robbins, in Moore County, North Carolina. Your receipt of this
letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by June 18, 1987, the District Engineer
will deem that waiver has occurred.

Please find enclosed a drawing of our plans to widen the canal at High
Falls. As we discussed over the phone, the canal side of the Island is silted
and has water on that side only during flood or high water conditions. We
plan to connect from the dam to the Island with a concrete wall. That wall
will contain a gate to be used for minimum releases. The gate will be approx-
imately 3 ft. by 4 ft. tall and adjustable. We plan to connect to the down
river end of the Island and then reconnect to the canal approximately 100 ft.
from the power house. The trash racks will be extended as in the drawing
(approximately triple the length now) and one or more new head gates added
to dramaticaly reduce the volicity through the racks and in the canal. This
rearrangement of canal walls will help greatly in reducing volicities to
protect and preserve fish and aquatic habitat. Please comment on this as
soon as possible so that construction may begin shortly.

Gentlemen,
Cook Industries,Inc. is currently applying to the Federal Energy
Regulatory Commission for a license exemption under order 106
North Carolina.
The High Falls Dam was built in the early 1900's as a part of a
mill operation. It is approximately 700 feet long and 9 feet tall.
A 500 feet mill race leads to the ruins of the old turbine sight.
The turbine sight has fallen down and washed away. No buildings
still exist on this tract.
Development plans include installation of appropriate turbines and
new generators installed in the mill race area. The project will
be operated in a run of the river mode with no reservoir,drawdowns.
Notification and corment request from your agency are part•of the
license exemption application process. A location map of the area
has been attached for your use.

Dear Mr. Cook:
This is in reply to your letter of August 24, 1983,
requesting the Corps of Engineers to comment on your plans to
apply to the Federal Energy Regulatory Commission (FERC) for a
license exemption for the High Falls Hydroelectric project

This project should not adversely impact on the navigation
or flood control management responsibilities of the Corps of
Engineers. However, if any of your construction alternatives
A__A,.-A fill marerial into the waters
or adjacent wetlands of the Deep River, you may
obtain a permit to satisfy requirements of Section 404 of the
Clean (dater Act.
You should also be advised that the Corps of Engineers is
prepared for a new construction start on the Randleman Lake
project, subject to congressional funding. This project will be
located on the Deep River approximately 42 miles upstream of your
project and may substantially alter the flow regime at your
proposed project. Randleman Reservoir will be a multipurpose
project which will include storage for both flood control and
conservation purposes. The conservation storage is principally
dedicated to water.supply, and the demand for this storage is
expected to fully develop within the first 20 to 25 years of the
project life. If existing effluent disposal patterns continue,
the bulk of these water supply withdrawals would be permanently
lost from the Deep River Basin since the effluent from Greensboro
as well as a portion from High Point is discharged into adjacent
watersheds.

Although I do not anticipate any objections to your
proposal, it should be emphasized that these comments are
preliminary, and the Corps' final judgment will be made to FERC
based on your application submittal to that agency.
