Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 50 NTU's or less are not considered significant). 2. That appropriate sedimentation and erosion control measures shall be employed to minimize turbidity and siltation impacts from the project. Violations of any condition herein set forth shall result in revocation of this Certification. State Water Quality Certification in accordance with Section 401 of the Federal Clean Water Act. Based on the review of the proposal to remove and place dredged and fill material below ordinary high water into Little Briar & Strrip Iron Creeks, class "C" waters of this State, it is recommended the certification include a condition that the activities not cause the downstream turbidity to increase in excess of 50 NTU and appropriate erosion control measures be taken to limit any impact on the waters. SAWC087-N-032-0177 January 22, 1987 PUBLIC NOTICE FRANK COLEMAN AND ASSOCIATES, 4101 North Boulevard, Suite D, Raleigh, North Carolina 27604, has applied for a Department of the Army permit TO PLACE FILL MATERIAL IN LITTLE BRIAR CREEK AND STIRRIP IRON CREEK TO EFFECT CONSTRUCTION OF A SECTION OF SOUTHERN PARKWAY-IN DURHAM, Durham County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed construction of six crossings of creeks and/or adjacent wetlands during construction of the four-lane divided highway from Miami Boulevard (S.R. 1959) in Durham to U.S. 70 in Wake County. The typical roadbed will include a top width of 120 feet, two 24-foot-wide paved lanes, and fill side slopes of 2:1. Site "1-C" involves the discharge of 710 cubic yards of fill material below ordinary high water (OHW) into Little Briar Creek and its adjacent wooded wetlands. A total of 0.78 acre of water and wetlands will be filled during construction of the 175-foot-long, 200-foot-wide fill causeway through the area. The creek will be relocated into 235-foot-long, 9 by 8 reinforced concrete box culverts (2) through the fill, and carried by an 18-foot-wide, 90-foot-long tail ditch from the fill to the original streambed. The second site'(No. 2 on plans) will require the placement of 650 cubic yards of fill below OHW into approximately 800 linear feet of an unnamed tributary to Little Briar Creek. The stream will be relocated into an approximately 400-foot-long, 6-foot-wide riprap channel immediately north of the fill and then carried through the fill by a 260-foot-long, 72-inch reinforced concrete pipe. High ground occurs to either side of the stream along the length of this worksite. Construction at Site 3 will involve the placement of 2,400 cubic yards of fill below OHW in an unnamed tributary to Little Briar Creek and its adjacent wetlands. The present stream, ill-defined and draining through a previously disturbed wooded wetland, is to be relocated into 176-foot-long, 54-inch concrete pipes (2). As proposed, approximately 0.77 acre of wetlands will be filled during construction of the 180-foot-wide, 170-foot-long crossing. The work at Site 4 will involve construction of an additional two lanes immediately north of an existing roadbed over an unnamed tributary to Stirrip Iron Creek. Approximately 350 cubic yards of upland fill will be placed below -2- OHW in the stream and its adjacent wetlands during construction of the 55- foot-wide, 60-foot-long crossing. The stream is to be relocated into an approximately 135-foot-long, 10-foot-wide channel and then carried through the fill by 73-inch by 55-inch (2) concrete pipe arches. The existing road crossing at Site 4 was accomplished under authorization of a nationwide permit in our regulations (33 CFR 330.5). The crossing at Site 5 will involve the discharge of 6,400 cubic yards of fill material into 0.87 acre of wooded wetlands on a tributary to Stirrip Iron Creek. The wetland crossing, approximately 180 feet wide and 190 feet long, will include 172-foot-long, 72-inch pipes (3) to carry flows through the fill. Fifty cubic yards of soil are to be excavated immediately upstream of the fill to provide for improved flow into the pipes. In addition, 140 tons of riprap are to be placed in the stream and its adjacent wetlands immediately downstream of the fill for stabilization. Construction at Site 6 will require relocation of approximately 200 feet of stream off Stirrip Iron Creek into 180 linear feet of 8-foot by 9-foot box culverts (2). Riprap is to be placed in the streambed for a distance of 100 feet downstream of the fill. High ground occurs along both streambanks the length of this worksite. The purpose of the proposed work is to provide for construction of a multi-lane highway facility to serve the public and planned area development. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. y 1 w -3- The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and. accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. Therefore, if your office has not acted on the request by March 16, 1987, the District Engineer will deem that waiver has occurred. Army Corps of Engineers Public Notice SAWC087-N-032-0177 dated January 22, 1987 describing a project proposal by Mr. Frank. Coleman and Associates of Raleigh. The project, involving the placement of fill material and culverts in wetlands at several stream crossings for the purpose of constructing a new highway section known as Southern Parkway, is located in Durham and Wake Counties. The project runs between Miami Boulevard in Durham to Highway 70 in Wake County. It is the finding of the Department of Natural Resources that the project is in the public interest. The Department, therefore, interposes no objection to the alignment of the Southern Parkway provided that reasonable mitigation and environmental safeguards are followed during construction. It is requested that the following recommendations that were submitted by cooperating state agencies be made a part of the Federal permit: 1) the amount of wetlands impacted by the project be created under a 2 for 1 mitigation program; 2) all culverts be set below grade so as to provide for fish passage and so that culverts bottoms will develop an approximation of an natural substrate; 3) avoid widening and straightening streams above and below culverts so that there is no loss of stream length and so that stream sinuosity and roughness coefficient is maintained. Goldstein & Associates 1 1 1 1. CULVERTS. Culverts along the six stream crossings of Southern Parkway will be emplaced below grade to facilitate fish passage during normal water flow, to function as pools during periods of low flow, and to avoid altering current velocity upstream, downstream, or within the structure. Culvert bottoms may be roughened at a future date, if hydrologic conditions demand, and if required by U.S. Fish & Wildlife Service, to maintain stream flow without downstream erosion and to facilitate attachment and growth of invertebrate animals (Guidelines for Mountain Stream Relocations in North Carolina, Wingate et al., N.C. Wildlife Resources Commission, 1979, 11 p.). 2. WETLANDS. The landowners will donate acreage for new wetland and new streambed habitat within those wetlands. The North Carolina Department of Transportation will provide funds and/or labor necessary to meet project objectives. Wetland creation and stream habitat replacement is based on the development of two parcels, one on each principal drainage. The first parcel is located south of the proposed Southern Parkway, between stations 2 and 1A of the environmental assessment, on the Little Brier Creek drainage. The Little Brier Creek parcel contains a total of 2.2 acres adjacent to the north side of existing wetland. The second site is south of station 6 on the Stirrup Iron Creek drainage, and occupies 1.5 acres adjacent to the west side of existing wetland. The same procedure will be followed at each site. Capped water table monitoring wells, punched with post-hole diggers and piped with PVC tubes, will be installed at appropriate intervals along the lower portions of the sites, adjacent to existing wetlands. The wells will be periodically inspected to determine the seasonal location and degree of variation of the water table. That information will be used to assure that grading is conducted when the water table is low and labor costs will be minimal, and to assure that the table is high during the critical (fall or winter) planting period. Grading surveys will be conducted for horizontal and vertical grading control at each site. Excavation will extend below the average water table by 2', after which the -1- 3. STREAMBEDS. New streambed habitat will be created to replace streambed habitat taken by culverts and by diversion. These new streambeds will be emplaced on wetland created for the Stirrup Iron Creek drainage and that created for the Little Brier Creek drainage. 1 In order to divert flow to newly created streambed channels, existing streambed channels located on adjacent wetlands will be blocked off with plugs at upstream locations. Meanders of the new channels will closely approach, and should eventually merge with, portions of the old channels. The newly created streambed footage will equal or exceed the sum of streambed footage lost to culverts and diversion. The newly created Little Brier Creek wetland will be excavated to provide 2,700' of new streambed to replace 900' of natural channel and 1,300' of channel taken by culverts. The new channel will vary in width, and contain 29 sharp meanders and a series of riffles and pools at locations to be established during construction. The newly created Stirrup Iron Creek wetland will be excavated to provide 1,040' of newly created streambed to replace 520' of natural channel and 380' of channel taken by culverts. The new channel will vary in width, and contain nine sharp meanders and a series of riffles and pools at locations to be established during construction. r The new streambeds will be one to three meters below new wetland ground level, with.45- to 60-degree sloping banks. This depth and angle will allow retention of water within stream banks and allow wildlife unimpeded access to the stream. ' The channel beds will contain durable rocks of sufficient weight to resist transport by spring floodwaters (Fish Habitat Improvement Handbook, T.B. RE-TP7, January, ' 1985, for U.S. Department of the Army, Forest Service, Southern Region). Single wing deflectors, rock sills, and rock and boulder dams will be incorporated into the artificial streambeds to promote and maintain meanders, riffles and pools. All are low-flow channel structures which should not impede highwater flows, yet will supply the hydraulic pressures to accomplish habitat objectives.
