Reference your application for a Department of the Army permit
to construct a boat travel lift and docks on the Northeast Cape
Fear River near Turkey Creek, southwest of Rocky Point, Pender
County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The 'proposed pier and its attendant mooring structures are approved as
depicted in the attached plats provided the total length, as required by
NCAC 15 7H.0208(b)(6)(c) of the Rules of the Coastal Resources Commission,
does not extend waterward more than one-third the width of the water body.
(2) The authorized structures and associated activity will not cause an unaccep-
table interference with navigation.-
(3) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the permitted activity
without having it transferred to a third party.
(4) The waterward end of the authorized pier shall be fitted with permanent
reflectors and/or lights to reduce the potential for collision by boats
at time of darkness or inclement weather.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(5) Wetlands will not be excavated or filled. Prior to construction, the location
of proposed sedimentation basins will be coordinated with the Regulatory
Branch, Wilmington District Corps of Engineers, telephone (919) 343-4632,
in consultation with the Division of Coastal Management, to prevent an
unintentional violation of Section 404 of the Clean Water Act.
(6) Should the permittee propose to dispose of treated waste by discharging
same into the river under an NPDES permit, a major modification to this
permit will be required.
NOTE: An Easement is required from the Council of State through the State
Property Office, Department of Administration prior to construction
of the water withdrawal pipe and the attendant enclosed pumping station.
NOTE: The permittee is advised to contact the local health department regarding
their requirements for septic tank installations (as required under
10 NCAC 10A.1900 et. seq.). For information concerning septic tank
and other on-site waste disposal methods, contact the On-Site Sewage
Program at (919) 733-2895.
NOTE: The Land, Quality Section, Division of Land Resources reports that an
erosion and sedimentation control plan is on file with that office.
A violation of the restrictions and requirements of that plan could
constitute a violation of this permit if sediments reach adjacent waters
or wetlands.

8. Project Summary The applicants propose to develop the property for the purpose
of manufacturing boats. Buildings will be constructed and a travel
lift / docking area will be provided.

9. PROJECT DESCRIPTION
The project site is located on a 40 acre tract of land partially adjacent to
the Northeast Cape Fear River. The tract was recently acquired from a major
timber and paper company. A portion of the tract had been the timber
production. The remainder had mixed pine and hardwood species as the cover
vegetation. Some site preparation is underway on the property landward of the
estuarine shoreline AEC. (That area up to 75 feet landward of the mean high
water range [mhw] contour). The river at this location is a classified primary
nursery area and a B water. Depths in the project site range from
approximately 6' to 18'. Due to the isolated nature of the tract we`recommend
contact Mr. Dan Shields at Law Engineering to arrange for a site visit. He can
be reached at (919) 799-1550 in Wilmington, North Carolina. Mail can be

The applicants propose to clear approximately 60% of the 40 acres in order to
construct a boat manufacturing facility. Initially 185,000 s.f. of building
will be constructed which will alternately expand to 483,000 s.f.. There will
be approximately 140,000 s.f. of parking (paved). Three sedimentation basins
with discharge to riverine wetlands will be constructed. One on the eastern
side of the property and one each at the southeast and southwest corners of the
property. In order to launch boats for final assembly or fitting out a travel
lift/dock facility will be constructed out into the river. The dock/lift
extends approximately 110' out into the river.. At this location the riverlis
approximately 340' wide. There will be two sections of dock each approximately
94' long consisting of an 8' floating section with three 45' fingers each 4'
wide. This will provide docking for approximately 8 boats (sheet 4).
10. ANTICIPATED IMPACTS
The project area is predominately high ground. At the location of the sediment.
catch basin at the south east and east side of the property "404" wetlands
exist. In order to avoid these areas the final alignment of the basins should
be determined by Corps personnel. The travel lift/dock length does not exceed
one-third the river width. No impacts on coastal resources are anticipated.

Reference the application of Carver Boat Corvoration,
represented by Mr. Gene Grygiel, Vice President, for a Department
of the Army permit to construct a boat travel lift and docks on
the Northeast Cape Fear River near Turkey Creek, southwest of
Rocky Point, Pender County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. Wetlands will not be excavated or filled. Prior to
construction, the location of proposed sedimentation basins will
be coordinated with the Regulatory Branch, Wilmington District
Corps of Engineers, telephone (919) 343-4632, to prevent an
unintentional violation of Section 404 of the Clean Water Act.
b. The authorized structure and associated activity will not
cause an unacceptable interference with navigation.
C. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he

abandons the permitted activity without having it transferred to a
third party.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received June 19, 1987, for a
Department of the Army permit to construct a boat travel lift and
docks on the Northeast Cape Fear River near Turkey Creek,
southwest of Rocky Point, Pender County, North Carolina, indicates
it to be a candidate for Federal authorization under this general
permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of
Coastal Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SAWC087-N-071-0425 and will be
coordinated by Mr. Ken Jolly. He is available to address
