(1) In order to protect juvenile shrimp populations, no excavation or filling will be permitted between April 1 and September 30 of any year without prior approval of the Division of Coastal Management. (2) The authorized basin entrance cut will be staked by representatives of the DCM or COE prior to excavation. The permittee is advised to call for a site meeting. (3) An earthen plug will be left between the basin and the waters of Gales Creek until all excavation landward of the plug has been completed. To prevent unnecessary sediments from reaching adjacent waters, 24 hours will be allowed to elapse before the plug is removed. (4) The 300 square foot marsh area, immediately adjacent to the north side of the access canal will not be filled. The basin and channel/canal will be positioned so that no wetlands will be filled. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Cannon ADDITIONAL CONDITIONS Permit #77-87 Page 2 of 2 (5) All excavated materials will be confined landward of the normal high water (NHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. (6) No excavated or fill materials will be placed at any time in any vegetated wetlands or waters of the State. (13) The temporary placement or double-handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (14) All spoil and/or fill material must be contained by mechanical structures or devices (such as silt fences) to prevent sediment from re-entering adjacent waters. (15) All graded, filled, or otherwise disturbed areas must be provided with a ground cover within 30 working days. (16) The activity must be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction- related discharge (increases of 25 NTUs'or less are not considered significant). Narrative description The applicant's property is approximately a 6 acre tract purchased from a larger 300 acre parcel previously owned by Mr. Hiram J. Mayo. The property is located in the community of Mesic off SR 1224 near Gales Creek Point in Pamlico County. The property is roughly square in shape and is characterized by 2-5' elevations, all on sandy soils. Vegetation consists mainly of mixed pioneer grasses with a small cluster of live oaks in the central part of the property. The parcel is bordered by canals on the north and south sides and Gales Creek to the east. Small pockets of mixed marsh (Salt Reed grass, Salt Grass and Black Meedlerush) border the site near Gales Creek. At the mouth of both canals a galvanized pipe block (which was ordered by the U.S. Army Corps of Engineers in a 1975 enforcement action) is positioned to prevent navigation of the bordering canals by small boats. Adjacent waters are classified as SA by the Division of Enviromental Management and are currently open to shell fishing by the Division of Health Services. The adjacent tributaries in this vicinity are designated as primary nursery areas, however these particular man-made canal systems are not. The applicant submitted a permit application in November requesting that a similar basin be constructed immediately adjacent to the southern most canal. This office received the request.and initiated processing, however, the application was returned to the applicants by the U.S. Army Corps of Engineers citing the previous violation by Mr. Mayo and the subsequent resolvement of this infraction. The U.S. Army Corps of Engineers in resolving this violation by Mr. Mayo required that Mr. Mayo block the entrance to these canals with a galvanized pipe structure and not allow them to be used by anyone instead of going to the expense of filling them in.' This condition was incorporated into an after-the fact permit by the U.S. Army Corps of Engineers and this permit was required to be filed as restrictive covenants to the property which subsequently runs with the deed as it is transferred among individuals. Faced with this obstacle, the Cannons opted to redesign their project to position the basin in the area in which it is now proposed. The applicant is now proposing to construct his residence in roughly center of the property and construct his boat basin and access channel on the northeast side. This boat basin is to be.approximately 115' long by 65' wide and is to be serviced by a 300' long by 25' wide access channel. The boat basin is to be bulkheaded around the perimeter which will ! involve approximately 408' of bulkhead and a boatramp dock r and dockhouse are proposed on the western most side. Spoil is to be removed by a clam shell attachment on a drag line on a barge. Spoil will be deposited in the vicinity of the i house construction. Anticipated Impacts Conducting this project as proposed will involve the excavation of approximately 1025 sq. ft. of mixed marsh area during the channel construction. This mixed marsh area appears to have been altered previously, possibly during the Mayo incident at this site. The marsh through which the channel is proposed is different from the adjacent natural marshes, being much higher in elevation, much less dense, and growing on mineral soils. In addition to a segment of this being excavated, another 300 sa. ft. is proposed to be filled on the north side of the bulkhead between the natural marsh and the channel entrance. The access channel excavation will involve 6000 sq. ft. and the high ground basin excavation will involve 8650 sq. ft. Spoil will amount to approximately 3290 cu. yds. and this is to spread over 18,225 sa. ft. in the vicinity of the proposed house. All excavated materials will be confined landward of the normal high water (NHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. d. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters of the State. -2- e. Excavation will not exceed 4 feet below the elevation of normal low water (NLW). f. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. g. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Narrative description The applicant's property is approximately a 6 acre tract purchased from a larger 300 acre parcel previously owned by Mr. Hiram J. Mayo. The property is located in the community of Mesic off SR 1224 near Gales Creek Point in Pamlico County. The property is roughly square in shape and is characterized by 2-5' elevations, all on sandy soils. Vegetation consists mainly of mixed pioneer grasses with a small cluster of live oaks in the central part of the property. The parcel is bordered by canals on the north and south sides and Gales Creek to the east. Small pockets of mixed marsh (Salt Reed grass, Salt Grass and Black TTeedlerush) border the site near Gales Creek.' At the mouth of both canals a galvanized pipe block (which was ordered by the U.S. Army Corps of Engineers in a 1975 enforcement action) is positioned to prevent navigation.of the bordering canals by small boats. Adjacent waters are classified as SA by the Division of Enviromental Management and are currently open to shell fishing by the Division of Health Services. The adjacent tributaries in this vicinity are designated as primary nursery areas, however these particular man-made canal systems are not. The applicant submitted a permit application in November requesting that a similar basin be constructed immediately. adjacent to the southern most canal. This office received the request and initiated pro:cessing,• however, the application was returned to the applicants by the U.S. Army Corps.of Engineers citing the previous violation by Mr. Mayo and the subsequent resolvement of this infraction. The U.S. Army Corps of Engineers in resolving this violation by Mr. Mayo required that Mr. Mayo block the entrance to these canals with a galvanized pipe.structure and not allow them to be used by anyone instead of going to the expense of filling them in. This condition was incorporated into an after-the fact permit by the U.S. Army Corps of Engineers and this permit was required to be filed as restrictive covenants to the property which subsequently runs with the deed as it is transferred among individuals. Faced with this obstacle, the Cannons opted to redesign their project to position the basin in the area in which it.is now proposed. The applicant is now proposing to-construct his residence in roughly center of the property and construct his boat basin and access channel on the northeast side. This boat basin is to be.approximately 115' long by 65' wide and is to be serviced by a 300' long by 25' wide access channel. The boat basin is to be bulkheaded around the perimeter which will involve approximately 408' of bulkhead and a boatramp dock and dockhouse are proposed on the western most side. Spoil is to be removed by a clam shell attachment on a drag line on a barge. Spoil will be deposited in the vicinity of the i house construction. Various driveways and walkways along with a detached storage building are.proposed by the applicant also. 10. Anticipated Impacts Conducting this project as proposed will involve the excavation of approximately 1025 sq. ft. of mixed marsh area during the channel construction. This mixed marsh area appears to have been altered previously, possibly during the Mayo incident at this site. The marsh through which the channel is proposed is different from the adjacent natural marshes, being much higher in elevation, much less dense, and growing on mineral soils. In addition to a segment of this being excavated, another 300 sa. ft. is proposed to be filled on the north side of the bulkhead between the natural marsh and the channel entrance. The access channel excavation will involve 6000 sq. ft. and the high ground basin excavation will involve 8650 sq. ft. Spoil will amount to approximately 3290 cu. yds. and this is to spread over 18,22.5 sq. ft. in the vicinity of the proposed house. Narrative description The applicant's property is approximately 6-acre tract purchased from a larger 300 acre parcel owned by Mr. Hiram J. Mayo. The property is lo- cated in the community of Mesic off SR 1224 near Gale Creek Point in Pam- lico County. The property is roughly square in shape and is characterized by 2-5' ele- vations, all sandy soils. Vegetation consists mainly of mixed pioneer grasses with a small cluster of live oaks. The parcel is bordered by canals on the north and south sides, and Gales Creek to the east. Small pockets of mixed marsh (salt reed grass, salt grass, black needlerush) borders the site near Gales Creek. At the mouth of both canals a gal- vanized pipe.block (which was ordered by the U. S. Army Corps of Engineers in a 1975 enforcement action) is positioned to prevent entry of small boats into the bordering canal. Adjacent waters are classified as SA by DEM and are currently open to shellfishing by the Div. of Health Ser- vices. The adjacent tributaries in this.vicinity are designated as primary nursery areas; however, these particular man-made systems are not. The applicant is proposing to construct a residence, construct a boat- house, and excavate a boat basin with this permit request. The house is to be constructed in roughly the center of the site, and the boat house and boat basin are to- be located on the south canal. Maintenance excava- tion is proposed for. the canal-which will extend to the-S--1/2' NWL eleva- tion of Gales Creek. ??The existing galvanized pipe block is to be relocated to a position farther inland on this existing southern canal. 10.
