THIS CELZTIFTCATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of. Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to Brunswick County Econanic
DeveloPnent Corporation pursuant to an application filed on the 23rd day
of June, 1987 to construct a roadway crossing at the Leland Industrial
Park.

The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Rawell's
Branch in conjunction with the proposed road crossing in Brunswick
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted ian such a manner
as to prevent significant increase in turbidity
outside the area of construction' or construction
related discharge (increases such that the
turbidity in the Stream is 50 NT s or less
are not considered significant).'
2. That the fill be from an upland '`source and free
from any taxic materials.
3. Where rip-rap material is not being used, the
side slopes should be stabilized with vegetation
upon completion.
4 That all sed tat _ion -and eros4 - control
measures-should be implemented for to filling.

Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above

Please find enclosed a State Application requesting a
401 Certification to place fill materials in 404 Wetlands above
the headwaters of Rowell's Branch in Brunswick County. The
purpose of the application is to construct an earthen causeway
which will measure 170 feet in length by 100 feet in width across
the creek to gain access to that section of the Leland Industrial
Park lying adjacent to the Seaboard Coastline Railroad. The
proposed crossing will be permanent and will have two 5 foot
diameter corrugated metal pipe extending along the Branch.
Approximately 40 tons of rock rip rap will be placed on the
3:1 slopes around the pipes to aid in bank stabilization.
A copy of the Army Corps letter is also enclosed for your
information.

Dear Mr. Moul:
Reference your letter dated May 15, 1987, concerning the
Leland Industrial Park and the 84 acres owned by Brunswick County
at Rowell's Branch off U.S. Highway 74-76 in Brunswick County,
North Carolina.
The culvert and fill material placed in the creek can be
authorized by our nationwide permit for minor road crossings of
less than 200 feet spanning open water and wetlands. In the event
the road is not completed, all culverts and earthen material must
be removed. Please notify us of the final disposition on this
matter.

The applicant is proposing to fill approximately 0.4 acres of wetlands above the
headwaters of Powells's Branch, classified C-Swamp. This filling is requested in
order to gain access to developable high ground.
The project has been reviewed to determine impacts to water quality. The project
will require a 401 Water Quality Certification, which should contain the following
conditions :
1. That the fill be from an upland source and free from toxic material.
2. Where rip-rap is not being used, the side slopes should be stabilized
with vegetation upon completion.
3. All sedimentation and erosion control measures should be implemented
prior to filling.
This office has no objection to the project as proposed.

Dear Mr. Moul:
Reference your letter dated May 15, 1987, concerning the
Leland Industrial Park and the 84 acres owned by Brunswick County
at Rowell's Branch off U.S. Highway 74-76 in Brunswick County,
North Carolina.
The culvert and fill material placed in the creek can be
authorized by our nationwide permit for minor road crossings of
less than 200 feet spanning open water and wetlands. In the event
the road is not completed, all culverts and earthen material must
be removed. Please notify us of the final disposition on this
matter.
