(1) No part of the decks will be constructed within 15 feet of the adjacent property lines as extended into the water. (2) The decks will not be covered or enclosed. (3) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. (4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. The permittee is not relieved of this requirement if he abandons the permitted activity. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Project summary The applicant proposes to replace two open decks adjacent to a residential structure in Roanoke Sound at Nags Head. JEFFERSON BROWN BID REPORT PAGE 2 SITE DESCRIPTION The applicant owns a single family residence which is supported on pilings over the waters of Roanoke Sound at Nags Head. The structure is serviced by a septic tank and drain field on high ground. Three decks were constructed on the waterward side of the house which were damaged last year in storms resulting in the need to replace some of the pilings and rebuilding of the decks. The applicant proposes to replace two of the decks which will require 12 new pilings and replanking of the decks. Several old pilings are still in place but are in a deteriorated state. No deck covering remains on the two decks. The reconstruction of the decks will result in the covering of 476 square feet of water. ANTICIPATED IMPACTS Sinking of new pilings will result in some short term elevated turbidity levels. The decks are over the shallow waters of Roanoke Sound and immediately adjacent to the existing residence and should not pose a navigational problem. CAMA REVIEW The Nags Head LUP classifies the waters of Roanoke Sound as Conservation. The proposed project is consistent with that classification. s, Submitted by: George H.
