(1) The bulkhead will not extend waterward more than 4 feet from the normal water level at any point along its alignment at the time of construction. (2) The fill material will be clean and free of any pollutants, except in trace quantities. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Project etiumannry The applicant proposes to construct a bulkhead at his property on the Croatan Sound at the end of.S.R. 1134-(Skyco Road). .?.r - i ATLANTIC COASTAL INVESTMENTS - NEIL BLIIKEN BIO REPORT PAGE 2 SITE DESCRIPTION The applicant owns approximately two acres of undeveloped land adjacent to the Croatan Sound at the end of S.R. 1134-Skyco Road. The property, vegetated primarily in pine, has been subdivided into 6 residential lots. Recent storms have removed the overburden resulting in many partially undermined trees and a wide white sand beach. The applicant reports that the shoreline has experienced erosion in the last year of about 4 feet. The adjacent property to the north is not bulkheaded and the property to the south has an old bulkhead well offshore. The applicant is requesting authority to bulkhead the 350 foot long shoreline to prevent any additional erosion. The alignment depicted in the plats indicates the bulkhead will extend 10 feet waterward of NWL on the south end and 2 feet on the north end. The applicant reports that thi$ alignment will. average 5 feet waterward of the NWL. ANTICIPATED IMPACTS The construction of the bulkhead will result in some short term elevated turbidity levels'. The backfilling of the proposed bulkhead will resultin the filling of 1750 square feet of shallow water habitat. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. Therefore, if your office has not acted on the request by Aug 2, 1987, the District Engineer will deem that waiver has occurred.
