Reference your application for a Department of the Army permit
to excavate a basin, construct bulkheads and a forklift ramp
and install piers and pilings to establish an 82-slip commercial
marina on the Trent River off Madam Moores Lane, New Bern, Craven
County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWCO80-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

Dear Mr. Parker:
Reference the application of Carolina Oil and Distributing
Company, represented by Mr. James Blandford, for a Department of
the Army permit to excavate a 300-foot-long, 70-foot-wide basin
area and construct bulkheads and a concrete forklift ramp
associated with an 82-slip commercial marina facility on the Trent
River off Madam Moores Lane, New Bern, Craven County, North
Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The bulkhead will be positioned in strict accordance with
permit plans. It will be positioned landward of any wetland
vegetation.
b. All excavated materials will be confined landward of the
normal water elevation contour and any regularly or irregularly
flooded vegetated wetlands.
c. No excavated or fill materials will be placed at any time
in any vegetated wetlands or waters of the State.

d. Vegetated wetlands will not be excavated or filled.
e. Excavation will not exceed 5 feet below the elevation of
normal water.
f. The temporary placement or double handling of excavated or
fill materials within waters or vegetated wetlands is not
authorized.
g. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized work. Use of the permitted activity
must not interfere with the public's right to free navigation on
all navigable waters-of the United States.
h. If the display of lights and signals on the authorized
structure is not otherwise provided for by law, such lights and
signals as may be prescribed by the U.S. Coast Guard will be
installed and maintained by and at the expense of the permittee.
i. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having it transferrred to
a third party.

bypass bridge as requested in the permittee's application dape610/87 including
attached plats, 7 sheets 1-7 of 7 dated 3/24/87.
This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Marina Construction and Operation
(1) The location and dimensions of the proposed piers must be in accordance
with the approved work plat drawings and must not at any time restrict or
encumber traditional navigational uses of the waterway.
(2) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters at or adjacent to the authorized work.
Use of the permitted activity must not interfere with the public's right
to free navigation on all navigable waters of the United States.
(3) Prior to the occupancy of any slips authorized under this permit, the permittee
will permanently equip the marina with a pumpout facility to service boats
with holding tanks.
(4) Prior to marina occupancy, the permittee must construct restrooms at the
marina and operate the same in compliance with standards and guidelines
(See attached sheet for Additional Conditions
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(5) Trash receptacles sufficient in number and location to provide easy access
and capacity will be installed at the marina prior to operation.
(6) The marina shall prominently post and enforce a no sewage discharge policy.
(7) All floating structures, other than boats, used for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations
for onshore sewage treatment.
(8) No person shall be allowed to live aboard vessels in the marina.
Bulkhead Construction and Excavation
(9) The bulkhead will be positioned in strict accordance with permit plans.
It will be positioned landward of any wetland vegetation.
(10) In order to protect juvenile fin fish populations, no excavation or filling
will be permitted between March 1 and August 1 of any year without the prior
approval of the Division of Coastal Management.
(11) In order to prevent undermining of the fringe marsh, dredging of the river
bottom will be gradually tapered away from the marsh edge at no steeper
than a 4:1 slope.
(12) All excavated materials from the basin must be deposited directly on the
highground and there be retained to prevent its re-entry into the adjacent
waterways. Such material must be stabilized within 30 days of placement.
(13) Vegetated wetlands will not be excavated or filled.
(14) Excavation will not exceed 5 feet below the elevation of normal water.
(15) The temporary placement or double handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.
Miscellaneous
(16) Except for pedestrian accessways and the forklift ramp, a 50 foot wide vege-
tated_ buffer zone will be maintained between the proposed bulkhead and any
structural foundation.
(17) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-
related discharge.
(18) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the permitted activity
without having it transferred to a third party.

NOTE: Any additions or modifications to the proposed work plan will require
a modification and review by the Division of Coastal Management.
NOTE: The permittee is reminded that presently the Hwy. 17 swing bridge is
opened on a limited schedule. The increase in boating activity at the
marina will cause greater demands on that schedule with subsequent New
Bern area traffic back-up and/or departure schedules by marina patrons.
NOTE: Patrons of the marina should be advised of the narrow opening of the
railroad bridge adjacent to the marina.
NOTE: Permanent reflectors should be attached to the structures in order to
make them more visible during hours of darkness or inclement weather.
NOTE: An erosion and sedimentation control plan will be required for this project
since more than one contiguous acre is to be affected. The plan must
be filed at least 30 days prior to beginning the project and must be
approved before construction begins.
NOTE: Should the permittee encounter cultural resources during the accomplishment
of any work associated with this permit, he will immediately cease work
and notify the Division of Coastal Management and the Division of Archives
and History.

8. Project summary to develop a dry stack storage marina with 82
wetslips on 2 acres of highground property on the Trent River, James
city. Craven County

9. Narrative Description
Mr. James Blanford has filed a CAMA application to develop a
marina and dry stack storage facility on 2 acres of highground
property located on the James City side of the-Trent River where
the new Highway 70 bypass bridge crosses the river and next to
the railroad trestle in Craven County.
The project involves bulkheading the primary shoreline some 305
li. ft. The vertical bulkhead will be located landward of an
existing sparsely vegetated fringe of reed grass mixed with black
needlerush. In order to properly stabilize the necessary fill
material, a return wall bulkhead of some 200 li. ft. will be
constructed along the east side of the property adjoining the
railroad right-of-way. Work plat sheet-3 of 7 shows an irregular
in the river to be mechanically excavated. Basically the area
measures 300' long along the shoreline by 70' wide. The proposed
water depths will be -5' during normal water. As noted on sheet
4 of 7 and 6 of 7, the existing 10' wide fringe of reed grass
will be preserved and actually enhanced by the transplanting
method. All excavated spoil material, some 1750 cu. yds. of
sandy mud, will be placed directly on highground property and-
retained by the proposed bulkhead.
Three main.piers are scheduled for construction. Each pier will
be approximately 200' in length and will accommodate 24-26
boatslips. A gas tank or refueling station will be located at
the outboard end of the southwestern most pier. The central pier
will terminate with a "T" headed platform. Near the middle of
the shoreline the applicant proposes to locate a concrete
forklift ramp that will service the drystack storage building.
Except for this concrete rampway the applicant has designed his
project to provide a 50' wide vegetated buffer zone between the
proposed bulkhead and any of the drystack storage building. The
combined square footage of the drystack storage building which
will include a snack bar shop and a marine repair shop
approximates 15000.sq. ft. of covered roof area. The project
plans also call for the grading and filling of the highground
property in such a way that all rooftop runoff and drainage will
pass through an existing grass swale and eventually through an
area of 404 wooded swamp before emptying into the Trent River.
As shown on work plat 4 of 7, this area is part of a 100' wide
easement established by the railroad company between any and all
development and the actual rail line on the northeast side.
10. Anticipated Impacts
The open water marina will effectively cover 2.3 acres of the
public trust AEC within the Trent River. However, the proposed
facility has combined the use of 84 drystack slips with the use
of 82 wetslips. Based on a review of the U.S.G.S. topographic
map and the aerial photographic coverage the proposed piers
should not encroach on the prescribed navigational channel

between the railroad trestle and the new highway 70 bridge.
Design of the excavation in.the Trent River will directly
eliminate .48 acres of shallow water bottom. This area averages
3-4' deep on normal water and will be excavated to a -5' level.
Although no onsite samples were taken, it is doubtful that the
area contains any submerged grasses or other biologically
productive features. The proposed excavation is most necessary
at that point where the forklift will load and unload boats. In
addition, because of the property's location along the open
waters of the lower Trent River near New Bern, stagnate water and
poor circulation within the proposed basin will be no problem
since the flushing capabilities of the river are optimal at this
location.
The surface waters of the Trent River are classified as SB by the
Division of Environmental Management. The applicant has taken
care to design a stormwater drainage program for the property as
well as providing a 50' wide vegetated buffer zone along the
shoreline. In combination with the proposed building at
approximately 15000 sq. ft. the project easily meets the CAMA
standards for impervious surface areas.
CAMP, Review
The proposed development has been reviewed with reference to the
current Land Use Plan for Craven County where the land
classification shows the project site to be transitional and the
surface waters of the Trent River conservation. No physical
constraints have been identified in the review of that document
and therefore, the project is considered consistent with the
goals and objectives of the Land Use Plan. .

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received April 13, 1987, for a
Department of the Army permit to construct a 82-slip marina
facility on the Trent River off of Madam Moores Lane in New Bern,
Craven County, North Carolina, indicates it to be a candidate for
Federal authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SAWC087-N-025-0303 and will be

9. Narrative Description
Mr. James Blanford has filed a CAMA application to develop a
marina and dry stack storage facility on 2 acres of highground
property located on the James City side of the Trent River where
the new Highway 70 bypass bridge crosses the river and next to
the railroad trestle in Craven County.
The project involves bulkheading the primary shoreline some 305
li. ft. The vertical bulkhead will be located landward of an
existing sparsely vegetated fringe of reed grass mixed with black
needlerush. In order to properly stabilize the necessary fill
material, a return wall bulkhead of some 200 li. ft. will be
constructed along the east side of the property adjoining the
railroad right-of-way. Work plat sheet 3 of 7 shows an irregular
in the river to be mechanically excavated. Basically the area
measures 300' long along the shoreline by 70' wide. The proposed
water depths will be -5' during normal water. As noted on sheet
4 of 7 and 6 of 7, the existing 10' wide fringe of reed grass
will be preserved and actually enhanced by the transplanting
method. All excavated spoil material, some 1750 cu. yds. of
sandy mud, will be placed directly on highground property and
retained by the proposed bulkhead.
Three main piers are scheduled for construction. Each pier will
be approximately 200' in length and will accommodate 24-26
boatslips. A gas tank or refueling station will be located at
the outboard end of the southwestern most pier. The central pier
will terminate with a "T" headed platform. Near the middle of
the shoreline the applicant proposes to locate a concrete
forklift ramp that will service the drystack storage building.
Except for this concrete rampway the applicant has designed his
project to provide a 50' wide vegetated buffer zone between the
proposed bulkhead and any of the drystack storage building. The
combined square footage of the drystack storage building which
will include a snack bar shop and a marine repair shop
approximates 15000 sq. ft. of covered roof area. The project
plans also call for the grading and filling of the highground
property in such a way that all rooftop runoff and drainage will
pass through an existing grass swale and eventually through an
area of 404 wooded swamp before emptying into the Trent River.
As shown on work plat 4 of 7, this area is part of a 100' wide
easement established by the railroad company between any and all
development and the actual rail line on the northeast side.
10. Anticipated Impacts
The open water marina will effectively cover 2.3 acres of the
public trust AEC within the Trent River. However, the proposed
facility has combined the use of 84 drystack slips with the use
of 82 wetslips. Based on a review of the U.S.G.S. topographic
map and the aerial photographic coverage the proposed piers
should not encroach on the prescribed navigational channel
between the railroad trestle and the new highway 70 bridge.
Design of the excavation in the Trent River will directly
eliminate .48 acres of shallow water bottom. This area averages
3-4' deep on normal water and will be excavated to a -5' level.
Although no onsite samples were taken, it is doubtful that the
area contains any submerged grasses or other biologically
productive features. The proposed excavation is most necessary
at that point where the forklift will load and unload boats. In
addition, because of the property's location along the open
waters of the lower Trent River near New Bern, stagnate water and
poor circulation within the proposed basin will be no problem
since the flushing capabilities of the river are optimal at this
location.
The surface waters of the Trent River are classified as SB by the
Division of Environmental Management. The applicant has taken
care to design a stormwater drainage program for the property as
well as providing a 50' wide vegetated buffer zone along the
shoreline. In combination with the proposed building at
approximately 15000 sq. ft. the project easily meets the CAMA
standards for impervious surface areas.
CAMA Review
The proposed development has been reviewed with reference to the
current Land Use Plan for Craven County where the land
classification shows the project site to be transitional and the
surface waters of the Trent River conservation. No physical
constraints have been identified in the review of that document
and therefore, the project is considered consistent with the
goals and objectives of the Land Use Plan.
