Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Bald Head Island, Brunswick County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. In order to minimize adverse impacts to fish and wildlife resources, no excavation or filling will be permitted between the dates of April 1 and November 15 of any year without the prior approval of the U.S. Fish and Wildlife Service. b. Vegetated wetlands will not be excavated or filled. c. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. Narrative Description The Village of Bald Head Island has requested a permit which would authorize a beach nourishment project located along the southwestern portion of Bald Head Island. Bald Head Island is a resort community/complex accessible only by boat and is located in Brunswick County at the confluence of the Cape Fear-River and the Atlantic Ocean. -In the last several years erosion rates have accelerated along the southwestern portion of the-island to the point where several homes have been relocated off the oceanfront with an inn/restaurant currently being threatened. The applicants areproposing to maintenance dredge by hydraulic dredge an approximately 500' long by 400' wide portion of the federally maintained Cape Fear entrance channel to a depth of -40' MLW and to pump the excavated material to the oceanfront of Bald Head Island. This-material (primarily course sand) would then be discharged upon the beach along approximately 10000 li. ft. of oceanfront shoreline. The applicant has indicated that the nourishment project would range from 100-300' in width and would increase the existing beach profile by an aver-age of 61. Bulldozers will be used to redistribute the sand above the MHW- line and frontal dunes will be "repaired" or reestablished. 10. Anticipated-Impacts. The project as proposed will result in the maintenance excavation of approximately 5 acres of channel bottom in the Cape Fear River which is currently a federally authorized activity. The approximately 400 cu: yds. of primarily-sand material which is generated by this excavation will be discharged upon an approximately 10000 li. ft. section of oceanfront shoreline. Up to 47 acres of offshore beach area (below the MHW line) could be directly impacted by this project with up to 23 acres of beach area (above the MHW line) also being filled. Increased turbidity levels, disturbance of nesting areas for sea turtles, burial of benethic organisms in the surf zone and short-term loss of habitat areas for shore birds will all be impacted by the proposed project.
