This permit, issued one 2Ab -7 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject pemnittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) In order to protect juvenile shrimp and fin fish populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management. (2) Excavation will not exceed 4 feet below the elevation of mean low water (MLW). (3) Vegetated wetlands will _not b-ge-iexcavated.or,'fi.1.1. e4. ` (4) All' excavated materials will e confined above mean high water -and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surround- ing waters. (5) The diked disposal area will be constructed a sufficient distance from the mean high water level or any marsh or eliminate the possibility of dike erosion into or upon any marsh and/or surrounding waters. (See attached sheet for Additional Conditions This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (7) The disposal area effluent will be contained by pipe, trough or similar device to a point at or below the mean low water level within the canal to be dredged to prevent gully erosion and unnecessary siltation. (8) The terminal end of the pipeline will be positioned at or greater than fifty (50) feet from any part of the dike and a maximum distance from spillways to allow settlement.of suspended solids. (9) A water. control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. (10) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. (11) The dike and spoil area will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. Hydraulic dredging will be used to excavate the material and it will be placed in a high ground disposal area. Mr. and Mrs. Robert Adams Page 2 9. PROJECT DESCRIPTION: The project site is located on the mainland side of Sunset beach, approximately one mile east of Sunset Beach bridge. It consist of a man-made canal measuring approximately 120 feet wide by 910 feet long. Th average depths at mean low water (MLW) ranges from approximately - 1/2' mlw to + 1.5' mlw. There is an existing fringe of marsh S rtina alterniflora) bordering the shoreline on both sides of the Canal. The waters in this area are classified as SA closed waters and are primary nursery. At present there are only 9 residential structures in this subdivision. The applicant proposes to excavate by Hydraulic Dredge approximately 9600 cubic yards of silt/sand material. This material will be placed directly on a designated lot identified in the proposed plan as property #9 located in the south end of the Canal. This site is just adjacent to a high marsh 11404" area. The effluent discharge from the area would go to the AIWW. The dimensions of the maintained Canal will be approximately 910' long x 401wide x 4' deep. 10. ANTICIPATED IMPACTS: There will be some short term turbidity and sedimentation problems associated with the dredging. Provided that this activity is timed so as to avoid periods of peak biological activity, no significant long term negative impacts are expected.
