Dear Mr. Crabtree:
On January 30, 1995, the Division of Environmental Management
issued Permit No. WQ0010525 to you for the subject wastewater pump
and haul activities. This permit expired on July 31, 1995. You
have requested that the permit be reissued since the City of Durham
sewers are not yet available.
The Division is reissuing this permit to you; however, the Division
is concerned about your previous indication that you were
unfamiliar with the terms and conditions of the permit. On August
9, 1995, you received a Notice of Violation (NOV) for failure to
submit the records required by condition 15 of the permit. After
receiving this NOV, you called Randy Jones, of my staff, to discuss
the situation. You indicated to Mr. Jones that you did not really
know anything about the pump and haul operation other than to call
to have the storage tank pumped when the alarm sounded and that you
were certainly not aware that records must be submitted to the
Division. You or your designee should immediately become familiar
with the terms and conditions of this permit. Please understand
that the permit is issued to you and you are responsible should the
Division find it necessary to pursue any enforcement activities
related to the operation of this pump and haul activity. You
should also understand that the issuance of this permit should not
be taken as an indication that it will be renewed in the future.

.This permit shall be effective from the date of issuance until
January 31, 1996, and shall be subject to the conditions and
limitations as specified therein. Please pay particular attention
to the monitoring requirements in this permit. Failure to
establish an adequate system for collecting and maintaining the
required operational information will result in future compliance
problems.
If any parts, requirements, or limitations contained in this permit
are unacceptable, you have the right to request an adjudicatory
hearing upon written request within thirty (30) days following
receipt of this permit. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, NC 27611-7447. Unless such
demands are made this permit shall be final and binding.
