However, additional information is required before the review may be completed. Please address the items on the following pages no later than the close of business on November 20, 2013. Please be aware that you are responsible for meeting all requirements set forth in North Carolina rules and regulations. Any oversights that occurred in the review of the subject application package are still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items shall result in future requests for additional information. Please reference the subject application number when providing the requested information. A. Cover Letter: 1. No comments. B. Application Fee: 1. No comments. C. Application: 1. Please note that the submitted application (Form: HRIS 12-06) is out of date. Accordingly, please complete the most recent version of the application (Form: HRIS 08-13), or at a minimum, complete Sections VI, IX and X of the application. This application can be downloaded at: http://portal.ncdenr.or web/wq/aps/lau/applications. 2. Please clarify why the flow allocation information provided in Application Item, III.3. differs from past flow allocation information provided for the Monteray Shores facility. For instance, previous flow allocation calculations included 44,775 gallons per day (GPD) for future Corolla Bay commercial expansion, but the information included with this application only cites 15,000 GPD for this purpose. 3. The setback in Application Item IV. 1. for the infiltration system to any habitable residence or place' of assembly owned by the Permittee to be maintained as part of the project site is listed as "See Revised Exhibit IV.2." The Division could not locate an Exhibit IV.2 in the application package. Please amend Application Item IV.1. to include this minimum observed setback distance. 4. The last part of Application Item IV.1. indicates that a setback is not met. Please clarify which setback is not met. The proposed modification includes the addition of new equipment to the wastewater treatment plant. Therefore; please amend Application Item V.2. as necessary to include all new treatment units and equipment, as well as their plan sheet and specification page references. Application Item VII.7. and the existing permit issued November 9, 2012 state that the area of the existing infiltration basin is 1.85 acres. However, both the Hydrogeologic Report and Engineering Plans have differing areas of 2.23 and 2.22 acres, respectively. Amend Application Item VH.7. to include the correct area. D. Property Ownership Documentation: 1. No comments. Mr. Martin Lashua October 21, 2013 Page 3 of 5 E. Soil Evaluation: 1. No comments. F. Agronomist Evaluation: 1. Not applicable. G. Hydrogeologic Report: 1. See Section I— Engineering Plans Comments #1 and Q. H. Water Balance: 1. Not applicable. I. Engineering Plans: Plan Sheet C-100 and the Hydrogeologic Report indicate that the high -rate infiltration basin is approximately 2.22 acres in size, even though the current permit only authorized the construction and operation of a 1.85 acre infiltration basin. Accordingly, the Division has no record that the basin was not constructed to the permitted size, and was not aware of this change until this permit application. Please explain why the Division was not notified of this substantial change in acreage prior to this permit modification (e.g., Engineering Certification, start-up inspection, permit modification, etc.) In addition, please provide documentation as to when and how it was determined that the basin was actually larger than the original design. The Hydrogeologic Report states that the groundwater lowering drain should capable of pumping up to 275,850 GPD; however, the Division could not locate information on the drain in the provided design drawings. Please provide documentation that the drain is capable of this flow, and how flow from the drain will be regulated. Also, during Division inspections, it has been noted that there have been some problems with the drain pumping sand and damaging the groundwater pumps. Is this still a problem and, if so, how will it be addressed during this modification? 3. Plan Sheet C-100 shows that the high -rate infiltration basin contains a dividing wall, thus presumably allowing the Permittee to operate the system as two separate basins. If so, please provide the area of each basin. 4. Application Item IV.2. states that the 5-day upset pond will be fenced to prevent public access. However, Plan Sheet C-101 does not appear to show fencing around the proposed 5-day upset pond. Please amend the plan set to include fencing, as well as provide a detail of the proposed fencing. Since the submitted specifications will be stamped approved upon permit issuance as a standalone document, please provide a cover sheet to the specifications that has been signed, sealed and dated by a licensed North Carolina Professional Engineer. 2. Per Application Instruction J, please amend the specifications to include a table of contents with references to each section. K. Engineering Calculations: 1. A large portion of the Engineering Calculations appears to be previously submitted calculations from an October 2010 application to Permit No. WQ0035060 for Outer Banks Ventures WWTP #1. Accordingly, please submit revised calculations that are for the Monteray Shores facility, and that are for the proposed flow of 5 80,3 20 GPD. 2. Amend the submitted Engineering Calculations to include calculations demonstrating the area of the high -rate infiltration basin(s) at the two foot freeboard elevation. L. Site Map: 1. No comments. M. Power Reliability Plan: 1. No comments. N. Operation and Maintenance Plan: 1. Amend existing Operation and Maintenance Plan to include information about the proposed 5- day pond, as well as the new MBR units/layout. 2. For at least the last three years wetland vegetation has been observed growing in the basin during inspections. Because flows have been relatively low, the presence of the vegetation has not impacted the basin's operation; however, if the basin is to be permitted for the proposed additional flow, the Permittee should provide a description of what operation and maintenance methods will be used to remove the vegetation and maintain the basin in the future so it can assimilate the additional flow. O. Residuals Management Plan: 1. Amend the Residuals Management Plan to provide calculations demonstrating that sufficient residual storage is provided based on the increased flow. In accordance with 15A NCAC 02T .0704(g), please provide documentation from the North Carolina Utilities Commission documenting that the Permittee has either been approved or has applied for approval to provide utility service to the areas proposed to be included in this permit modification. ➢ Existing Permit: 1. No comments. ➢ Final Environmental Document: 1. Not applicable. ➢ Floodway Regulation Compliance: 1. Not applicable. ➢ Operational Agreements: 1. Not applicable. ➢ Threatened or Endangered Aquatic Species Documentation: 1. Per Application Instruction P and 15A NCAC 02T .0105(c)(10), provide documentation concerning the presence or absence of threatened or endangered aquatic species in the area of the proposed facility modification. ➢ Wastewater Chemical Analysis: 1. Not applicable.
