Kinlaw: in accordance with a request filed Tune 27, 1994, on behalf of the Cumberland county Schools by the engineering firm of the Rose Group, Inc., we are forwarding herewith Permit No. WQ0009637, with an issue date of June 29, 1994. zhio permit, issued to the Cumberland County Sahaola, is for the temporary operation of a pump and haul system to serve Stedman Elementary school. This permit shall be effective from the date of issuance until June 30, 1996, and shall be subject to the conditions and limitationa as specified therein. In order to ensure proper operation of this facility, i would like to direct your attention to condition number twelve (12) of the permit. If any parts, requirementa, or limitations contained in this Permit erg unacceptable to you, you have the right to an adjudicatory hearing upon written request within 30 days following receipt of this Permit. This request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative Rearinga, P.O. This permit shall become voidabla unl&ao the subject pump and haul activities are carried out in a manner which has been approved by this Division. 2. This permit is off active only with respect to the nature and volume of wastes described in the application and supporting data. 3. No type of wastewater other than that domestic waste from Stedman Elementary School shall be included in the pump and haul activities. 6. The permit shall become voidable unless the agreement between the Cumberland County schools and the Fayetteville Public Works Ccw=ission for the ultimate disposal of the wastewater is in full forcia and effect. 7. In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall cease operation of all pump and haul activities and take ouch immediate corrective action &a necessary, including those as may be required by this Division. a. This pump and haul permit shall not be renewed. 9. The wastewater collected by this system shall be treated in the City Cf Fayetteville PWC Crone Creek wastewater Treatment Plant prior to being discharged into the recaiving stream. 10. The Permittea is liable for any damage caused by a spill or failure of the pump and haul operations. 11. Adequate inspectiod, mainten"ce, and cleaning shall be provided by the Permittee to ensure proper operation of the subject facilities. 12. The Parmittee or his designee shall inspect the pump and haul facilities a minimum of two (2) times per day, five (5) days per week to prevent malfunctions and deterioration, operator errors, and discharges which may cause or lead to the release of waste to the environment, a threat to human health, or a nuisance, The Permittee shall keep an inspection log or summary including at least the date and time of inspection, oboarvations made, and any maintenance, repairs, or corrective actions taken by tha Parmittee. This log of inspections shall be maintained by the Fermittee for as long as the pump and haul activities are being conducted and shall be ;wade available upon request to the Division of Environmental Management or other permitting authority, JAN 10 '95 15:36 Pump and Haul Permit Page 3 13. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon greaentativn of credentials, enter and inspect any property, premisea, or place, on or related to the pump and haul collection facilities at any reasonabla time for the purpose of determining compliapce with this permit, may inspect or copy any record that must ba kept under the terms and conditions of this permitF and may obtain samples. 14. An accurate record of the pump and haul activities must be maintained by the Permittee, indicating! A. Data wastewater is removed from the facility. b. Name of facility from which wastewater in removed. c. Name of facility receiving wastewater. d. Volume of wastewater removed. 15. Failure to abide by the conditions and limitations contained In this Permit may aubject the Permittee to an enforcement action by the Division of Environmental management in accordance with North Carolina General Statute 143-215.6. 16. The issuance of this Permit does not ,preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which xnay be imposed by other government agencies (local, state, and federal) which may have jurisdiction. 17. Noncompliance Notification: The Permittee shall report by telephone to the Fayetteville 'Regional Office, telephone number 919-486-1541, as soon as possible, but La no case more than 24 hours or on the next working day following the occurrence or first knowledge of any of the following: a. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compreasore, etc. b. Any Failure of a pumping atation, eewe.r line, etc., resulting in a by-pass directly to receiving waters without treatment of any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall file a; written report in letter form JAN 10 '95 15:37 113 P06 Pump and haul Parmit Page 4 within 15 days following first knowledge of the occurrence. The wastewater collected by this system shall be treated in the City of Fayetteville PWC wastewater treatment plant prior to being discharged into the receiving stream. 10. The Permittee is liable for any damage caused by a spill or failure of the pump and haul operations. 11. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter and inspect any property, premises, or place, on or related to the pump and haul collection facilities at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any record that must be kept under the terms and conditions of this permit; and may obtain samples. - '14.
