On May 10, 1993, the Division of Environmental Management issued Permit No. WQ0006798 to
the Coastal Regional Solid Waste Management Authority for the subject washdown water pump and haul
operation. Since that time, the Division has discovered that part of condition number 19 was inadvertently
omitted from the issued permit; therefore, in accordance with the conversation between you and Randy
Jones, of my staff, on June 1, 1993, Permit No. WQ0006798 is being reissued to the Coastal Regional
Solid Waste Management Authority to make this minor correction.
This permit shall be effective from the date of issuance until April 30, 1998, shall void Permit No.
WQ0006798, which was issued on May 10, 1993, and shall be subject to the conditions and limitations as
specified therein. The Coastal Regional Solid Waste Management Authority shall notify the Division, in
writing, when Permit No. WQ0007600, which was issued on February 23, 1993, is no longer required.
The pump and haul activities associated with this permit (WQ0006798) shall not begin until written
authorization is provided by the Division. Please pay particular attention to the monitoring requirements in
this permit. Failure to establish an adequate system for collecting and maintaining the required operational
information will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within 30 days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150E of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447,
Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina
as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
operation of an approximately 2000 GPD washwater and 10 GPD "gray water" pump and haul facility to
serve the Coastal Regional Solid Waste Management Authority's Carteret County solid waste transfer
station; the facilities consist of the construction and operation of a washwater simplex pump station with an
audible and visual high water alarm, the installation of an above ground 20,000 gallon storage tank with an
audible and visual high water alarm, sediment and trash traps, piping, and other appurtenances with no
discharge of wastes to the surface waters, pursuant to the application received on July 27, 1992, and in
conformity with the project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Environment, Health and Natural Resources and considered a part of this
permit.
This permit shall be effective from the date of issuance until April 30, 1998, shall void Permit No.
WQ0006798, which was issued on May 10, 1993, and shall be subject to the following specified
conditions and limitations:
1. This permit shall become voidable unless the subject pump and haul activities are carried
out in a manner which has been approved by this Division.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may or may
not be approved.
5. No type of wastewater other than that from the Coastal Regional Solid Waste Management
Authority's Carteret County solid waste transfer station shall be included in the pump and
haul activities.
6. The permit shall become voidable unless the agreement between the Coastal Regional Solid
Waste Management Authority and the Town of Newport for the treatment of the transfer
station washwater and the approximately 10 gallons of "gray water" is in full force and
effect.
7. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall cease operation of all pump and haul activities and
take such immediate corrective action, as may be required by this Division.
8. The washwater and "gray water" collected by this system shall be treated in the Town of
Newport's wastewater treatment facility prior to being discharged into the receiving stream.
9. The Wilmington Regional Office, telephone no. 919/395-3900, shall be notified at least
forty-eight (4$) hours in advance of operation of the pump and haul activities so that an in-
place inspection can be made. Such notification to the regional supervisor shall be made
during the normal office hours from 8:00 a.m, until 5:00 p.m. on Monday through Friday,
excluding State Holidays.
10. The Permittee is liable for any damages caused by a spill or failure of the purnp and haul
operations.
11. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
12. The Permittee or his designee shall inspect the washwater collection facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by
the Permittee. This log of inspections shall be maintained by the Permittee for as long as
the pump and haul activities are being conducted and shall be made available upon request
to the Division of Environmental Management or other permitting authority.
13. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the washwater collection facilities at any reasonable time
for the purpose of determining compliance with this permit; may inspect or copy any
records that must be kept under the terms and conditions of this permit; and may obtain
samples.
14. An accurate record of the pump and haul activities must be maintained by the Permittee,
indicating:
a) name of facility from which wastewater is removed,
b) date wastewater is removed from the facility,
C) name of facility receiving wastewater, and
d) volume of wastewater removed.

15. The Coastal Regional Solid Waste Management Authority is responsible for obtaining
monitoring results from the transfer station wastewater that will be pumped and hauled to
the Town of Newport's Wastewater Treatment Facility, for the constituents listed below.
This monitoring will be conducted for five discrete pump and haul events, beginning with
the second pump and haul activity, and shall be performed for every second pump and haul
event thereafter, for the remaining four monitoring events. These monitoring events shall,
as much as possible, coincide with the Town of Newport WWTF effluent monitoring
requirements specified in condition 16, to ensure that both monitoring events include the
same pumped and hauled wastewater. Additionally, the Coastal Regional Solid Waste
Management Authority is responsible for maintaining records which include: name of
facility, date monitoring is performed, time of day monitoring is performed, location from
which samples are collected, and volume of wastewater being pumped and hauled in the
specific load.

16. The Coastal Regional Solid Waste Management Authority is responsible for obtaining
monitoring results from the Town of Newport's Wastewater Treatment Facility effluent for
the constituents listed below. This monitoring will be conducted for five discrete pump and
haul events, beginning with the second pump and haul activity, and shall be performed for
every second pump and haul event thereafter, for the remaining four monitoring events.
These monitoring events shall, as much as possible, coincide with the transfer station
monitoring of the wastewater that will be pumped and hauled, as specified in condition 15,
to ensure that both monitoring events include the same pumped and hauled wastewater.
The effluent monitoring shall be performed at a time when the treated pumped and hauled
wastewater would be expected to be a part of that effluent, considering the detention time in
the wastewater treatment facility. Effluent sampling for all testing shall be performed at the
NPDES permitted final effluent discharge, below all treatment processes and each event
shall consist of twenty-four hour composite samples. Additionally, the Coastal Regional
Solid Waste Management Authority is responsible for maintaining records which include:
name of facility, date monitoring is performed, time of day monitoring is performed,
location from which samples are collected, effluent flow (GPD) of WWTF at time of
sample collection, and date and time of day that pumped and hauled wastewater in
equalization/storage tank was released into WWTF and date and time of day that such
release to WWTF ceased (includes only the most recent event prior to or during
monitoring).

17. One copy of all records required by conditions 14, 15, and 16 shall be submitted to the
following three addresses, within five (5) working days of their availability to the Coastal
Regional Solid Waste Management Authority. When submitting these records or
monitoring results, reference them by Permit No., permit issue date, and condition number:

18. The Coastal Regional Solid Waste Management Authority is responsible for obtaining the
results from two chronic toxicity tests to be performed on the Town of Newport's
Wastewater Treatment Facility effluent. The sampling for this testing shall be performed
prior to effluent disinfection and shall consist of twenty-four hour composite samples. The
chronic toxicity tests shall be performed using test procedures outlined in The North
Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic
Bioassay Procedure - Revised *September 1989 or subsequent versions).
The effluent concentration defined as treatment two in the North Carolina procedure
document is 66%. The Coastal Regional Solid Waste Management Authority is responsible
for ensuring that this procedure is used to establish compliance with the permit condition.
The first toxicity test event will be performed prior to the occurrence of any pump and haul
activities. These sample results shall be labeled, "Prior to Pump and Haul." The remaining
toxicity test event shall be performed after the second pump and haul event, and in
conjunction with the first sample event required in condition 16. DEM Forms AT -1
(original), for both toxicity testing events, are to be sent to the following address:

The test data shall be complete and accurate and shall include all supporting
chemical/physical measurements performed in association with the toxicity tests, as well as
all dose/response data.
Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an
invalid test and will require retesting. Failure to submit suitable test results will constitute
noncompliance with those applicable requirements in this permit.

19. The results of all sampling and monitoring required in this permit will be reviewed by the
Division. If necessary for the protection of public health and welfare and the State's natural
resources, the Division will impose additional requirements which may include
pretreatment and additional requirements in the Town of Newport's NPDES permit.
20. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
21. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
22. The Permittee shall provide for the installation and maintenance of an audible and visual
highwater alarm on any pump tank(s) and storage tank(s) used in these pump and haul
activities.
23. A copy of the approved plans and specifications shall be maintainers on file by the Permittee
for the life of the project.
24, Noncomplignee Notification:
The Permittee shall report by telephone to the Wilmington Regional Office at 919/395-
3900, as soon as possible, but in no case more than 24 hours or on the next working day
following the occurrence or first knowledge of the occurrence of any of the following:
Any process unit failure, due to known or unknown reasons, that render the
facility incapable of adequate wastewater treatment such as mechanical or electrical
failures of pumps, aerators, compressors, etc.
b. Any failure of a pumping station, sewer line, etc. resulting in a by --pass directly to
receiving waters without treatment of all or any portion of the influent to such
station or facility.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
25. Upon completion of construction and prior to operation of the subject pump and haul
activities, a certification must be received from a professional engineer certifying that the
permitted facilities have been installed in accordance with this permit and the approved
plans and specifications. Mail the Certification to the Permits and Engineering Unit, P.O.
Box 29535, Raleigh, NC 27626-0535.
26. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit, as specified by 15A NCAC 2H.0205
(c)(4).
27. The Coastal Regional Solid Waste Management Authority shall notify the Division, in
writing, when Permit No. WQ0007600, which was issued on February 23, 1993, is no
longer required.
28. The pump and haul activities associated with this permit (WQ0006798) shall not begin until
written authorization is provided by the Division. The Coastal Regional Solid Waste
Management Authority is responsible for requesting such authorization.
