This permit shall be effective from the date of issuance until March 31, 2009, shall void Permit No. WQ0006085 issued April 29, 2004, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If fany parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. Technical Assistance and Certification Unit APS Central Files (WQ0006085) NorthCarolina Naturallrf Aquifer Protection Section 1636 Mail Service Center Raleigh, NC 27699-1636 Phone (919) 733-3221 Customer Service Internet: http:#h2o.enr.state.nc.us 2728 Capital Boulevard Raleigh, NC 27604 Fax (919) 715-0588 1-877-623.6748 Fax (919)715-6048 An Equal Opportunity/Affirmative Action Employer —50% Recycled110% Post Consumer Paper NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH WASTEWATER TREATMENT AND RECLAIMED WATER UTILIZATION PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Town of Ocean Isle Beach Brunswick County FOR THE continued operation of approximately 81 acres of reclaimed water utilization area that contains 404 sprinklers and all associated piping, valves, electrical and instrumentation/control systems, and other appurtenances necessary to make complete and functional reclaimed water utilization facilities (the new spray irrigation facilities shall receive wastewater effluent meeting the reclaimed water quality standards only); and the continued operation of a 1,050,500-gallon per day (GPD) wastewater treatment and spray irrigation / reclaimed water utilization facility as follows: a wastewater treatment facility consisting of one (1) 4.68-million gallon Iagoon and two (2) 7.125-million gallon lagoons (both lined and to be used for equalization of influent wastewater, storage of wastewater effluent not meeting the reclaimed water quality standards, or return of reclaimed water not capable of being reused prior to introduction to the headworks for treatment/re -treatment); an influent wastewater flow monitoring and recording device; one (1) mechanically -cleaned bar screen with a manually -cleaned bar screen for use in bypass situations; one (1) eight -foot diameter vortex -type grit removal system with a 100-gallon per minute airlift unit; one (1) adjustable flow splitter/control box; three (3) sequencing batch reactor (SBR) tanks, each with 422,500 gallons of working volume for the equalization/pre-reaction, aeration, clarification/decanting, and post -clarification equalization of wastewater and a 100-gallon per minute (GPM) sludge wasting pump, and three (3) 860-cubic foot per minute (CFM) positive displacement blowers to provide fine -bubble aeration to the tanks; and one (1) 422,500-gallon aerated sludge holding tank (i.e., aeration provided by SBR blowers) in which digestion takes place prior to removal at a sludge loading station by a contractor for land application utilizing a 200 GPM sludge removal pump. Following equalization, aeration, and clarification, secondary wastewater effluent is introduced to a continuous ly-backwashed traveling bridge filter unit. This unit consists of the following components: two (2) 507-square foot (ft) filter beds onto which secondary wastewater effluent is applied at a loading rate not to exceed 1.38 gallons per minute per square. foot (GPM/ft2), each having a eight -inch thick layer of sand with an effective size of between 0.55 and 0.65 millimeters and an eight -inch thick layer of anthracite with an effective size of between 0.85 and 0.95 millimeters; two (2) 4,900-gallon clear wells with a 25 GPM/ftz backwash pump to facilitate backwashing of each of the filter beds assisted by air scouring; and gravity drainage of backwash water to a pump station with two (2) 400 GPM pumps to return backwash water to the headworks. Tertiary wastewater effluent is disinfected using ultraviolet disinfection and continuously monitored for turbidity before utilization in the reclaimed water utilization facilities or disposed of in the spray irrigation facilities. Wastewater effluent meeting the reclaimed water quality criteria stipulated in 15A NCAC 2H .0219 (k)(1)(A)(iii) (i.e., as evidenced by a turbidity of 10 nephelometric turbidity units (NTU) or less) is diverted into the reclaimed water utilization facilities, while wastewater effluent not meeting the reclaimed water quality criteria is returned to the headworks through a pump station with two (2) 400 GPM pumps or irrigated onto the existing 110-acre spray irrigation field described below. This diversion function is automatically -controlled through use of the turbidimeter in conjunction with motor -operated valves; a spray irrigation/reclaimed water utilization facility consisting of a 250,000-gallon pump well and a 22.5-million gallon lagoon, both of which are lined and used for wastewater effluent/reclaimed water storage at the site of the wastewater treatment facilities prior to spray irrigation/utilization; a pump station containing two (2) 400 GPM pumps and two (2) pump stations containing two (2) 700 GPM pumps each, both of which are located at the site of the wastewater treatment facilities and are capable of transporting wastewater effluent/reclaimed water to the spray irrigation/reclaimed water utilization facilities, transferring wastewater effluent/reclaimed water between various storage lagoons/ponds (i.e., both at the site of the wastewater treatment facilities and at the site of the reclaimed water utilization facilities), and returning wastewater effluent/reclaimed water to the equalization ponds for re -treatment should spray irrigation of wastewater effluent or utilization of reclaimed water not be possible; a flow metering device that is capable of continuously metering and totaling all wastewater effluent being spray irrigated and/or reclaimed water being utilized or transferred to the site of the reclaimed water utilization facilities; a field that is approximately 110 acres in area and is equipped with a solid -set spray irrigation system that contains 666 sprinklers, each with a 56-foot radius; and all associated piping, valves, electrical and instrumentation/control systems, and other appurtenances necessary to make a complete and functional wastewater treatment and spray irrigation operation (The existing spray irrigation facilities, approximately 110 acres in area, may receive any wastewater effluent from the wastewater treatment facilities, regardless of whether or not it meets the reclaimed water quality standards); In addition to the above -described components, the combined wastewater treatment and spray irrigation/reclaimed water utilization facilities is provided with all-weather access; restricted access or the appropriate public notification regarding reclaimed water utilization; audible and visual alarms for each control panel; a telemetry system to monitor various alarm and failure conditions; an automatically - activated stand-by power generation system, capable of providing power to the facilities permitted herein in the event of a loss of the commercial power supply; and all associated piping, valves, electrical and instrumentation/control systems, and other appurtenances (i.e., existing and new) required to make complete and functional wastewater treatment and spray irrigation/reclaimed water utilization facilities. The above -described wastewater treatment and spray irrigation/reclaimed water utilization facilities shall serve the Town of Ocean Isle Beach and its wastewater customers with no discharge of wastes to surface waters, pursuant to the modification request received September 14, 2004 and in conformity with the project plans, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until March 31, 2009, shall void Permit No. WQ0006085 issued April 29, 2004, and shall be subject to the following specified conditions and limitations: L PERFORMANCE STANDARDS 1. All wastewater shall be treated at least once in the tertiary treatment plant prior to irrigation. If the treated reclaimed water does not comply with reuse standards it shall either be irrigated on the 110- acre site or returned to the treatment plant headworks for tertiary re -treatment. 2. The wastewater treatment and spray irrigation / reclaimed water utilization facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters, which will render thew unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately assimilate the wastewater, the Pertittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality, such as the construction of additional or replacement wastewater treatment and disposal facilities. 3. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 4. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. 5. Diversion or bypassing of untreated or treated wastewater from the wastewater treatment and/or the spray irrigation / reclaimed water utilization facilities is prohibited. 5. Public access to the spray irrigation / reclaimed water utilization facilities shall be controlled during active site use. Such controls may include the posting of signs that describe the activities being conducted at the facilities. 7. The following buffers shall be maintained: a. 400 feet between the wetted area and any residence or place of public assembly under separate ownership (Fields 1-14) b. 150 feet between wetted area and property lines (Fields 1-14), c. 100 feet between wetted area and wells (Fields 1-14), d. 100 feet between wetted area and drainage ways or surface water bodies (Fields 1-14), e. 50 feet between wetted area and public right of ways (Fields 1-14), f. 100 feet between wetted areas and water supply wells (Fields 15-23), g. 100 feet between wetted areas and waters classified as SA (Fields 15-23), h. 25 feet between wetted areas and surface waters not classified as SA (Fields 15-23), i. 100 feet between wastewater treatment units and wells, j. 50 feet between reclaimed water storage/irrigation ponds and property lines, and k. 50 feet between wastewater treatment units and property lines. Some of the buffers specified above may not have been included in previous permits for this waste treatment and disposal system. These buffers are not intended to prohibit or prevent modifications, which are required by the Division, to improve performance of the existing treatment facility. These buffers do, however, apply to modifications of the treatment and disposal facilities that are for the purpose of increasing the flow that is tributary to the facility. These buffers do apply to any expansion or modification of the irrigation areas and apply in instances in which the sale of property would cause any of the buffers now complied with, for the treatment and disposal facilities, to be violated. The applicant is advised that any modifications to the existing facilities will require a permit modification. 8. The Permittee shall maintain an active cross -connection control program that shall have the following minimum requirements: a. No direct cross -connections shall be allowed between the reclaimed water and potable water systems. b. A reduced pressure principle backflow preventer, an approved air gap separation, or other device approved by the Division of Environmental Health shall be installed at the potable water service connection to the use area where both reclaimed water and potable water are supplied to a reclaimed water use area. The installation of the reduced pressure principle backflow prevention device shall allow proper testing. An air gap separation, approved and regularly inspected by the potable water supplier, shall be provided between the potable water and reclaimed water systems where potable water is used to supplement a reclaimed water system. 9. The following shall be requirements for the reclaimed water distribution, storage, and utilization facilities: a. All reclaimed water valves, storage facilities, and outlets shall be tagged or labeled to warn the public or employees that the water is not intended for drinking. Where appropriate, such warning shall inform the public or employees to avoid contact with the water. b. All reclaimed water piping, valves, outlets, and other appurtenances shall be color -coded, taped, or otherwise marked to identify the source of the water as being reclaimed water. i. All reclaimed water piping and appurtenances shall be either colored purple (i.e., Pantone 522) and embossed or integrally stamped or marked "CAUTION: RECLAIMED WATER — DO NOT DRINK" or be installed with a purple (i.e., Pantone 522) identification tape or polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and repeated every three feet or less. ii. Identification tape shall be at least three inches wide and have white or black lettering on purple (i.e., Pantone 522) field stating "CAUTION: RECLAIMED WATER — DO NOT DRINK." Identification tape shall be installed on top of reclaimed water pipelines, fastened at least every 10 feet to each pipe length and run continuously the entire length of the pipe. iii. Existing underground distribution systems retrofitted for the purpose of distributing reclaimed water shall be taped or other identified as specified above. This identification need to extend the entire length of the distribution system but shall be incorporated within 10 feet of crossing any potable water supply line or sanitary sewer line. c. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits operation by authorized personnel only. d. Above -ground hose bibs (i.e., spigots or other hand -operated connections) shall not be present. Hose bibs shall be located in locked below -grade vaults that shall be clearly labeled as being of non -potable quality. As an alternative to the use of locked below -grade vaults with standard hose bibs services, hose bibs, which can only be operated by a special tool or connected to a special hose connection may be placed in non -lockable underground services boxes clearly labeled as non -potable water. II. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. Upon classification of the wastewater treatment and irrigation facilities by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall designate and employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G .0201. The ORC shall visit the facilities in accordance with 15A NCAC 8G .0204 or as specified in this permit and shall comply with all other conditions specified in these rules. 3. A suitable, year-round vegetative cover shall be maintained on the irrigation areas. 4. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 5. Adequate measures shall be taken to prevent wastewater runoff from the spray/reclaimed water irrigation fields. 6. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 7. The application rate on the wetted area of the existing I10-acre irrigation site (Fields I through 14) shall not exceed a cumulative loading of 91 inches over any twelve (12) month period at an instantaneous application rate such that ponding or runoff does not occur. Each field shall be closely monitored during any spray irrigation event. Should the applied reclaimed water be observed to accumulate on the ground surface, the application rates shall be reduced or irrigation shall be ceased accordingly. 8. An automatically activated standby power source shall be on site and operational at all times. If a generator is employed as an alternate power supply, it shall be tested weekly by interrupting the primary power source. 9. No type of wastewater other than that from the Town of Ocean Isle Beach shall be irrigated onto the wetted areas of the spray irrigation or reclaimed water utilization facilities. 10. Freeboard in any of the lagoons/ponds shall be maintained at greater than two (2) feet. 11. Waste -level gauges, to monitor waste levels in all lagoons/ponds shall be installed. The gauges shall have readily visible permanent markings indicating the maximum liquid level at the top of the temporary liquid storage volume, minimum liquid level at the bottom of the temporary liquid storage volume, and top of the dam elevations. Caution must be taken not to damage the integrity of the liners when installing the gauges. 12. A protective vegetative cover shall be established and maintained on all earthen basin embankments (outside toe of embankment to maximum pumping elevation), berms, pipe runs, erosion control areas, and surface water diversions. Trees, shrubs, and other woody vegetation shall not be allowed to grow on the earthen basin dikes or embankments. Earthen basin embankment areas shall be kept mowed or otherwise controlled and accessible. 13. All wastewater that does not comply with the limit for fecal coliform (daily maximum concentration of 25 per 100 ml) or turbidity (instantaneous maximum of 10 NTU) shall be either irrigated on the existing 110-acre spray irrigation field or routed to the equalization/detention lagoons until such time that the problems associated with the treatment capability of the wastewater treatment plant have been corrected. The wastewater effluent diverted back to the lagoons shall be conveyed to the beadworks of the wastewater treatment facilities for re -treatment through the tertiary plant prior to discharge to the reclaimed water storage lagoons/ponds. Effluent shall not be irrigated directly from the existing 4.68 million gallon lagoon or the dual 7.125 million gallon lagoons. 14. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. III. MONITORING AND REPORTING REQUIREMENTS 1. Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. Influent flow shall be continuously monitored and daily flow values shall be reported on Form NDMR. The Permittee shall install an appropriate flow measurement device consistent with approved engineering and scientific practices to ensure the accuracy and reliability of influent flow measurement. Flow measurement devices selected shall be capable of measuring flows with a maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. The Permittee shall keep records of flow measurement device calibration on file for a period of at least three years. At a minimum, data to be included in this documentation shall be: a. Date of flow measurement device calibration b. Name of person performing calibration c. Percent from true flow 3. C Daily maximum shall be the maximum value of all samples collected during the reporting period. During the remainder of the year, these parameters shall be monitored monthly. ** Triannually sampling shall be conducted during March, July and November. If Groundwater sampling indicates or predicts problems with the compliance with Groundwater Standards, this permit will be modified to include additional and/or more restrictive limitations. The effluent parameters listed above provide compliance limitations to the 81-acre dedicated reclaimed water site (Fields 15-23) only. Wastewater may be irrigated on the 110-acre dedicated irrigation site (Fields 1-14) regardless of the aforementioned compliance parameters. 7 4. Adequate records shall be maintained by the Permittee tracking the amount of wastewater irrigated and/or reclaimed water utilized. These records shall include, but are not necessarily limited to the following information: a. Date and time of irrigation, b. Volume irrigated, c. Zone or area irrigated, d. Length of time zone is irrigated, e. Continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings for each zone, f. Weather conditions, and g. Maintenance and condition of vegetative crops. 5. Freeboard in all lagoons/ponds shall be recorded weekly. 6. Three (3) copies of all monitoring data [as specified in Conditions III(2) and III(3) on Form NDMR-i and three (3) copies of all operation and disposal records [as specified in Conditions III(4) and III(5)) on Forth NDAR-1 shall be submitted monthly on or before the last day of the following month. All information shall be submitted to the following address: NC Division of Water Quality Information Processing Unit 1617 Mail Service Center Raleigh, North Carolina 27699-1617 7. A log of all maintenance activities performed at these facilities shall be kept. This log shall include, but shall not be linvted to, the following items: a. Daily sampling results including settleable matter and dissolved oxygen in the sequencing batch reactor during the aeration and the decanting phases. b. Visual observations of the wastewater treatment and spray irrigation/reclaimed water utilization facilities, including freeboard maintenance of all ponds. c. Record of all preventative maintenance (e.g., changing of filters, adjusting belt tensions, alarm testing, diffuser inspections and cleanings, spray irrigation nozzle replacement, etc.). d. Date of calibration of the flow and turbidity measurement devices. e. Date and results of power interruption testing on automatically -activated stand-by power generation system. S. A record shall be maintained of all residuals removed from this facility. This record shall include the name of the hauler, permit authorizing the disposal or a letter from a municipality agreeing to accept the residuals, date the residuals were hauled, and volume of residuals removed. Within six (6) months of permit issuance, the Permittee shall secure an approved means of residual disposal. 9. An annual representative soils analysis (Standard Soil Fertility Analysis) shall be conducted on each irrigation field in the 110-acre dedicated site (Fields 1-14) and the results maintained on file by the Permittee for a minimum of five years. The Standard Soil Fertility Analysis shall include, but is not necessarily limited to, the following parameters: Acidity Manganese Magnesium Potassium Calcium Percent Humic Matter Sodium Zinc Copper pH Cation Exchange Capacity Phosphorus Exchangeable Sodium Percentage Base Saturation (by calculation) 10. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office, telephone number (910) 395-3900, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations including the occurrence of turbidity values in exceedance of 10 NTU's. Occurrences outside normal business hours may also be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS I. Sampling: a. Monitor wells (MW-1, MW-2, MW-3, MW-4, MW-5 AND MW-6) shall be sampled every March, July and November for the parameters listed below. Prior to sampling the parameters, the measurement of water levels must be taken. The depth to water in each well shall be measured from the surveyed point on the top of the casing. The measuring points (top of well casing) of all monitoring wells shall be surveyed relative to a common datum. For Total Organic Carbon (TOC), if concentrations greater than 10 mg/l are detected in any down. -gradient monitoring well, additional sampling and analysis must be conducted to identify the individual constituents comprising this TOC concentration. If the TOC concentration as measured in the background monitor well exceeds 10 mg/l, this concentration will be taken to represent the naturally occurring TOC concentration. Any exceedances of this naturally occurring TOC concentration in the down -gradient wells shall be subject to the additional sampling and analysis as described above. 0 c. For Volatile Organic Compounds (VOCs) sampled in June, use only one of the following methods: 1) Standard Method 6230D, Practical Quantitation Limit (PQL) at 0.5 ug/L or less 2) Standard Method 6210, PQL at 0.5 ug/L or less 3) EPA Method 8021, Low Concentration, PQL at 0.5 uglL or less 4) EPA Method 8260, Low Concentration, PQL at 0.5 ug/L or less 5) Another method with prior approval by the Aquifer Protection Section Chief. Any of the referenced methods used for VOCs must at a minimum, include all the constituents listed in Table VIII of Standard Method 6230D. Any method used must provide a PQL of 0.5 ug/L or less, which must be supported by laboratory proficiency studies as required by the DWQ Laboratory Certification Unit. Any constituents detected above the Method Detection Limit (MDL) but below the PQL of 0.5 ug/L must be qualified (estimated) and reported. d. Any laboratory selected to analyze parameters must be Division of Water Quality (DWQ) certified for those parameters required. 2. Vertical Separation Requirements: Wastewater irrigation activities shall not occur in areas when the vertical separation between the land surface and the water table is at less than three (3) feet. 3. Applicable Boundaries: a. The COMPLIANCE BOUNDARY and REVIEW BOUNDARY for the waste disposal areas solely associated with reclaimed water irrigation are specified by regulations in 15A NCAC 2H, Waste Not Discharged to Surface Waters, specifically .0219(k)(1)(C)(i)(Ifl). The Compliance Boundary and the Review Boundary for groundwater shall be established at the property boundary. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to remediation action according to 15A NCAC 2L .0106(d)(2). b. The COMPLIANCE BOUNDARY for the dedicated disposal system is specified by regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary for the disposal system individually permitted on or after December 30, 1983 is established at either 250 feet from the waste disposal area, or 50 feet within the property boundary, whichever is closest to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action according to 15A NCAC 2L .0106(d)(2). c. The REVIEW BOUNDARY is established around the dedicated disposal system midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require action in accordance with 15A NCAC 2L .0106(d)(1). 10 V. INSPECTIONS 1_ Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143- 215.6A to 143-215.6C. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B.0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCG010000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 2H .0500. G. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of the project. 7. The annual administering and compliance fee must be paid by the Permittee within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 8. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension.
