SPRAY IRRIGATION/ HIGH RATE INFILTRATION SYSTEM PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
continued operation of a 180,000 GPD high rate infiltration system which consists of the
following:
a 400,000 GPD wastewater treatment facility which consists of a dual -train extended aeration
plant with influent bar screen, aerated surge tank with dual pumps, dual aeration basins with
course -bubble fixed diffusers, aerobic digester and sludge holding tank, dual 28-foot diameter by
12 foot SWD circular clarifiers, a 4-cell tertiary filter; effluent chlorine disinfection system, on -
site standby generator, a dosing pump station which discharges to a 180,000 GPD capacity
wastewater disposal system which consists of a 69,900 square foot rapid infiltration bed; and
construction and operation of spray irrigation facilities to initially provide 76,800 GPD of
additional capacity for disposal of reuse -quality effluent, said additions to consist of a 3.4 MG
effluent storage pond (with 15 days storage capacity based on an ultimate irrigation disposal

rate of 256,800 GPD) and a 1.5 MG (5 day) capacity "upset" detention pond, both unlined; dual
600 GPM submersible irrigation pumps to replace existing pumps in the effluent wet well; meter
for continuous on-line monitoring of effluent turbibity; an emergency bypass system for
diversion of non -reuse quality effluent to the 5-day detention pond in the event of a plant upset;
approximately 2600 Linear feet of 8-inch force main to a 6.3 acre spray irrigation area north of
the existing plant; a 3-zone irrigation system with 59 sprinklers at the new north spray field; a
zoned irrigation system with 40 sprinklers for disposal of treated effluent on 4.7 acres at the
existing plant site; and a 100 KW portable generator to provide emergency standby power for
irrigation;
to serve the Town of Yaupon Beach with no discharge of wastes to the surface waters
pursuant to the application received October 16, 1998 and in conformity with the project plans,
specifications, and other supporting data subsequently filed and approved by the Department of
Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until June 30, 2002, shall void
Permit No. WQ0005790 issued August 29, 1997, and shall be subject to the following specified
conditions and limitations:
SECTION I
PERFORMANCE STANDARDS
1. Upon completion of construction and prior to operation of the newly installed spray
irrigation facilities, a certification must be received from a professional engineer
certifying that the new facilities have been installed in accordance with this permit,
the approved plans and specifications. Mail the certification to the Permits and
Engineering Unit, Division of Water Quality, P. O. Box 29535, Raleigh, NC 27626-
0535.
2. The Wilmington Regional Office, phone no. 910- 395-3900, shall be notified at least
forty-eight (48) hours in advance of operation of the new spray irrigation facilities so
that an in -place inspection can be made. Such notification to the regional supervisor
shall be made during normal office hours from 8:00 a.m. until 5:00 p.m. on Monday
through Friday, excluding State Holidays.
3. The permitted facilities, including the new spray irrigation system, shall be properly
maintained and operated at all times so that there is no discharge of wastewater to
the surface waters, which will render them unsatisfactory for normal use.

4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions or failure of the irrigation areas or infiltration basin to
adequately absorb the treated wastewater, the Permittee shall take immediate action
to correct the problem, including such actions as may be required by the Division of
Water Quality.
5. The issuance of this permit shall not relieve the Permittee of the responsibility for
damages to groundwater or surface water resulting from the operation of this
facility.
6. The residuals generated from these treatment facilities must be disposed of in
accordance with General Statute 143-215.1 and in a manner approved by the North
Carolina Division of Water Quality.
7. Diversion or bypassing of the untreated wastewater from the treatment facilities is
prohibited.
8. Adequate measures shall be taken to direct stormwater from the high rate infiltration
area and to prevent wastewater run-off.
9. The following buffers shall be maintained:
a) 500 feet between high rate infiltration unit and any public surface water
supply or public shallow potable water well,
b) 100 feet between high rate infiltration unit and any "SA" classified surface
waters,
c) 50 feet between high rate infiltration unit and any other surface waters,
d) 100 feet between high rate infiltration unit and property lines,
e) 50 feet between treatment units and property lines,
f) 50 feet between high rate infiltration unit and other treatment units and public
right of ways, and
g) 200 feet between high rate infiltration unit and any groundwater drainage
system,
h) 100 feet between the edge of spray irrigation wetted area and any "SA"
surface waters,
i) 100 feet between the edge of spray irrigation wetted area and any potable
water supply well,
j) 10 feet between the edge of spray irrigation wetted area and any nonpotable
well.

SECTION II
OPERATION AND MAINTENANCE REQUIREMENTS
The facilities shall be properly maintained and operated at all times.
2. The Permittee shall employ a certified wastewater treatment plant operator to be in
responsible charge of the wastewater treatment facilities, The operator must hold a
certificate of the grade at least equivalent to the classification assigned to the
wastewater treatment facilities by the Certification Commission. The Permittee
must also employ a certified back-up operator of the appropriate type and grade to
comply with the conditions of Title 15A, Chapter 8A, .0202. The ORC of the
facility must visit each Class I facility at least weekly and each Class II, III, and IV
facility at least daily, excluding weekends and holidays, and must properly manage
and document daily operation and maintenance of the facility and must comply with
all other conditions of Title 15A, Chapter 8A, .0202.
3. Loading of the high rate infiltration basin with treated effluent shall not exceed
180,000 GPD. The permittee shall periodically drain and clean the infiltration basin
and keep records of these maintenance activities. The Permittee may request an
increased loading limit in the future based on demonstrated improvements in
performance of the high rate infiltration system.
4. Disposal by spray irrigation shall initially be limited to 26,800 GPD. The following
maximum application rates shall apply to the spray irrigation, system:

The Permittee shall maintain records of all spray irrigation activity and may request
an increased irrigation disposal limit in the future based on demonstrated satisfactory
performance.

5. A suitable vegetative cover shall be maintained at all times on the spray irrigation
areas.
6. The facilities shall be effectively maintained and operated as a non -discharge system
to prevent the discharge of any wastewater outside of the high rate infiltration
disposal area and spray irrigation areas.
7. Spray irrigation shall not be performed during inclement weather or when the
ground is in a condition that will cause runoff.
8. No traffic or equipment shall be allowed on the disposal areas except while
installation occurs or while normal maintenance is being performed.
9. Minimum free board of 2 feet shall be maintained below the top of the containment
berms of the high rate infiltration basin, irrigation storage pond, and 5-day detention
pond.
10. The screenings removed from the wastewater treatment plant shall be properly
disposed in a sanitary landfill or by other means which have been approved by this
Division.
11. An automatically activated standby power source shall be on site and operational at
all times. If a generator is employed as an alternate power supply it shall be tested
weekly by interrupting the primary power source.
12. The flow measurement device shall be calibrated annually by the representative of a
firm which is routinely engaged in the calibration of flow measurement devices.
Records of this calibration, including all information pertinent to the calibration,
shall be available during any inspection by Division staff.
13. The application of chemicals to the infiltration bed is expressly prohibited unless
otherwise approved by the Wilmington Regional Office.
14. Diffusers shall be cleaned as needed to ensure that adequate aeration is provided.
Records of this maintenance shall be maintained by the permittee.
15. The rapid infiltration system shall be inspected daily. A records of all maintenance
shall be recorded in the daily operations log for the facility.

SECTION III
MONITORING AND REPORTING REQUIREMENTS
1. Any monitoring deemed necessary by the Division of Water Quality to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
2. As an indicator of proper operation and maintenance, the facility shall produce an
effluent in compliance with the following limitations:

The effluent from the subject facilities shall be monitored by the Permittee at the
point prior to discharge to the infiltration basin or irrigation storage lagoon for the

The effluent pH shall not be less than 6.9 standard units nor greater than 9.0 standard units.
* 2/1\4onth sampling frequency only during the months of April through October.
During the remainder of the year, these parameters shall be monitored monthly.
** Triannual sampling shall be conducted during February, June and October.
If groundwater sampling indicates or predicts problems with compliance with of the
Groundwater Standards, this permit will be modified to include additional and/or
more restrictive limitations.
3. Three (3) copies of all effluent monitoring data (as specified in condition III 2) on
Form NDMR-1 shall be submitted on or before the last day of March, July and
November. All information shall be submitted to the following address:

4. A record shall be maintained of all residuals removed from this facility. The record
shall include the name of the hauler, the permit authorizing the disposal or a letter

from a municipality agreeing to accept the residuals, the date the residuals were
hauled and the volume of residuals removed.
5. A maintenance log shall be maintained at this facility including, but not limited to,
the following items:
a. Daily sampling results including residual chlorine, settleable matter, and
dissolved oxygen in the aeration basin and at the clarifier weir;
b. Visual observations of the plant and plant site;
C. Record of preventative maintenance (changing of filters, adjusting belt
tensions, alarm testing, diffuser inspections and cleanings, etc.);
d. Date of calibration of flow measurement device; and
e. Date and results of power interruption testing on alternate power supply.
6. Adequate records shall be maintained by the Permittee tracking the amount of
wastewater disposed by spray irrigation. These records shall include, but are not
necessarily limited to, the following information:
a. date of irrigation,
b. volume of wastewater irrigated
C. field irrigated,
d. length of time field is irrigated,
C. continuous weekly, monthly, and year to date hydraulic (inches/acre) loadings
for each field,
f. weather conditions, and
g. maintenance of cover crops.
7. NONCOMPLIANCE NOTIFICATION:
The Permittee shall report by telephone to the Wilmington Regional Office,
telephone no. (910)395-3900, as soon as possible, but in no case more than 24 hours
or on the next working day following the occurrence or first knowledge of the
occurrence of any of the following:
a. Any occurrence at the wastewater treatment facility which results in the
treatment of significant amounts of wastes which are abnormal in quantity or
characteristic, such as the dumping of the contents of a sludge digester, the
known passage of a slug of hazardous substance through the facility; or any
other unusual circumstances.

b. Any process unit failure, due to known or unknown reasons, that render the
facility incapable of adequate wastewater treatment such as mechanical or
electrical failures of pumps, aerators, compressors, etc.
Any failure of a pumping station, sewer line, or treatment facility resulting in
a by-pass directly to receiving waters without treatment of all or any portion
of the influent to such station of facility.
d. Any time that self -monitoring information indicates that the facility has gone
out of compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in
letter form within fifteen (15) days following first knowledge of the occurrence.
This report must outline the actions taken or proposed to be taken to ensure that the
problem does not recur.
Section TV
GROUNDWATER REQUIREMENTS
(1) Within. 2 % years of initiating operation of the irrigation storage pond/spray irrigation
activities, the Town of Yaupon Beach must present a groundwater impact analysis report to
the Division of Water Quality/Groundwater Section. This report must include (but not
necessarily be limited to) the following;
(a) a summary and discussion of the groundwater compliance data collected to date at
all of the monitoring wells, and
(b) a groundwater mounding analysis which considers the infiltration pond, the
irrigation storage pond, and the irrigation zones 4, 4a, and 5. This analysis must be
calibrated as closely as possible to historical groundwater level measurements while
using historical pond loading rates.
The purpose of the groundwater impact analysis is to accurately assess the combined
groundwater impacts of the infiltration pond, and irrigation storage pond, and the spray
irrigation zones 4, 4a, and 5.
(2) Within sixty (60) days of permit reissuance, monitoring wells MW-1 and MW--3 shall be
abandoned according to 15A NCAC 2C .0113 (Abandonment of Wells) in the 15A NCAC
2C .0100 Well Construction Standards.

(3) Within sixty (60) days of permit reissuance, monitoring wells MW-4 shall be abandoned
according to 15A NCAC 2C .0113 (Abandonment of Wells) in the 15A NCAC 2C .0100
Well Construction Standards unless the Town of Yaupon Beach desires to retain the
monitoring well for their own future monitoring needs.
(4) Prior to beginning waste disposal operations in spray irigation zone 4 & 5, one monitoring
well, named MW-5, shall be installed to monitor groundwater quality. And one additional
monitoring well, named MW-6, shall be installed to monitor the local groundwater table.
The wells shall be constructed such that the water level in the well is never above or below
the screened (open) portion of the well at any time during the year. The general location
and name for each well is marked on Attachment A. The monitoring well MW-5 shall be
located at the review boundary, constructed in accordance with this permit, and approved
by the Wilmington Regional Office. And monitoring well MW-7 shall be located down -
gradient of the irrigation storage pond, constructed in accordance with this permit, and
approved by the Wilmington Regional Office.
(5) All wells that are constructed for purposes of groundwater monitoring shall be constructed
in accordance with 15A NCAC 2C .0108 (Standards of Construction for Wells Other than
Water Supply) and any other state and local laws and regulations pertaining to well
construction.
(6) The Wilmington Regional Office, telephone number (910) 395-3900, shall be notified at
least forty-eight (48) hours prior to the construction of any monitoring well so that an
inspection can be made of the monitoring well locations. Such notification to the regional
groundwater supervisor shall be made during the normal office hours from 8:00 a.m. until
5:00 p.m. on Monday through Friday, excluding state holidays.
(7) Within sixty (60) days of completion of monitoring wells MW-5 and MW-6, the permittee
§hall submit two original copies of a scaled topographic map (scale no greater than 1":100')
signed and sealed by a professional engineer or a state licensed land surveyor that indicates
all of the following information:
a. the location and identity of each monitoring well,
b. the location of all components of the waste disposal system,
C. the location of all property boundaries,
d. the latitude and longitude of the established horizontal control monument,
e. the relative elevation of the top of the well casing (which shall be known as the
"measuring point"), and
f. the depth of water below the measuring point at the time the measuring point is
established.

This survey shall be conducted using approved practices outlined in North Carolina
General Statutes Chapter 89C and the North Carolina Administrative Code Title 21,
Chapter 56. The surveyor shall establish a horizontal control monument on the property of
the waste disposal system and determine the latitude and longitude of this horizontal
control monument to a horizontal positional accuracy of +/-10 feet. All other features
listed in a. through e. above shall be surveyed relative to this horizontal control monument.
The positional accuracy of features listed in a. through e. above shall have a ratio of
precision not to exceed an error of closure of 1 foot per 10,000 feet of perimeter of the
survey. Any features located by the radial method will be located from a minimum of two
points. Horizontal control monuments shall be installed in such a manner and made of
such materials that the monument will not be destroyed due to activities that may take
place on the property. The map shall also be surveyed using the North American Datum of
1983 coordinate system and shall indicate the datum on the map. All bearings or azimuths
shall be based on either the true or NAD 83 grid meridian. If a Global Positioning System
(GPS) is used to determine the latitude and longitude of the horizontal control monument,
a GPS receiver that has the capability to perform differential GPS shall be used and all data
collected by the GPS receiver will be differentially corrected.
The maps and any supporting documentation shall be sent to the Groundwater Section, NC
Division of Water Quality, P.O. Box 29578, Raleigh, NC, 29626-0578.
{8) Within thirty (30) days of completion of all well construction activities, a certification
must be received from a professional engineer or a licensed geologist certifying that the
monitoring wells are located and constructed in accordance with the Well Construction
Standards (i 5A NCAC 2C) and this permit. This certification should be submitted with
copies of the Well Completion Form (GW-1) for each well. Mail this certification and the
associated GW-1 forms to the Permits and Compliance Unit, Groundwater Section, P.O.
Box 29578, Raleigh, NC, 27626-0578.
(9) For the initial sampling of the well as specified elsewhere in the permit, the permittee shall
submit a copy of the GW-1 Form (Well Completion Form) with the Compliance
Monitoring Form (GW-59) for that well. Compliance Monitoring Forms that do not
include copies of the GW-1 form will be returned to the permittee without being
processed. Failure to submit these forms as required by this permit may result in the
initiation of enforcement activities pursuant to NC General Statutes 143-215.6.

(10) Monitoring well MW-5 shall be sampled initially after construction (and prior to spray
irrigation of zones 4 & 5 and bringing the 5-day upset pond on-line) for the following
parameters:
Water Level pH
Chloride Total Dissolved Solids (TDS)
Fecal Coliforms Total Organic Carbon (TOC)
Nitrate (NOD Total Ammonia
"Volatile Organic Compounds" (VOCs) by one of the following methods
(A) Standard Method 6230D, PQL at .5 µg/L or less
(B) Standard Method 621 OD, PQL at .5 µg/L or less
(C) EPA Method 8 02 1, Low Concentration, PQL at .5 µg/L or less
(D) EPA Method 8260, Low Concentration, PQL at .5 µg/L or less
(E) Another method with prior approval by the Groundwater Section Chief
Any method used must meet the following qualifications:
(1) A laboratory must be DWQ certified to run any method used.
(2) The method used must, at a minimum, include all the constituents listed in
Table VIII of Standard Method 6230D.
(3) The method used must provide a PQL of .5 µg/L or less which must be
supported by laboratory proficiency studies as required by the DWQ
Laboratory Certification Unit. Any constituents detected above the MDL but
below the PQL of .5 µg/L must be qualified (estimated) and reported.
The measurement of water levels must be made prior to sampling for the remaining
parameters. The depth to water in each well shall be measured from the surveyed point on
the top of the casing.
The measuring points (top of well casing) of the monitoring well shall be surveyed to
provide the relative elevation of the measuring point for each monitoring well.
If any volatile organic compounds are detected by the methods listed, then the Wilmington
Regional Office groundwater supervisor (telephone number: 910-395-3900) must be
contacted immediately for further instructions regarding any additional follow-up analyses
required. The results of all initial and follow-up analyses must be submitted
simultaneously.

The results of the sampling and analysis must be received on Form GW-59 (Groundwater
Quality Monitoring: Compliance Report Form) by the Groundwater Section, Permits and
Compliance Unit, P.O. Box 29578, Raleigh, N.C. 27626-0578 on or before the last
working day of the month following the sampling month.
(11) Monitoring wells MW-2 and MW-5 shall be sampled every February, June and October for
the following parameters:
Water Level pH
Chloride Total Dissolved Solids (TDS)
Fecal Coliforms Total Organic Carbon (TOC)
Nitrate (NOD Total Ammonia
"Volatile Organic Compounds" (VOCs) - In October Only by one of the following
methods.
(A) Standard Method 623OD, PQL at .5 ug/L or less
(B) Standard Method 6210D, PQL at .5 /.cg/L or less
(C) EPA Method 8021, Low Concentration, PQL at .5 ,ug/L or less
(D) EPA Method 8260, Low Concentration, PQL at.5,ug/L or less
(E) Another method with prior approval by the Groundwater Section Chief
Any method used must meet the following qualifications:
(1) A laboratory must be DWQ certified to run any method used.
(2) The method used must, at a minimum, include all the constituents listed in
Table VIII of Standard Method 6230D.
(3) The method used must provide a PQL of .5 kig/L or less which must be
supported by laboratory proficiency studies as required by the DWQ
Laboratory Certification Unit. Any constituents detected above the MDL but
below the PQL of .5 ,ug/L must be qualified (estimated) and reported.
The measurement of water levels must be made prior to sampling for the remaining
parameters. The depth to water in each well shall be measured from the surveyed point on
the top of the casing.
The measuring points (top of well casing) of the monitoring well shall be surveyed to
provide the relative elevation of the measuring point for each monitoring well.

If any volatile organic compounds are detected by the methods listed, then the Wilmington
Regional Office groundwater supervisor (telephone number. 910-395-3900) must be
contacted immediately for further instructions regarding any additional follow-up analyses
required. The results of all initial and follow-up analyses must be submitted
simultaneously.
The results of the sampling and analysis must be received on Form GW-59 (Groundwater
Quality Monitoring: Compliance Report Form) by the Groundwater Section, Permits and
Compliance Unit, P.O. Box 29578, Raleigh, N.C. 27626-0578 on or before the last
working day of the month following the sampling month.
(12) Monitoring well MW-6 shall be sampled monthly for the following parameter:
Water Level
The depth to water in each well shall be measured from the surveyed point on the top of

other GW-59 forms (which are sent in three times/year).
(13) In accordance with 15A NCAC 211.0219(k)(1)(C)(i)(In), the Compliance Boundary and
Review Boundary for disposal systems using reclaimed domestic or municipal water are
both established at the property boundary. An exceedance of Groundwater Quality
Standards at or beyond the Compliance/Review Boundaries is subject to immediate
remediation action in accordance with 15A NCAC 2L.0108, in addition to the penalty
provisions applicable under General Statute 143-215.6A(a)(1).
(14) Any additional groundwater quality monitoring, as deemed necessary by the Division, shall
be provided.

SECTION V
INSPECTIONS
1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee
to insure proper operation of the subject facilities.
2. The Permittee or his designee shall inspect the wastewater treatment and disposal
facilities to prevent malfunctions and deterioration, operator errors and discharges
which may cause or lead to the release of wastes to the environment, a threat to
human health, or a nuisance. The Permittee shall keep an inspection log or summary
including at least the date and time of inspection, observations made, and any
maintenance, repairs, or corrective actions taken by the Permittee. This log of
inspections shall be maintained by the Permittee for a period of three (3) years from
the date of the inspection and shall be made available upon request to the Division of
Water Quality or other permitting authority.
3. Any duly authorized officer, employee, or representative of the Division of Water
Quality may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the disposal site and facility at any reasonable time
for the purpose of determining compliance with this permit; may inspect or copy any
records that must be kept under the terms and conditions of this permit; or may
obtain samples of groundwater, surface water, or leachate.
SECTION VI
GENERAL CONDITIONS
1. This permit shall become voidable unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans, specifications, and other
supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. This permit is not transferable. In the event there is a desire for the facilities to
change ownership, or there is a name change of the Permittee, a formal permit
request must be submitted to the Division of Environmental Mangement
accompanied by an application fee, documentation from the parties involved, and
other supporting materials as may be appropriate. The approval of this request will
be considered on its merits and may or may not be approved.

4. Failure to abide by the conditions and limitations contained in the permit may
subject the Permittee to an enforcement action by the Division of Water Quality in
accordance with North Carolina General Statute 143-215.6.
5. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by other
government agencies (local, state, and federal) which have jurisdiction.
6. Prior to any transfer of this land, a notice shall be given to the new owner that gives
full details of the materials applied at this site.
7. A set of approved plans and specifications for the subject project must be retained by
the Permittee for the life of the project.
8. The Permittee, at least six (6) months prior to the expiration of this permit, shall
request its extension. Upon receipt of the request, the Commission will review the
adequacy of the facilities described therein, and if warranted, will extend the permit
for such period of time under such conditions and limitations as it may deem
appropriate.

ENGINEER'S CERTIFICATION
1, , as a duly registered Professional Engineer in
the State of North Carolina, having been authorized to observe (periodically/weekly/full time)
the construction of the modifications and improvements to the Yaupon Beach Wastewater
Treatment Plant, located on Fish Factory Road in Brunswick County for the Town of Yaupon
Beach, hereby state that, to the best of my abilities, due care and diligence was used in the
observation of the following construction:
spray irrigation facilities to initially provide 76,800 GPD of additional capacity for disposal of
reuse -quality effluent, said additions to consist of a 3.4 MG effluent storage pond (with 15 days
storage capacity based on an ultimate irrigation disposal rate of 220,000 GPD) and a 1.5 MG (5
day) capacity "upset" detention pond, both unlined; dual 600 GPM submersible irrigation pumps
to replace existing pumps in the effluent wet well; meter for continuous on-line monitoring of
effluent turbibity; an emergency bypass system for diversion of non -reuse quality effluent to the
5-day detention pond in the event of a plant upset; approximately 2600 linear feet of 8-inch force
main to a 6.3 acre spray irrigation area north of the existing plant; a 3-zone irrigation system with
59 sprinklers at the new north spray field; a zoned irrigation system with 40 sprinklers for
disposal of treated effluent on 4.7 acres at the existing plant site; and a 100 KW portable
generator to provide emergency standby power for irrigation.
