Church, Jr., Director New Hanover County Department of Environmental Management 3002 U.S. Highway 421 North Wilmington, North Carolina 28401 Subject: Permit No. WQ0005745 The County of New Hanover Pump and Haul New Hanover County Dear Mr. Church: In accordance with your application received October 25, 1991, we are forwarding herewith Permit No. WQ0005745, dated November 1, 1991 to the County of New Hanover for a temporary Pump and Haul operation to transport refuse wastewater from the County's Waste -To -Energy Facility to the County owned Secure Landfill Wastewater Treatment Facility. This Permit shall be effective from the date of issuance until December 2, 1991 and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, North Carolina 27511-7447. Regional Supervisor APH:PER:DSK3:WQ5745.PH cc: Dennis Burks, New Hanover County Facilities Assessment Unit Permits & Engineering Wilmington Regional Files Central Files NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION RALEIGH DEPARTMENT OF ENVIRONMENT, HEALTH AND NATURAL RESOURCES RALEIGH PUMP AND HAUL PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations: PERMISSION IS HEREBY GRANTED TO The County of New Hanover for a temporary Pump and Haul operation to transport refuse wastewater from the County's Waste -To -Energy Facility at a rate of 15,000 GPD, totaling approximately 100,000 gallons to the County owned Secure Landfill Wastewater Treatment Facility in accordance with the application submitted to the Department of Environment, Health and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until December 2, 1991, and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the subject pump and haul activities are carried out in a manner which has been approved by this Division. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. 5. No type of wastewater other than that from The New Hanover County Waste -To -Energy Facility refuse pits shall be included in the pump and haul activities. Permit No. WQ0005745 Page 2 6. This permit shall become voidable unless the agreement between New Hanover County Waste -To -Energy Facility and MCO Transport, Incorporated for the collection, and transportation of the wastewater and the agreement between New Hanover County Secure Landfill and the New Hanover County Waste -To -Energy Facility is in full force and effect. 7. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall cease operation of all pump and haul activities and take such immediate corrective action, as may be required by this Division. 8. This pump and haul permit shall not be renewed. 9. The wastewater collected by this system shall be treated in the New Hanover County Secure Landfill Wastewater Treatment Facility. 10. The Permittee is liable for any damages caused by a spill or failure of the pump and haul operations. 11. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater collection facilities at any reasonable time for the purpose of determining compliance with this permit may inspect or copy any records that must be kept under the terms and conditions of this permit and may obtain samples. 12. An accurate record of the pump and haul activities must be maintained by the Permittee indicating: a) date wastewater is removed from the facility. b) volume of wastewater removed. c) status of permanent disposal option. These records shall be submitted to the Wilmington Regional Office of the Division of Environmental Management on or before the fifteenth (15) day of the month following the issuance of this permit and each month thereafter. 13. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 15. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H. 0205.(c)(4). Permit issued this 1st day of November, 1991.
