tanks-, dual 4,765 gallon clarifiers; duar27Cr-CFM'blowers; dual terdaary€tltemeach with an area of 18 square feet;
a,2,700 gallon clear well; a 2,890 gallon mud well; dual 270- GPM back -wash -pumps; dual 18 GPM back wash
return pumps; a 1,380 gallon chlorine contact tank; dual tablet type chrorinators; an 8,500 gallon dosing tank with
dual 85 GPM dosing pumps`and hia water -alamis-, two rotary distributors each with a diameter of 80 feet; a 30
kW -auxiliary power generator to ser_vr. the. treatment plant and a I0 kW portable auxiliary power generator to
serve the treatment -plant -and a 10 kW gortable.auxiliary.power generator to serve the pump stations; and all
associated piping, valves, and appurtenances to serve -Cape Emerald Subdivision., with no discharge of wastes to
the surface waters; pursuant- to- the- appheation received April 5, 2005, and -in conformity with the project plan,
specifications, and other supporting data subsequently filed and approved b-y the Department of Environment and
Natural Resources and considers" part of this permit.
This permit shall be e€€eetive frorn the date of issuance_untiL April 30, 2010, shall void Permit No.
WQ0005173 issued November.6,,2000; and shall be subject to the following specified conditions and limitations:
I. PERFORMANCE STANDARDS
1. In the event that the facilities -fill to..perfot-rn-.satisfactorily; including the creation of nuisance
conditions; the- -tale 4nmediate correctivz actions,.including those actions that may be
required by the Divisiorr- of, Water Quality (DivisionX such as the construction of additional or
replacement wastewater treatment or disposal facilities.
2. This permit shall become voidable if the soils fail to adequately assimilate the wastes and may be
rescinded unless the facilities are installed, maintained, and operated in a manner which will protect
the assigned water quality standards of the surface waters and ground waters. The ponding of
wastewater on the surface of the distribution field when the dosing cycle commences shall be
considered as evidence of failure of the soils.to adequately. assimilate the wastewater. Additionally,
such failure shall be interpreted as a violation -of this permit-conditiom
3: The residuals generated from these .treatment facilities must be disposed in accordance with General
Statute 143-215. Laud in.a manner. approved by the. Division.
4. Adequate measures shall - be taken to divert stormwater from the high rate infiltration area and to
prevent wastewater runoff.
Diversion or bypassing of the -untreated wastewater from the treatrnen� facilities is prohibited.
6. The issuance of this-permit- shall not relieve_ the Termittm cif the responsibility for damages to surface
or groundwaters.resulting_fromthe operation of this facility.
7. The following buffers shall be maintained:
a. 10 feet between high, rate- infiltration unit -and any on -property residential units that are to be sold
(e.g., condominiums, subdivisions),
b. 500 feet between hi& rate infiltration unit and'any. impounded'public surface water supply or
public shallow (less than 50 -feet sleep) ground water supply,
c. 100 feet between highrate`infiltration unit and any private or public water supply source,
d. 200 feet betweenhigh-rate-infiltration unit and-any-streamsclassified as WS or B,
e. 200 feet from mean high-waterbetween highrate infiltration unit and any "SA" or "SB" classified
surface waters;
f. 200 feet from normal high water between high rate infiltration unit and any other stream, canal,
marsh, or coastal waters,
g. 200 feet from -normal high waterbetween high rate infiltration unit and any CIass I or Class II
impounded reservoir used as a source of drinIdng water,
h. 200 feet between_high_rate infiltration unit and -any other, lake or impoundment,
i. 200 feet between high rate MItration unit and any Drainage -systems (ditches, drains, surface
water diveFsions; ete.)-and- from .any groundwater lowering and surface drainage ditches,
j. 50 feet -between -high -rate -infiltration unit and property lines,
k. 50 feet betw=rUxsUT enVm-fits and property lines, and
h. 50 feerbetween High rare infilfration unit and public aright of ways.
Some of the buff-ers specified above may -not have been included -In previous permits for this waste
treatment and disposal system. These.. buffers.are.not,iatended to prohibit or prevent modifications,
which are requiresi.hy the D"ion,.to improve performance of the existing treatment facility. These
buffers do, .hnwe_ver,apply- to iuedifications of the treatment an& disposal facilities which are for the
purpose of. incTeas�ing the flow that- is - tributary to the • facility. These buffers do apply to any
expansion or -modification of the -high rate infiltration areas and' -apply in instances in which the sale of
property would` cause- any ofthu buffers now compried'with, for the treatment and disposal facilities,
to be violated: The appricantis ad-vised`that any modifications to the existing facilities will require a
permit modification.
A usable green area shall be maintained for wastewater. disposal.:. The green area shall have the
capability, of accommodating -the. average daily. flow of the -facility being servers without exceeding
the ioading.rates of the green area - A,"green- area", as defined -in -15A NCAC 2H .0404 (g)(7), is an
area suitable for waste.disposal, either in its -natural state or which has been modified by planting a
vegetative-cever of grasses-er low growing shrubbery.
II. OP RATION AND MAINTENANCE RE In MENTS
1. The facilities shall be properly maintained and operated at all times.
2: Upon --classification e€ the wastewater treatment and spray, irrigation. facilities by the Water Pollution
C-onttol System Operatom Certification Commission (WRCSOCC), -the. Permittee shall designate and
employ a certif e(I operawrtu ber it responsible charge (ORCr% Q_ d-one or more certified operator(s)
to be backup ORC(s) of the facilities in accordance -with 15A NCAE 8G ,0201. The ORC shall visit
the facilities in accordance with 15Ai NCAC SG .0204 6r as specified in this -permit and shall comply
with all other con-dition -specified in these rules.
3. The application rates -for- the high rate infiltration system shall not exceed 5.0 GPDlsquare foot.
4. The facilities shall -be -e€fectively maintained and operated as. a non -discharge system to prevent the
discharge of any wastewateroutside-of the high rate infiltration disposal area, which result from the
operation of this facility.

5. No traffic or eft. shall be- allawed' on. the disp�osaf area except while- installation occurs or
while normal maintenance is being performed.
6. The rotary distributimr fiel& shall -be- raked'twice_ weekly during the months April through October
and once a week duzizrg dm months of November through March.
7. The screenings remaved from -the -wastewater treatment plant shall be properly disposed in a sanitary
landfill or by other meters that lave -been approved by this Division.
8. Vegetative -grawtlr must-bg kept" out_ of the rotary distdbution areas at all times. All vegetation must
be removed-manually-sa that n4rimal distrirbance_v4I1,occur to the disposal area.
9., The applica6ot-ai"chcailears-tathe.diat<ibution field(&) is -expressly prohibited.
10. An automatically activated standby- power source .shalLbe- on. site and operational at all times. If a
generator is employed -as an- alternate- power supply, 'it shall'be.tested.weekly by interrupting the
primary power source.
11. Diffusers- shall -be -cleaned as -needled to ensure -that adequateaerationis provided. Records of this
maintenance shall be7mah t med-by-the Perrnittee.
]'l: The chlorine tablets used in tl►e disinfection, facility shall;. be of the kind and type specified in the
plans and 'specifications approved by the Division.
W. MONITORING.AND REPMTTIENNG REOMUMENTS
1: Any monitoring deemed nee essary-by the Division to insure surface and ground water protection will
be established and un-acceptable-sampling reporting schedule shall be followed.
2. Influent- flow shall be coutinuousiy monitored and daily flow values shall be reported on Form
NDMR.
If not already installed, the Permittee shall install an appropriate flow measurement device consistent
with approved engineering and scientific practices to ensure the accuracy and reliability of influent
flow measurement. plow measurement devices selected shall be capable of measuring flows with a
maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of
once per year, andmaintained to ensure that the accuracy of the measurements is consistent with the
accepted capability ofthartype of device. Records of flow measurement device calibration shall be
kepron-flile by the Piermittoe for a period of at least three years. At a minimum, data to be included i.^.
this documentation shallFbe:
a, Date of flow measurement device calibration
b. Name ofperson-performing calibration
c. Percent from true flow
If not already constructed, plans and specifications for the flow measuring device shall be prepared by
a licensed Professional Engineer. and submitted to the appropriate regional office 30 days prior to
installation. The_ flow. measuring device shall be installed within 1 year-ef.the date of this permit.
3. As an indicator crf proper operation, andmaintenance,. the .facility small produce an effluent in
compliance with the following limitations:

5, A record shall be. maintained ofall.residuals removed from this facility. The record shall include the
name of the hauler, the permit. authorizing the disposal. -on a. letter from a municipality agreeing to
accept the residuals, the -date the -residuals were hauled; and.the'volume of residuals removed,
6. A - maintenance —log shall be maintained at this. facility including; but not limited to, the following
items:
a. Daily sampling results, in_dissolved oxygea in the -aeration basin and at the clarifier weir;
b. Visual observations of the plant and plant site;
c... Record .of preventative maintenance (changing of filters, adjusting belt tensions, alarm testing,
diffuser inspections and cleanings, etc.);
d. Date ofcalibration of flow measurement device;
e. Date and results of power interruption testing on alternate power supply; and
f, Date fields wereraked and arms inspected.
IV.
7. Noncompliance Notification:
The Permittee shall report by telephone to the Wilmington Regional Office, telephone number (910)
395-3900, as soon as possible, but in no case more than 24 hours or on the next working day
following the occurrence or first knowledge of the occurrence of any of the following:
a. Any-occurrencc at the wastewater treatment.facility. whiff hhxesults- in the treatment of significant
amounts of wastes whicl:.are.ahn =nal-in quan ity.or=claaEteriWc, such as the dumping of the
contents (if .a.ihasin or tank, the. known passage of a: -slug of- hazardous substance through the
facility, or any otl= unusual circumstances,
b. Any process'unit failure,'due to known or unknown reasons, that renders the facility incapable of
adequate wastewater treatment,. such as mechanical or electrical failures of pumps, aerators,
compressors, ete.; .
c, Any failure of a pumping, station,. sewer line, or treatment facility. resulting in a by-pass of all or
any portion of the influent to such station or facility; or
d. Any time that self -monitoring information indicates. C1iatthe facility isnot in compliance with its
permit limitations,
Occurrences outside, normal .business hours may also. U. reported to the Division's Emergency

GROUNDWATER REQUrREMENTS
1. Well Construction Requirements:

installed to monitor groundwater quality, The,well shall be constructed such that the water level
in the,wel. is never abate or below.the screened (open) portion of the well at any time during the
year, The -general location of the well -is marked on -Figure 2. 'Mc -monitoring well shall be located
at the Rev4ew Boundary, constructed in accordance-; with' this- permit, and approved by the
Wilmington final Off =. -,
b, The new well must be constructed by either aNorth Carolina .Certified Weil Contractor, the
property owner, or the property lessee. according -,.to General - Statutes 87-98,4(bx2), If the
construction is_ not perfarmed..hy a certified well. contractor, the property owner or lessee,
provided_ that they are a natural person, must physically perform -the actual well construction
activities,. The well - rnum be` constructed according to -the- North- Carolina Well Construction
Standards (I SA NCAC .0-t&&ra:mi7any local county rules,

Monday through Friday, excluding states holidays.
2. Sampling Requirements:
a. Groundwater monitorin& wells l -1, .MW-3. MW-4 and new well MW-5 shall be sampled
every March, July, and November far the parameters listed -below:

Water levels in the - groundwater monitoring wells, shall be measured prior to sampling the
groundwater- for the remaining_�paiameters. -The -depth to water in each well shall be measured
from the surveyed Mnt .othe- toprof the -casing, which shall be --surveyed .relative to a common
datum-
b. Volatile organic eomgaunds-CVOCs).-shall be analyzedusing one ofthe following methods:
i. Standard Mdhad 6230D{PQL at 0.5 ug/L or less),
ii. Standard Method--62-10 CPQL at 0.5 ug/L or less); -
iii. EPAMethod 8-2-1-(LowConcentration,"P.QL at 0.5 ug/L or less);
iv. EPA -Method 8-260 �Law eoncentration,P%; at 0.5 ug/L or less);
V. Another method with.prior-approvatby.the,D.ivisian....
Any of the refereneed-methods used for VOCs shall, at a minimum, include, all of the constituents
listed in Table VIIi of Standard:Methods .6230D.' The method used shall provide a PQL at 0.5
ug/L or less, ,vd&b- shall be-. supported by laboratory proficiency studies as required by the
Division's . Laboratory- CcA fication- Unit. Any constituents-deteeted above the MDL, but below
the PQL.at 0.5-ug/L, small -be quali ie&(t e.-, estimated) and reported.
c. If total •organic-earbtm (TECI concentrations- greater thanz 1Q milligrams per liter are detected in
any downgradient groundwater monitoring. well, additional: sampling and analysis shall be
conducted to. identify the: iEn&vidual constituents-comprising-this-TOC concentration. If the TOC
emc ntratinn. as- a=sured. iri the background well exceeds--10 milligrams per liter, this
=ice=atioa -shag be. taken to represent- tie- -antrually-occurring TOC concentration. Any
exceedances•-af this naturaily-occurring TOC-. concentration in downgradient wells shall be
sub ject-to-the additiomt sampling and analysis as described in this permit.
d. Any laboratory seiccted- to- analyze parameters -sbalL b& Division -certified for those parameters
required.
3. Reporting /Documentation Requirements:
a. The results- of the sampling_ and analysis:.shall .he. rex__ce va-on- the most -recent version of
"Groundwater Quality, Monitoring: Compiiance'R.eport.FonW' (Le., GW-59 Form) with copies of
the laboratory- aualym& attached by tl e Division's Information- Processing Unit on or before the
last.working day of the-uwnth follawirrg-the sampling month.
b. For the initial sampling of new monitor well MW-5, the permittee shall submit a copy of the
OW-1 Form (Well .Construction Record) with the Compliance Monitoring Form (GW-59 Form).
Initial Compliance. Monitoring Forms that do not include copies of the GW-1 Form may be
returned to the -permittee withouvbeing processed. Failure to submit these forms as required by
this permit,may result -in the initiation of enforcement activities pursuant to NC General Statutes
143-215.6A.
c. All reports, maps,. and- other -&w-umeatsts .required in the. "Groundwater Requirements" section of
this permit shall be.mailed to.thefollowing address:.

d. Within thirty (30).days-of comptetibn of all well construction activities, a certification must be
received from a -professional. engineer -or a 41censed geologist- certifying that the new monitoring
well, designated-as-MW-5, is located accordingto this permit:
4. AppIicable Rotrndaa Requirements:
a. The COMPLIANCE BOLND-AR for the: disposal system is -specified by regulations in 15A
NCAC 2L, Groundwater Classifications and Standards. The-- Compliance Boundary for the
disposal system individuali_y permitted prior to December a0l; 1983 is established at either (1) 500
feel -from the -waste disposal- area; or (2) at the property boundary, whichever is closer to the
waste disposal area. tin- exceedanre' of Groundwater Quality Standards at or beyond the
Compliance Boundary is- subjecf to immediate remediation action according to 15A NCAC 2L
.0106(d)(2J.
b. The REVIEW BOUNDAR is established' around- the disposal systems midway between the
Compliance Boundary and-the_pesimeter of the waste disposal area. Any exceedance of standards
at thelltvi&w Boundary shall require action in accordance with 15A NCAC 2L .0106(d)(1).
Other Requirements:
a. Any additional grotindwater-quatity monitoring, as -deemed 'necessary by the Division, shall be
provided.
V. iNSPECIZONS
Adequate inspection, nuintenanec, and: cllea�_shall*be, provided by the-Permittee to insure proper
operation of the subject facilities..
2. The Permittee or his -designee shall inspect -the wastewater -treatment and disposal facilities to prevent
nrarinn
malfunctions and deteri_ operator errors and discharges -which may cause or lead to the release
of wastes- to- the- euvironmexi#, a threat to -human health, or a nuisance. The Perrnittee shall maintain
an inspection log of surnmary including at least the date antr time of inspection, observations made,
and any. maintenance-, repairs-, or -correvtive actions taken by the Perrnittee. `his log of inspections
shall be-rnairrtained bythe Permittee for a period of three years from the, date. of the inspection and
shalYbe mad-e avajrafi� rn thF n;.rioi. " -- -+I- -. -,_ :.� _ - -- - .
3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of
credentials, enter and inspect any property, premises or place on or related to the disposal site or
facility at any reasonable time for the purpose of determining compliance with this permit, may
inspect or copy any records that must be maintained under the terms and conditions of this permit,
and may obtain- samples of groundwater, surfhoe water, or leachate.
VL GENERAL CONDITIONS
1. This permit shall become • voidable unless the faeilities are constructed in accordance with the
conditions of this permit, -the approved plans and specifications, and other supporting data.
2. This permit is effective , only with respect to the nature and volume of wastes described in the
application and other supporting data.
This permit is not teansfemlAe. k the event there is a rleske for the facilities to change ownership, or
there is a name change-of-the-Permittee; alforrnal permit- request must be submitted to the Division
accompanied.'by an appiicatiorr-fee; documentation from, the parties ' involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits and
may or may not be approved.
4., The subject wastewater treatment- and disposal facilities shall" be.connected to an operational publicly
owned wastewater collection -system within 180 days of its availability to the subject facilities, if the
subject wastewater treatment or disposal facilities are in noncompliance with the terms and
conditions of this non -discharge permit or the governing statutes or regulations. Prior to the initiation
of these connection activities, appropriate approval must'be received from this Division.
The annual adminiate g.and compliance fee_must be.paid'by the Permittee within thirty (30) days
after being billed by -the -Division. Failure to pay, the fm ar..eordingly may cause the Division to
